HomeMy WebLinkAbout1995-06-13 - AGENDA REPORTS - MOU CITY TRAILS DEVELOPMENT (2)AGENDA REPORT City Manager Approval Jr Item to -be presented by: Rick Putna f --ZS' CONSENT CALENDAR DATE: June 13, 1995 SUBJECT: Memorandum of Understanding: City Trails Development within Unincorporated Los Angeles County Areas DEPARTMENT: Parks, Recreation, and Community Services The City has identified a backbone trails system which includes three primary trails: the South Fork Trail, the Santa Clara River Trail, and the Bouquet Canyon Trail. The three primary trails travel through both City and County jurisdiction. The successful development of the City trails system is dependent upon obtaining the trail access through both City and County areas. In order to provide a continuous trail network, issues pertaining to the acquisition, construction, operation, and maintenance of City trails located in unincorporated territory need to be resolved. Working with the City Attorney's Office, County Counsel, and County Parks Staff, the Park Planning Section has prepared a Memorandum of Understanding (MOU) for construction and maintenance of City trails within L.A. County jurisdiction. (The MOU is attached to this report.) The agreement is an appropriate mechanism for setting forth a general procedure for current and future projects with respect to construction, maintenance responsibilities, and indemnification. Current City projects traversing the unincorporated area include: Bouquet Canyon Trail Phase II Santa Clara River Trail Phase II Santa Clara River Trail Phase III South Fork River Trail - Phase IV ion within North side of Newhall Ranch Road between McBean Parkway and Bouquet Canyon Road North side of river channel between Antelope Valley Freeway and Lost Canyon Road River corridor between Bouquet Canyon Road and existing Hart Ballfields (final alignment to be determined) South side of river channel between Valencia Boulevard and McBean Parkw y s A90T,da Item:._ This agreement would not permit the City to access privately held parcels within the trails corridor. Any specific license agreements must be obtained prior to accessing parcels for the purpose of trails development. Approve the Memorandum of Understanding with respect to the City Trails System, and direct staff to proceed with obtaining the Board of Supervisors adoption of same. Draft Memorandum of Understanding Santa Clarita Backbone Trail System Map REP:DDP council\m ul.ddp i MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF LOS ANGELES AND THE CITY OF SANTA CLARITA 1. The State of California, County of Los Angeles, and City of Santa Clarita have envisioned a regional trails corridor, ultimately connecting the Santa Clarita communities and Los Angeles County unincorporated area with diverse recreational opportunities in both the planning area and surrounding region. The City of Santa Clarita (City) has identified three primary trails through its General Plan - the Santa Clara River Trail, the South Fork Trail, and the Bouquet Canyon Trail (the "regional multi -use trails" or "trails"). These trails are identified in Exhibit "A." r These three (3) regional multi -use trails travel through both jurisdictions of the City of % Santa Clarita and the County of Los Angeles (County). Santa Clarita's General Plan elicits the promotion of cooperation between local, state, and federal agencies for the construction of regional bike trails. The City Council for the City of Santa Clarita has granted approval for City staff to pursue agreements with Los Angeles County for portions of the City's trail system which fall within the jurisdiction of Los Angeles County. 2. (A) The specific objective of the City of Santa Clarita is to construct, operate, and maintain the City's designated trails system situated outside the unincorporated City limits in perpetuity unless otherwise specified under the terms of the trail easements or other license agreements. (B) When applicable, the City shall obtain all appropriate Los Angeles County Flood Control District approvals for any trail projects that access flood control district property. ' 3. A('RERMFN f� (A) This Memorandum of Understanding is entered between the County of Los Angeles and the City of Santa Clarita and shall commence upon execution by both agencies. (B) This MOU constitutes the entire understanding between both parties. This MOU shall not be amended nor any provisions or breach hereof waived, except in writing by both parties. (C) The City agrees to provide complete construction, operations, and maintenance of planned City trail facilities that are constructed outside the incorporated City limits of the City of Santa Clarita in accordance with CalTrans and/or City trail standards. (D) Prior to the design and construction of trail segments outside the incorporated City limits, the City of Santa Clarita agrees to acquire appropriate easement or license agreements with specified property owners for trails access and use. The County hereby authorizes the City to acquire the necessary an appropriate property interests within County territory in order to implement this provision. (E) County agrees that the trail fee program shall be inapplicable to the regional multi -use trails operated and maintained by the City of Santa Clarita. (F) The County agrees to indemnify and hold the City, its officers, agents, and employees harmless against any liability which may be incurred by reason of injury to person or property arising from the use of said property for any purpose by the County. This provision, however, shall not apply to injuries arising by reason of the dangerous and defective condition of improvements where such condition was caused or allowed to exist or continue by reason of fault on the part of the City. The City agrees to indemnify and hold the County its officers, agents, and employees harmless against any liability which may be incurred by reason of injury to persons or property arising from the use of said property for any purpose by the City. This provision, however, shall not apply to injuries arising by reason of the dangerous and defective condition of improvements where such condition was caused or allowed to exist or continue by reason of fault on the part of the County. • No* 191 M Y:u. .39 I WONI •► (A) This MOU shall be governed by state law. If any provision of this MOU is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any way. (B) The conditions of this MOU shall inure to the benefit of, and shall be binding upon, each of the parties and their respective successors and assigns.
