SUBJECT: Resolution of Issues Raised by Owners of Placerita Canyon
DEPARTMENT: City Manager
BACKGROUND
Because of the destruction of the Hart High Auditorium from the Northridge Earthquake, a new
location for the Cowboy Poetry Festival had to be found.
City staff entered into an agreement with Melody Ranch to provide a site for the event. To
access Melody Ranch, Festival patrons would need to travel along the privately owned sections
of Placerita Canyon Road.
City staff has meet with owners of Placerita Canyon Road and the owners have requested that
the following items be undertaken by the City.
1. That the Speed P.A.R.E.T. be placed on the public portion of Placerita Canyon Rodd.
2. That a Sheriff's Unit be placed at the comer of Oak Creek and Placerita Canyon Road.
3. That major pot holes on Placerita Canyon Road be filled prior to the event.
4. That Oak Creek Road be smoothed, and pot holes filled.
5. That a Sheriffs Posse(mounted patrol) be active in the area of Placerita Canyon Road
between Oak Orchard and Oak Creek Roads.
6. That the City indemnify them from accidents from Festival patrons from 6:00 p.m.,
March 25, 1994 to 6:00 p.m., March 27, 1994,

City staff concurs with these requests and brings before you tonight request Number 6.
Attached, for your review and approval, is a proposed indemnification agreement for the
Placerita Canyon Road owners which narrowly defines the City's liability.
RECOMMENDATION
That the City Council direct the City Manager to execute the attached indemnification
agreement..

LIMITED INDEMNITY
The City of Santa Clarita, a municipal corporation, hereby agrees to indemnify, defend, and
hold harmless the property owners holding title to the privately -owned portion of Placerita
Canyon Road within the City of Santa Clarita, from any and all claims for damages resulting
from the use of the privately -owned portion of Placenta Canyon Road by the City -contracted bus
shuttle or by persons attending the Cowboy Poetry, Music and Film Festival during the period
commencing 6:00 p.m. Pacific Standard Time on March 25, 1994, and ending at 6:00 p.m.
Pacific Standard Time on Mach 27, 1994. Said indemnity specifically excludes any negligent
or intentional act or omission of the property owners holding title to the privately -owned portion
of Placenta Canyon Road within the City of Santa Clarita.
