Caravalho February 22, 1994 REDEVELOPMENT AGENCY COMMUNITY RECOVERY PLAN City Manager Council has directed staff to proceed with the preparation of a Community Recovery Plan pursuant to the Community Redevelopment Financial Assistance and Disaster Law. The primary purposes of the Plan are designed to: 1. Provide earthquake disaster relief; 2. Provide community infrastructure; 3. Conduct economic development/community revitalization activities as contained in the General Plan; and 4. Undertake improvements in community housing. State law requires a Public Hearing to be conducted as part of the Agency's formal consideration' of the Plan. Such a hearing has been noticed and scheduled at this point on the Agency's Agenda. This Section authorizes FFMA to pay the City a lump Sum for repairing owner -occupied dwellings to a habitable condition, as long as these homes are capable of being restored quickly. 'rhe mobile home repairs will include resetting,' releveling, reconnecting utilities and tiedowns to make the units liveable. This assistance is funded under the Human Services Program, which can assist individuals. in obtaining housing; this I;.ogram can not include reimbursement of the city's administrative jets. As of Saturday, a FEMA inspector ar.rivod at Santa clarita in order to ascertain the damages which were sustained by the Ci-y'a mobile home owners. 111 order for this process to be suceoaaful, the City of santa Clarita must provide FEMA with the names and addresses of each mobile home owner.who has decidod to participate in the City's program, prior to disbursing funder, the city will need to perform the following: 1. An agreomont from the owner which indemnifies the City and FEMA against all liability and claims which may result from thio program, or a term ilk tine lnastkr contract indicating that the contractor has adequate liability insurance; 2. Please inform the owners who want to benefit from this pro ram that themay be eligible for transient accommodation assistanpa but will ll be ineligible for duplicative repair work or for tomporary housing assistance, ie., for three -months rental assistance. In the signed letter/document., the owner will have to agree tc return any duplicative assistance. 90 if an Owner has received FEMA transient housing assistance and has used the funds for hotel rooms or to rent housing for a raw weeks, the owner does not need to return any funds. At then end of the program, the City will need to .provide FEMA With docunK9ntatiOn of how the funds were spent. FrMA will need a copy of the form letter which has the owner's s.ictnerturo and the above information so that FEMA may place it in the owner's files. A sample letter is attached. Please be aware that FEMA may have provided to these owners emergency housing grants whivll can be used for the immediate repair of their mobile domes. If the mobile home owners have received such assistance and 'save repaired their mobile home, there will be no need for these Owners to participate in this proqram. RDA 94-3 A RESOLUTION OF THE LEGISLATIVE BODY OF THE SANTA CLARITA REDEVELOPMENT AGENCY FINDING THAT THE ADOPTION OF THE SANTA CLARITA COMMUNITY RECOVERY PLAN AND ALL RELATED DOCUMENTS IS EXEMPT AS A PROJECT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT THE LEGISLATIVE BODY OF THE SANTA CLARITA REDEVELOPMENT AGENCY HEREBY DOES RESOLVE AS FOLLOWS: SECTION 1. The Legislative Body of the Santa Clarita Redevelopment Agency does hereby find, determine and declare as follows A. Commencing on January 17, 1994, an earthquake registering at least 6.6 on the Richter scale occurred, and was followed by a continuing series of aftershocks in and along fault lines in and/or adjacent to the City ("Disaster"); and B. Preliminary estimates of damage to buildings and structures within the City indicate that damage caused by the Disaster in the City is estimated at Two Hundred Ten Million Dollars ($210,000,000.00); and C. President Bill Clinton declared the area in the City to be a major disaster under federal law on January 17, 1994; and LAX:82144.3 D. Governor Pete Wilson of the State of California declared a State of Emergency in Los Angeles County on January 17, 1994; and E. The City Manager and the City Council of the City issued a Proclamation of Local Emergency in the City of Santa Clarita on January 17, 1994; and F. The City Council of the City responded in part to the Disaster by directing the Santa Clarita Redevelopment Agency to prepare a Redevelopment Plan for the Santa Clarita Community Recovery Project Area (the "Project Area") pursuant to the Community Redevelopment Law of the State of California (Health and Safety Code Section 33000 et sea.) ("CRL") and the Community Redevelopment Financial Assistance and Disaster Project Law (Health and Safety Code Section 34000 et sea.) ("Disaster Law"); and G. The Santa Clarita Redevelopment Agency has prepared the proposed Santa Clarita Community Recovery Plan ("Plan") in response to said direction; and H. The adoption of the Plan and all related documents ("Project") is a Project under the California Environmental Quality Act, Public Resources Code Section 21000 et sect. ("CEQA"); and ux:e2149.3 -2- I. The Agency has examined the Declaration of Lynn M. Harris, Deputy City Manager and the Director of Community Development for the City who serves as the Environmental Officer in the City; and J. The Agency concurs with Ms. Harris's findings and conclusions that the Project is exempt from CEQA as stated below; and K. That the Project is exempt from CEQA under Public Resources Code Section 21080(b)(3) because it is a project undertaken and carried out by the Santa Clarita Redevelopment Agency to maintain, repair, restore, demolish, or replace property or facilities damaged or destroyed as a result of a disaster in a disaster -stricken area which the Governor of California has proclaimed a state of emergency pursuant to Chapter 7 (commencing with Section 8550) of Division 1 of Title.2 of the Government Code; and L. The Disaster constitutes an "emergency" within the meaning of Public Resources Code Section 21060.3 ("Emergency") in that the Disaster was a sudden, unexpected occurrence, involving a clear and imminent danger, demanding immediate action to prevent or mitigate loss of, or damage to, 'life, health, property or essential public services; and that the Project is exempt as a project from the provisions of CEQA under Public Resources Code LAX:82149.3 -3- Section 21080(b)(4) because the Project is necessary to mitigate such an emergency; and M. Further, that the Project is exempt from CEQA under CEQA Guidelines Section 15269(a) and (c) for the above - stated reasons. SECTION 2. That the Agency has reviewed the proposed Notice of Exemption relating to the Project and has determined that the same was properly prepared in accordance with CEQA and the State and local guidelines. The said Notice of Exemption is hereby accepted and ordered filed. SECTION 3.
