HomeMy WebLinkAbout1995-08-22 - AGENDA REPORTS - NEGOTIATED PROPERTY TAX (2)AGENDA REPORT Ci Marl r Approval Item to be presented by: Don Williams CONSENT CALENDAR DATE: August 22, 1995 SUBJECT: JOINT RESOLUTION OF NEGOTIATED PROPERTY TAX TRANSFER FOR ANNEXATION NO. 1994-02 RESOLUTION NO. 95-93 DEPARTMENT: Building and Engineering Services The proposal is for a Joint Resolution of Negotiated Property Tax Transfer to be adopted by the City Council for Annexation No. 1994-02 (the "Bouquet Canyon Park Annexation"). Annexation No. 1994-02 is a proposal to annex to the City of Santa Clarita a 10.53 -acre public park consisting of an existing playground and open space land. The property is located at the northern terminus of Wellston Drive, adjacent to the existing City limits. (See attached map.) The annexation is supported by the County of Los Angeles, the current property owner. The County and the City have previously entered into a lease agreement which granted the City the responsibility of facilities maintenance and program operations for Bouquet Canyon Park. The terms of that agreement specify the transfer of title for the park site from the County to the City upon completion of Annexation No. 1994-02. There are no known persons or organizations opposed to this proposal. The City Council adopted Ordinance No. 95-5 on March 28, 1995, for the Bouquet Canyon Park Prezone. The project site is currently under the Los Angeles County zone classification of Heavy Agriculture, 2 -acre minimum lot size. The City of Santa Clarita has pre -zoned the project site to Open Space to allow the continued use of the site as a public park in conformance with the City's Unified Development Code and General Plan. City staff subsequently requested that the Local Agency Formation Commission (LAFCO) initiate proceedings for proposed Annexation No. 1994-02. The Los Angeles County Auditor -Controller has reviewed the proposed property transfer and negotiated exchange of property tax revenue associated with proposed jurisdictional change of Annexation No. 1994-02. The Auditor -Controller has determined that the Bouquet Canyon Park site is exempt from ad valorem taxation, and that no exchange of property tax revenue will occur between Los Angeles County and the City of Santa Clarita. The provisions of the proposed resolution reflect the County's standard language for property tax negotiation. &opted: A W M 'e JOINT RESOLUTION OF NEGOTIATED PROPERTY TAX TRANSFER FOR ANNEXATION NO. 1994-02 August 22, 1995 - Page 2 Upon Council adoption of Resolution No, 95-93, the proposed joint property tax negotiation resolution can be submitted to the Los Angeles County Board of Supervisors for adoption. Once the City Council and the Board of Supervisors have adopted the proposed property tax transfer resolution, the annexation proposal will be forwarded to the LAFCO and scheduled for a hearing. Staff estimates that the annexation will be completed by November 1995. RECOMMENDATION Adopt Resolution No. 95-93 and authorize the Mayor to sign the joint property tax transfer resolution for transmittal to the LAFCO for action by the Los Angeles County Board of Supervisors. F.140K[N`.idi OP -1 Resolution No. 95-93 Vicinity map MJC:lkl council \ re95-93. rr�jc RESOLUTION NO. 95-93 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM "ANNEXATION 1994-02" (BOUQUET CANYON PARK) TO THE CITY OF SANTA CLARITA WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change the governing bodies of all agencies whose service areas or service responsibilities would be altered by such change must determine the amount of property tax revenue to be exchanged between the effected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; but if the affected agency is a special district, the Board of Supervisors must negotiate on behalf of the district; and WHEREAS, the Board of Supervisors of the County of Los Angeles and the City Council of the City of Santa Clarita have determined that the amount of property tax revenues to be exchanged between their respective agencies as a result of the annexation of unincorporated territory to the City of Santa Clarita entitled "Annexation 1994-02" is as set forth below. NOW, THEREFORE, BE IT RESOLVED: SECTION 1. The negotiated exchange of property tax revenue between the County of Los Angeles and the City of Santa Clarita resulting from "Annexation 1994-02" is approved and accepted. SECTION 2. The subject property is exempt from ad valorem taxation. Therefore, there shall be no exchange of property tax revenue between the City of Santa Clarita and the County of Los Angeles, as a result of "Annexation 1994-02." SECTION 3. No additional transfer of property tax revenue shall be made to or from any other taxing agencies as a result of "Annexation 1994-02" to the City of Santa Clarita. SECTION 4. In the event that all or a portion of the annexation area is included within a redevelopment project pursuant to California Community Redevelopment Law, Health & Safety Code Sections 33000 et seq., the City of Santa Clarita shall not adopt the ordinance approving the redevelopment plan with respect to the annexed area until such time as the Redevelopment Agency of the City of Santa Clarita has diligently and in good faith consulted with the County with respect to the plan and to the allocation of taxes, pursuant to Health & Safety Code Section 33670 or any other relevant provision of law. Any ordinance approving a redevelopment project which does not comply with this paragraph shall be void and of no effect with regard to the subsequent allocation and distribution of taxes to the Redevelopment Agency.
