Deputy City Manager 1 d December 13, 1994 SOLID WASTE FRANCHISE AMENDMENT Resolution No. 94-130 Public Works The residential refuse franchise agreement provides for rate modifications based on changes in landfill tipping fees and the Producer Price Index (PPI). Increased landfill tipping fees of up to 25 % may be passed on to customers through rate increases following a written request to the Public Works Director; increases of more than 25 % require approval of the City Council. The terms of the franchise agreement require that PPI adjustments occur in January of each year and also require City Council resolution. At the City Council Study Session held on November 1, 1994, staff reported to Council that adjustments to the existing refuse rates effective January 1, 1995 would be presented at the Council meeting in November or December. REFUSE RATE ADJUSTMENTS Single Family Tipping fees at Laidlaw/Chiquita Canyon landfill will increase by $1.38 per ton on January 1, 1995. This translates to a 1.29% increase in monthly rates which equals $0.25 per household per month. In addition, the changes in the PPI reflect a 0.74% increase which represents an increase of $0.14 per household per month. These incremental changes distributed over the total waste disposal tonnages and operational expenses for single family households represent an increase of 2.03 % or $.39 per household per month.. Attachment A includes the rate adjustment summary. Multi -Family Multi -family accounts will be affected by an increase of 1.51 % in monthly rates due to landfill disposal fees and a 0.7% increase for the PPI adjustment, therefore the monthly rates are to be adjusted by an average 2.21 % (see attachment A). However, increased landfill tipping costs assessed the haulers can be passed on to customers in the interim period. RECOMMENDATION Adopt Resolution No. 94-130 which amends the schedule of rates in the franchise agreement to reflect a 2.03 % increase in rates for single family households and 2.21 % for multi -family bin accounts. The residential refuse franchise agreement provides for rate modifications. Rate modifications are built on direct pass through for landfill tipping fees and increases in the PPI. The terms of the franchise agreement require that PPI adjustments occur in January of each year and also require City Council resolution. The hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, 1st Floor, Santa Clarita, the 13th day of December, 1994, at or after 6:30 p.m. Proponents, opponents, and any interested persons may appear and be heard on this matter at that time. Mayor announces decision RESOLUTION NO. 94-130 A RESOLUTION OF THE CITY OF SANTA CLARITA, CALIFORNIA ESTABLISHING A SERVICE FEE SCHEDULE FOR THE COLLECTION, RECYCLING AND DISPOSAL OF SOLID WASTES, GREEN WASTES AND RECYCLABLES WHEREAS, the City of Santa Clarita has adopted Resolution No. 91-27 relating to the granting of an exclusive franchise for the collection, recycling and disposal of solid wastes, green wastes and recyclables within the city limits; and WHEREAS, the City Council has entered into an agreement with Santa Clarita Disposal Company, Blue Barrel Disposal Company, and Atlas Refuse Removal Company to collect, pick up and remove, recycle and dispose of solid wastes, green wastes and recyclables from all single family residences and all multi -family residences in the City of Santa Clarita, and WHEREAS, from time to time the landfill tipping fees fluctuate and the franchise grantees should be compensated for those increases over which they have no control; and WHEREAS, On October 17, 1994 results of the City's rate adjustment analysis confirmed increases in landfill tipping fees which reflect an increase in rates of one and twenty-nine hundredths percent (1.29%) to single family households accounts and one and fifty-one hundredths percent (1.51 %) to multi -family accounts, and WHEREAS, the City's franchised residential haulers currently utilize the Chiquita Landfill, such action will impose a direct impact upon all City residents, and WHEREAS, Section 21B of the City's residential refuse and recycling franchise agreement provides for annual modification and adjustment of rates due to changes in the Producer Price Index, and WHEREAS, increases due to incremental changes in the Producer Price Index reflect an increase of seventy-four hundredths percent (.74%) to single family households and seven tenths percent (0.7%) to multifamily bin accounts, and WHEREAS, Resolution No. 94-130, hereinafter superseding Resolution No. 94-4, authorized to impose fees necessary for collection services of solid wastes, green wastes and recyclables to all Santa Clarita residents. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Santa Clarita, as Follows: Section 1, The attached Exhibit A-95 represents the revised service fee schedule for the collection, recycling and disposal of solid wastes, green wastes and recyclables, as of January 1, 1995. Section 2. Landfill tipping fees that are increased less than 25 percent may increase the service rate to each customer and shall be apportioned on a pro -rata basis. The increased service rate shall be implemented 30 days after notifying the City Manager and pursuant to Section 21D, Residential Solid Waste Franchise Agreement. Section 3.
