Nisich CONSENT CALENDAR DATE: December 13, 1994 SUBJECT: TRAFFIC MODEL USER AGREEMENT DEPARTMENT: Community Development BACKGROUND The City of Santa Clarita and the County of Los Angeles, in cooperation with each other, have developed a "Joint City/County Traffic Model". The model can be used for forecasting traffic volumes, testingdevelopment scenarios; and is an important, tool,in establishing the circulation network of the General Plan to accommodate future traffic volumes. On May 25, 1993, the City of Santa Clarita and the County of Los Angeles jointly executed a Memorandum of Understanding (MOU) for the future use of the "Joint City/County Traffic Model" (Exhibit 1). The main purposes of the MOU are to: 1. Provide a process which the City and County would follow in order to update the model periodically and use the model in testing traffic impacts related to proposed developments. 2. Provide a vehicle for the City and the County to recover some of the cost incurred by the two agencies in producing the model. The MOU has provisions for charging each developer a certain fee to run the model for their project or to lease the model to large developers who are interested in performing several model run alternatives on their own, The Memorandum of Understanding provides a mechanism for private developers to request the City and the County to lease the model in order to test development scenarios and traffic volume projections for various projects. The City of Santa Clarita and the County of Los Angeles have agreed on a fee of $10,000 to be charged for developers who wish to lease the model for extensive testing of scenarios. The proceeds from the lease shall be allocated between City and County, based upon model development cost to each agency. The fee is in accordance with Section V of the MOU executed by the two agencies. Agenda Item: TRAFFIC MODEL USER AGREEMENT December 13, 1994 -Page 2 1. Establish and approve the attached joint City/County Traffic Model Memorandum of Understanding. 2. Establish a traffic model lease fee of $10,000, and authorize the City Manager to execute lease agreements with developers according to the criteria outlined in the Memorandum of Understanding, subject to the approval of the City Attorney as to form. BY AND BETWEEN and THE LOS ANGELES COUNTY DEPARTMENT OF PUBLIC WORKS hereinafter referred as "COUNTY"; THE CITY OF SANTA CLARITA A subdivision of the State of California hereinafter referred to as "CITY"; WITNESSETH WHEREAS, the CITY and COUNTY have recently completed a joint computerized traffic model for the Santa Clarita Valley area, hereafter referred to as "Model"; and WHEREAS, CITY and COUNTY have a need to cooperate on decisions involving traffic circulation and land use in the Santa Clarita Valley; and WHEREAS, the model requires periodic maintenance and updating; and WHEREAS, both CITY and COUNTY desire to share Model data including modeling for development projects, traffic studies, road and interchange scoping, and other uses of common,.interest; and WHEREAS, the CITY presently does not have the staffing capabilities to test and run the joint Model; and NOW, THEREFORE, it is agreed as follows: CITY and COUNTY will cooperate as outlined in the Guidelines for Model Use included as Attachment A, in Model maintenance and updating, testing, development projects, traffic studies, road and interchange scoping, and other uses of common interest; and COUNTY will provide modeling services to CITY for projects within CITY boundaries as requested by CITY thifough a Service Request. Harris, Deputy City Manager Community Development ATTACHMENT A May 13, 1993 GUIDELINES FOR MODEL USE I. MODEL USAGE AND MAINTENANCE 1. Both agencies shall have and use the Model. 2. County and City shall meet as necessary and at a minimum once every 6 months to update modeling data (land use, road improvements, plan amendments, etcetera). 3. Upon review and approval of interim update data by one agency, the data shall be sent to the other agency. 4. Developer projects within the City's boundaries shall be tested, reviewed, and approved by the City; projects in all other areas shall be tested, reviewed, and approved by the County. Results of tests by either agency shall be sent to the other agency.. 5. Developers utilizing Model output shall be charged a Model Development Recovery Fee to defray consultant contract costs and agency refinement costs for development of Model. The Model Development Recovery Fee is specified in Section III. II. Current Available Modeling Products Model runs will only include Link Volumes at this time. Link Volumes may be provided for AM, PM, off-peak and ADT. In addition, volume/capacity ratios may also be provided. Turning volume data will be available at a future date. III. Model Development Recovery Fee The above fee is based upon the following: 1. Model Testing Cost: Based on estimated time and material. 2. Model Development Recovery Cost: (a) 50 percent of Model Testing Cost for fees up to $10,000 (b) For Model Testing Cost over $10,000; 508 for the first $10,000 and 258 for portion of fee in excess of $10,000. 3. All fees shall be paid in advance by applicant. Proceeds from the Model Development Recovery Fee shall be allocated between City and County based upon the model development cost to each agency. IV. Disclaimer Developer/applicant will be required to sign a "Disclaimer and Conditions for use of Modeling Data" prepared by the Los Angeles County Department of Public Works and the City of Santa Clarita, Department of Community Development. V. Model Leas Developers needing the model for numerous testing scenarios may lease the model through a "Lease Agreement" for a one year period at a cost to be agreed upon by the City and County. This lease will entitle the developer to receive all updated modeling data from the CITY and/or COUNTY for the period of the lease. After deduction of time and material costs for lease obligations, the remaining proceeds from the lease agreement shall be allocated between City and County based upon Model development cost to each agency.
