Nisich-14 SUBJECT: INTENT TO VACATE RACQUET CLUB COURT DEPARTMENT: Community Development The residents of Canyon Country Racquet Club Condominiums have petitioned to the City of Santa Clarita to have Racquet Club Court, a cul-de-sac which leads into the condominium complex, vacated to install a gate for the following reasons: Racquet Club Court is exclusively used by the tenants of Canyon Country Racquet Club. To deter unwanted trespassers, e.g., solicitors and vandals. Increase pedestrian safety when accessing club amenities which are on both sides of the street. 4. The street is not targeted for extension. The vacation of Racquet Club Court has been reviewed and approved by the utility companies which have facilities which will be affected by the vacation. Those utility companies have no objection to the vacation on the condition that easements and right-of-way be designated for them to maintain and operate those facilities. Subdivision staff has examined all documentation and the California Street and Highways Code (CS&HC 8334) for the above request. The public street, Racquet Club Court, qualifies to be vacated under this code. RECOMMENDATION To set the date of Tuesday, July 11, 1995 to hold a public hearing on the vacation of Racquet Club Court pursuant to the California Street & Highways Code Section 8334; and that Council adopt Resolution No. 95-46. Adopted: O -' Resolution No. 95-46 Exhibit "A" MAM:lkl council\ar95d6.mnm RESOLUTION NO. 95-46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA DECLARING ITS INTENT TO ORDER THE VACATION OF RACQUET CLUB COURT IN THE CITY OF SANTA CLARITA WHEREAS, the cul-de-sac, Racquet Club Court as described, is no longer needed for present or prospective public use; and WHEREAS, the City of Santa Clarita and various utility companies will retain easements on, under, and across the portion to be vacated and have no objection to the vacation. NOW THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941 ", being Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine and order as follows: Section 1. That it is the intent of the City Council of the City of Santa Clarita, California to order the vacation of Racquet Club Court, as shown on Exhibit B" attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, County of Los Angeles, State of California, for it is not scheduled for extension or expansion and does not terminate public easements; that the subject right-of-way is not required for general public access or circulation or for bicycle paths or trails pursuant to Chapter 4, Part 3, Division 9 of the Streets and Highways Code, State of California, commencing with Section 8334. Section 2. That the hour of 6:30 p.m. on Tuesday, July 11, 1995 at the City Hall, 23920 Valencia Boulevard, within the City of Santa Clarita, is the time and place when and where any and all persons interested in or objecting to the proposed vacation of this public street may appear before the City Council to be heard, offer testimony, and submit evidence in relation thereto. Section 3. That the City Clerk of the City of Santa Clarita, California is hereby directed to cause "NOTICE OF STREET VACATION OF RACQUET CLUB COURT WITHIN THE CITY OF SANTA CLARITA, CALIFORNIA, AND PUBLIC HEARING THEREON' to be published and posted as required by the "Street Vacation Act of 1941", being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of the City of Santa Clarita hereby elects to proceed under the provisions of the Act. Section 4. The City Clerk shall certify to the passage of this Resolution and shall cause it to be published and posted in the manner prescribed by law.
