Nisi SUBJECT: SANTA CLARITA DRAINAGE ASSESSMENT AREA 18, TRACT NO. 44965 LOCATED AT SHANGRI-LA DRIVE AND NATHAN HILL ROAD - ANNUAL ASSESSMENT FOR FISCAL YEAR 95-96 RESOLUTION NO. 95-63 DEPARTMENT: Community Development This item is to conduct the public hearing to establish the annual assessment. This public hearing date was set during a public information meeting at the City Council meeting of May 23, 1995. The City of Santa Clarita had previously established Drainage Benefit Assessment Area No. 18 to provide for the maintenance of a subsurface drainage system constructed to ensure stability of the building pads and slopes constructed for Tract No. 44965 (see attached report). The proposition was submitted to the eligible voters in this area, and a majority of voters approved the formation of the District and the levying of the assessment. Each year in June thereafter, the City Council determines and imposes an annual assessment to cover the costs of maintaining the system. Additional geologic work was recommended in independent geologic reports done in April and December of 1994. The annual report done by the City's geologist, as part of the required annual geologic evaluation supported the recommendation that additional work is required. The work involves installing monitoring wells, evaluating the data from the wells and installing dewatering devices where indicated based on the evaluations of the data. The estimated assessment last year was $109.00 per unit. The estimated assessment for Fiscal Year 1995-96 is $159.00, the same as the adjacent assessment district, Area No. 6. The additional assessment will pay the costs to mitigate a high ground water condition by installing dewatering devices and for other required major repairs to the existing system. The affected property owners have been notified by mail of the proposed increase in assessment and public hearing in compliance with Senate Bill No. 1977. Staff was directed during the public information meeting at the City Council meeting of May 23, 1995, to receive public input and participation on this issue. Notices were mailed to all property owners listed on the latest tax roll. There were six people present, which included the major landowner for the District. A slide presentation was given, and the geology of the area and the need for an assessment district were discussed. The following concerns were brought forward by the participants of this meeting: 1. The developers of the new units should be responsible for the water problem. 2. Is this rise in ground water a serious problem? 3. How can City Council approve something when a solution hasn't been decided yet? 4. What about the over irrigation of currently landscaped areas and rodent problems? The following responses were offered by staff to these concerns: 1. As shown in the City's Engineering Report, much of the water problem is immediately adjacent to or within already developed areas of this development. Also, if the developer decided not to build at this time, the DBAA would still be responsible for maintaining this area. 2. The Geotechnical professionals agree that if the water level remains at the existing levels, additional problems may result. The developer's geologist has expressed concern and the City's Engineering Report expressed concern, over the high ground water in this development. The specifics of how serious and over what extent the problem lies will be re-evaluated after the recommended wells are installed and monitored. 3. It was explained that the Council only approves an estimated budget amount and that all work is separately authorized. The budget must be decided at a Council meeting before August 1,1995 in order for the assessments to be effective next year. It was also emphasized that staff has been working diligently with both developers in the area for the last year to resolve this ground water issue. Staff feels that the investigation that the City's consultant is currently conducting will produce an effective action plan to resolve this problem. The increase of $50 in fee is necessary at this time to cover the costs associated with the current well installation and monitoring study, as well as provide for maintenance and monitoring of these new wells in the future. Any mitigating measures called for in the action plan that this report calls for will be addressed at that time. Staff will be utilizing a landscape contractor to do a complete walk-through of all landscaped areas to check every single controller and irrigation system. This will help to determine where any over irrigation is taking place. Also, rodent problems will be addressed during the walk-through. The results of this walk-through will be discussed with the City's consulting geologist to determine what effects any problems found might have upon the ground water. The purpose of the District is to provide the mandatory maintenance for the existing subsurface drainage system, pump station and observation wells. The proposed maintenance cost is $159.00 per unit per year which is included on the tax bills for the properties in the district. The assessment last year was $109.00 per unit per year. The reason for the increase is due to the costs of mitigating the high ground water condition by installing de -watering devices and the district's portion of earthquake evaluation and repair.. City Clerk NED:lkl dlthd\pndbu .18 RESOLUTION NO. 95-63 DRAINAGE BENEFIT ASSESSMENT AREA NO. 18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DETERMINING AND IMPOSING ANNUAL ASSESSMENT WHEREAS, The Board of Supervisors of the County of Los Angeles, State of California, established Drainage Benefit Assessment Area No. 18 on July 25, 1989, pursuant to the Benefit Assessment Act of 1982, Chapter 6.4 of Part 1, Division 2 of Title 5 of the Government Code of the State of California, finance the operation and maintenance of drainage facilities constructed and dedicated as required for the recordation of a subdivision of land known as Tract No. 44965; and WHEREAS, Tract No. 44965 has been recorded and drainage facilities have been constructed; and WHEREAS, this former County area has now become within the jurisdiction of the City of Santa Clarita; and WHEREAS, the Engineer's Report containing a description of the service proposed, the revenue to be derived from the assessments, and a description of each parcel of real property proposed to be assessed for these services, has been filed with the City Clerk and presented to and considered by the City Council. NOW THEREFORE, BE IT RESOLVED; SECTION 1. That the City Council of the City of Santa Clarita hereby determines that the assessment set out in accordance with the Engineer's Report for Drainage Benefit Assessment Area No. 18 on file with the City Clerk of the City of Santa Clarita sets out the reasonable cost of the service provided. Description of the Service The proposed service involves the maintenance and operation of the subsurface drainage system and pump station constructed for Tract No. 44965. Included also is the maintenance of the access road to the pump station, the fences and walls and appurtenances pertaining to the subdrain system. Tract No. 44965 is located near Soledad Canyon Road and Sierra Highway, in the City of Santa Clarita as shown on Exhibit "A." Maintenance and operation of the subsurface drainage facilities involves- 1) periodic inspection, monitoring and evaluations; 2) well and access shaft unclogging and clean out where necessary; 3) maintenance of the one pump station; 4) annual geologist review with a report and recommendations and 5) installation of dewatering devices and other mitigation measures. The estimated total annual cost to provide this maintenance is $45,156. 2. Benefit Area The area located within the district boundaries shown on Exhibit "A" is the area of benefit, and the imposition of the benefit assessment will be restricted to this area. 0The basis of benefit was determined to be dwelling units, i.e., one dwelling unit = one benefit unit. Tract No. 44965 indicates there will be 284 dwelling units proposed. At this present time, many units have not been built; therefore, a proportional amount was levied upon each of the existing parcels. Assessor's parcel numbers with a zero assessment are common areas which will have no dwelling units on them, Drainage Benefit Assessment Area No. 18 is comprised of 284 dwelling units on 74 parcels as listed below. If changes occur in assessor's parcel numbers, the proposed assessment will be apportioned according to the basis of benefit.
