BOUQUET CANYON TRANSFER AGREEMENT
Community Development
Increasing development in Bouquet Canyon by a group of owners/developers, designated as the
Bouquet Canyon Second Access Group, has led to the establishment of the Bouquet Canyon
Second Access Agreement in 1984. Los Angeles County and the developers in question made
an agreement to construct highway and bridge improvements to provide better access to
Bouquet Canyon. From this agreement, the Bouquet Canyon Second Access Group Fund was
established. This fund is a compilation of financial contributions from the Second Access Group
to help expedite the construction of the designated road improvements.
In 1987, when the City of Santa Clarita was incorporated, the Bouquet Canyon Access
Agreement phase 2, which consists of constructing Newhall Ranch Road from Bouquet Canyon
Road to Rio Vista Drive, and Rio Vista Drive from Bouquet Canyon Road to Newhall Ranch
Road, was enveloped within City boundaries.
Los Angeles County has now presented the City with the option of securing the Agreement
through a transfer agreement document. The City Engineering staff has reviewed the
Agreement and has expressed a willingness to accept the Bouquet Canyon Second Access Group
Fund Transfer Agreement.
The Bouquet Canyon Second Access Group Fund Transfer Agreement is a mutual agreement
between Los Angeles County and the City of Santa Clarita, whereby the remaining scheduled
road improvements to provide access to and from Bouquet Canyon will be soley supervised by
the City of Santa Clarita. Los Angeles County will transfer all funding, conditions, and
obligations over to the City, with the, primary condition that the City utilize all funds for the
aforementioned road improvements.

The City Council adopt Resolution No. 95-31, approving the Bouquet Canyon Transfer
Agreement, whereby all funds, in accordance with the agreement, will be placed in a separate
account to be used soley for the purpose of construction of phase 2 of the Bouquet Canyon
Second Access Group Fund Transfer Agreement, which is beneficial for the purpose of
establishing access in and out of Bouquet Canyon, pursuant to Government Code Section 66484
and 66489.

RESOLUTION NO. 95-31
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA
BOUQUET CANYON TRANSFER AGREEMENT
WHEREAS, City was incorporated on December 15, 1987 and the site of phase 2,
construction of Newhall Ranch Road and Rio Vista Drive is now located entirely within the
boundaries of City; and
WHEREAS, the City has indicated its willingness to use the remaining funds
collected by County under the Second Access Agreement to complete phase 2 as provided under
Second Access Agreement, and
WHEREAS, Second Access Agreement is binding on the parties' successors, and City
is the jurisdictional successor to County; and
WHEREAS, pursuant to the provisions of
(1) Government Code 66484: A local Ordinance may require the payment of fees as
a condition of approval of a final map or as a condition of issuing a building permit for the
purposes of defraying the actual or estimated cost of constructing bridges over waterways,
railways, freeways, and canyons, or constructing major thoroughfares.
Section a. The Ordinance refers to the circulation element of the general plan and
... in the case of major thoroughfares, to the provisions of such circulation element which identify
those major thoroughfares whose primary purpose is to carry through traffic and provide a
network connecting to the state highway system; provided, such circulation element,
transportation or flood control provisions have been adopted by the local agency 30 days prior
to the filing of a map or application for a building permit.
(2) Government code 66489: Any local agency may establish area of benefit
pursuant to Section 66484 and may impose a reasonable charge on property within the area
which in the opinion of the legislative body, is benefited by the construction of the bridge or
major thoroughfare... (and) may enter into a reimbursement agreement with the subdivider.
THEREFORE, The City of Santa Clarita, California does declare, determine, and
resolve to execute the Bouquet Canyon Second Access Group Fund Transfer Agreement
contained within "Exhibit A," for the area of benefit shown on "Exhibit B".
