Acquisition of Master Leasehold Interests at 21340 Soledad Canyon Road

BACKGROUND
The alignment for the Chuck Pontius Commuter Rail Trail was previously adopted at the
regularly scheduled City Council meeting of May 24, 1994. In order to accommodate minimal
trail widths, this alignment will require demolition of the facility at 21340 Soledad Canyon
Road (commonly known as Far West Rent-A-Car).
Under the terms of the general use agreement between the City and the Metropolitan
Transportation Authority (MTA), the City will be permitted to purchase the master lease and
sublease interests at 21340 Soledad Canyon Road. Although the MTA use agreement has not
yet been fully executed, the MTA is aware of and does not object to the City's relocation
efforts regarding this facility in order to maintain the project schedule. These relocation
efforts consist of two major tasks: acquisition of the master leasehold interests, and
relocation of the businesses operating out of the facility.
The facility at 21340 Soledad Canyon Road is owned by Sandra Cone and Cheryl Cron of
Crescent City, California. Cone and Cron also hold the master leasehold interests with the
MTA. Cone and Cron do not operate any businesses out of the facility; they have subleased
the facility to Far West Rent-A-Car. Far West Rent-A-Car operates a portion of the facility,
but has also entered into lower -tier subleases with two other firms: Down and Under (Ski
Wear), and Comfortubs.
R. P..Laurain & Associates has completed their appraisal of the facility, and a negotiated
settlement of $26,200 has been reached with Cone and Cron for the building acquisition and
for the master leasehold interests with the MTA. Staff requests City Council authorization
to purchase these interests for the sum of $26,200, and that the Mayor be authorized to sign
the appropriate acquisition documents on behalf of the City.
Funds, through a discretionary Proposition C grant, are available in account no. 17-99029-227
for this purpose.

Once the acquisition documents are executed, staff further requests authorization to
terminate tenant and subtenant agreements, and to issue the appropriate 90 -day notices to
vacate. Provided that tenants display a good faith effort toward relocation, staff requests
that the City Manager be authorized to use his discretion to extend the notice to vacate date
through March 30, 1995.
RECOMMENDATION
1. City Council authorize purchase of the facility and all master leasehold interests
commonly known as 21340 Soledad Canyon Road, Santa Clarita, California for the sum
of $26,200; and that the Mayor be authorized to sign the appropriate acquisition
documents on behalf of the City.
2. City Council subsequently authorize termination of tenant and subtenant agreements,
and direct that notice to vacate documents be issued. Provided that tenants display a
good faith effort toward relocation, and provided that interim rents are submitted in a
timely manner, City Council to authorize the City Manager, at his discretion, to extend
the notice to vacate date through March 30, 1995.

We have been offered $50,000 for companies which combined I feel are worth
$300,000. Yes that $50,000 might pay for our loss of business plus relocating us to a
"store front" rent -a -car similar to one of our competitors on Creekside Drive, But
does the City really want to have to contend with the parking of some 80 cars and
UHaul trucks on already overcrowded Creekside drive?
At this time I request that you table Agenda Item #12 to be reconsidered at your
December 13 meeting. This will allow us to meet further with your staff to negotiate
a final settlement which will be amicable to both parties and act as a model to the
future of small business in the Santa Clarita Valley.
