Stiles CONSENT CALENDAR DATE: November 14, 1995 SUBJECT: EXCHANGE OF PROPERTY TAX REVENUES - ANNEXATION NO. 269 TO SANITATION DISTRICT NO. 26 Resolution No. 95-124 DEPARTMENT: Community Development ICS • .C� 1►t When a property not located within the existing boundaries of a Sanitation District is proposed for sewer connection, it must be annexed to the appropriate Sanitation District. In order to provide treatment services, the District must share in the increase in tax revenue from the property with all of the existing taxing agencies, including the City. The District does not receive any of the base tax rate of the property prior to annexation; it shares only in the increase represented by the Annual Tax Increment (ATI), if any. In order to share in the increase in revenue, the District must adopt a joint resolution with the Board of Supervisors of the County of Los Angeles, which acts on behalf of the local agencies receiving an apportionment of the property tax. RECOMMENDATION Adopt Resolution No. 95-124, approving and accepting the negotiated exchange of property tax revenues resulting from Annexation No. 269 to Sanitation District 26. RESOLUTION NO. 95-124 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES ACTING IN BEHALF OF Los Angeles County General Fund Los Angeles County Library Los Angeles County Flood Control Los Angeles County Fire Protection District Los Angeles County Fire - FFW THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 26 OF THE COUNTY OF LOS ANGELES, AND TIIE GOVERNING BODIES OF City of Santa Clarita Castaic Lake Water Agency Greater Los Angeles County Vector Control District APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES RESULTING FROM ANNEXATION TO COUNTY SANITATION DISTRICT NO. 26. "ANNEXATION NO. 269" WIIEREAS, pursuant to Section 99 and 99.1 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution, and WHEREAS, the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to County Sanitation District No. 26 entitled Annexation No. 269. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to County Sanitation District No. 26 in the annexation entitled Annexation No. 269 is approved and accepted. 2. For each fiscal year commencing on and after July 1; 1996 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to County Sanitation District No. 26 a total of 1.1074 percent of the Annual Tax Increment attributable to the land area encompassed within Annexation No. 269. Said percentage has been determined on the basis of the following contributions. AGENCY PERCENT Los Angeles County General Fund .5014 Los Angeles County Library .0414 Los Angeles County Flood Control .0194 Los Angeles County Fire Protection District .2913 Los Angeles County Fire - FFW .0247 City of Santa Clarita .1120 Castaic Lake Water Agency .1166 Greater Los Angeles County Vector Control District .0006 TOTAL 1.1074 3. No additional transfer of property tax revenues shall be made from any other taxing agencies to County Sanitation District No. 26 as a result of annexation entitled Annexation No. 269. 4. No transfer of property tax revenues from properties within a community redevelopment project shall be made during the period that the entire tax increment is legally committed for repayment of the redevelopment project costs. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of County Sanitation District No. 26 and the governing bodies of City of Santa Clarita, Castaic Lake Water Agency and Greater Los Angeles County Vector Control District signatory hereto.
