SUBJECT: Chuck Pontius Commuter Rail Trail - Project No. 99-029
Relocation of "Comfortubs" and "Down and Under"
DEPARTMENT: Parks, Recreation, and Community Services
BACKGROUND
The alignment for the Chuck Pontius Commuter Rail Trail was previously adopted at the
regularly scheduled City Council meeting of May 24, 1994. In order to accommodate minimal
trail widths, this alignment will require demolition of the facility at 21340 Soledad Canyon
Road (commonly known as Far West Rent-A-Car).
Under a separate agenda item presented to the City Council on this date, staff has requested
authorization to acquire the master leasehold interests to the facility. Provided that the City
Council approves this request, termination of tenant and subtenant leases may proceed in
accordance with State relocation guidelines. Currently, one tenant (Far West Rent-A-Car)
and two subtenants (Comfortubs, and Down and Under) occupy the facility.
One of the subtenants, Comfortubs, has agreed to relocate their business and vacate the
premises by December 1, 1994. In accordance with relocation guidelines, Comfortubs will be
eligible up to $10,000 for re-establishment costs over an 18 -month period from the date of
vacation.
The other subtenant, Down and Under, would like to take advantage of either
re-establishment costs or "in -lieu" opportunities afforded under the relocation guidelines, and
has agreed to vacate the premises by March 30, 1995. Provided these costs can be
substantiated, this could total up to $20,000.
Staff requests City Council authorization to proceed with these business relocations, provided
that the acquisition of the master leasehold interests (provided under separate agenda report
this date) is approved. It should be noted that negotiations with the third tenant, Far West
Rent-A-Car, are still in process. Staff will be submitting a recommendation regarding Far
West once these negotiations are reconciled.
Funds, through a discretionary Proposition C grant, are available in account no. 17-99029-227
for this purpose.

RECOMMENDATION
City Council authorize relocation payments for Comfortubs up to $10,000 and relocation
payments for Down and Under up to $20,000. All costs to be substantiated and in
conformance with State relocation guidelines.
