The Park is located at the northern terminus of Wellston Drive, north of and adjacent to the existing City limits in the Saugus area. The Planning Commission conducted a public hearing on September 20, 1994. No one from the audience spoke on the item. At that meeting the Planning Commission adopted Resolution P94- 14 which recommended that the City Council approve the Negative Declaration prepared on the project with a finding that with the identified mitigations the project will not have a significant effect on the environment, and adopt the proposed ordinance approving Prezone 94-002. Annexation to the City is regulated by the Cortese -Knox Local Government Reorganization Act of 1985 (revised 1991) and the Local Agency Formation Commission (LAFCO).. The LAFCO requires that the City prezone the territory to be annexed prior to annexation. The proposed prezoning designation is consistent with the City's General Plan and Unified Development Code (UDC). The costs associated with the acquisition of the park would be approximately $75,000 per year. This cost would include general park maintenance and annual upgrades. RESOLUTION NO. 95.27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA APPROVING THE NEGATIVE DECLARATION PREPARED FOR PREZONE NO. 94-002 (MCN 94-054) FOR THE PROPERTY LOCATED AT THE NORTHERN TERMINUS OF WELLSTON DRIVE, NORTH OF AND ADJACENT TO THE EXISTING CITY LIMITS WHEREAS, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find, determine and declare: A. That the City has initiated Prezone No. 94-002 to bring the project area into conformance with the City's General Plan land use designation of Open Space (OS) and the City's Unified Development Code (UDC), which became effective December 24, 1992. The project site, which consists of 10.53 acres, is located at the northern terminus of Wellston Drive, north of and adjacent to the existing City limits in the Saugus area. That the Planning Commission of the City of Santa Clarita conducted a public hearing on September 20, 1994, pursuant to applicable law, to consider an amendment to the Official Zoning Map for the City of Santa Clarita, and adopted Resolution No. P94-14, with the finding that the Negative Declaration was in compliance with the California Environmental Quality Act (CEQ,A), and recommending that the City Council approve Prezone No. 94-002 and the Negative Declaration prepared for the project.. The Initial Study prepared for the project has been circulated for review and comment by affected governmental agencies and the public, and all comments received have been considered. The public review period was from February 22, 1995 to March 14, 1995. C. Based upon the testimony and other evidence, if any, received at the public hearing, and upon studies and investigations made by the Planning Commission and the City Council and on their behalf, the City Council further finds and determines that the project is consistent with the General Plan and complies with all other applicable requirements of State law and local ordinance. SECTION 3. In acting on the prezoning application, the City Council has considered certain principles and standards, and finds and determines as follows: A. That a need for the prezone classification to OS exists within the project area. B. That the subject property is a proper location for the OS designation. C. That public necessity, convenience, general welfare and good planning practice justify the prezoning designation of OS. D. That the proposed prezoning designation of OS is consistent with existing land uses in the area and would notresult in a substantive change to the existing zoning of the subject site. E. That the proposed Annexation No. 1994-02 prezoning area consists of 10.53 acres of improved park land located adjacent to and outside of the existing City limits, at the terminus of Wellston Drive, as identified in Exhibit A. SECTION 4. The City of Santa Clarita City Council has reviewed and considered the Initial Study prepared for the project and finds and determines as follows: A. Said study found that no adverse impact to the existing and future environment of the area would result from the proposal. B. The proposed prezone would not have a significant adverse effect on the environment and the proposed Negative Declaration was prepared, posted, and advertised in accordance with the California Environmental Quality Act (CEQA). SECTION 5. Based upon the foregoing, the City Council does hereby ordain that the application for a prezone is approved, and that the Official Zoning Map of the City of Santa Clarita is hereby amended to designate the subject property OS. SECTION 6. This ordinance shall become effective at 12:01 a.m. on the thirty-first day after adoption, or upon the effective date of the annexation (proposed Annexation No. 1994-02) of the subject property to the City of Santa Clarita, whichever occurs last. SECTION 7. REQUEST: The City proposes to prezone Bouquet Park from Los Angeles County A-2-2 (Heavy Agriculture, two -acre minimum lot size) to City of Santa Clarita Open Space (OS), in conformance with the City's General Plan, to allow for annexation of the approximately 10 -acre public park to the City of Santa Clarita. BACKGROUND In November, 1993, the City of Santa Clarita negotiated a lease agreement with the County of Los Angeles to allow for City operation and maintenance of an approximately 10 -acre public park ("Bouquet Park"), located on the west side of Wellston Drive in the unincorporated area of Los Angeles County (Saugus area). The park is currently owned by the County of Los Angeles, which is unable to continue park operation and maintenance due to financial constraints. PROJECT DESCRIPTION The City proposes to prezone the project site from Los Angeles County A-2-2 (Heavy Agriculture, 'two -acre minimum lot size) to City of Santa Clarita OS (Open Space), in conformance with the City's General Plan land use designation for the site, to allow for the park's annexation to the City. Annexation and transfer of title for the park from the County to the City is necessary to allow the City to continue long-term park operation and maintenance.. ENVIRONMENTAL REVIEW As part of the project review, an Initial Study was prepared to evaluate the potential impacts of the proposed prezone and annexation. The proposal would not alter the present land use of the project site, but would allow for the continuation of the existing public recreational facility. It was determined that this proposal shall have no adverse environmental impacts with the following condition of approval: "Upon completion of Annexation No. 1994-02, the County of Los Angeles shall transfer title of Bouquet Park (APN 3244-035-900) to the City of Santa Clarita." A draft Negative Declaration was posted and advertised on August 30, 1994. INTERDEPARTMENUINTERAGENCY REVIEW Comments and recommendations were solicited from departments and agencies which may be affected by this project, and were also reviewed by the City Attorney.. No comments were received as a result of this solicitation, and the project is not known to be opposed by any person or entity. ANALYSIS The 10.53 -acre project site is located on Wellston Drive, immediately adjacent to the City in the unincorporated area of Los Angeles County. To avoid closure of the park, which is heavily used by City residents, the City and County negotiated a lease agreement in November, 1993, allowing the City to assume responsibility for park operation and maintenance while the proposed annexation is being processed. The General Plan states that the City shall "encourage the improvement, rehabilitation, and maintenance of existing parks and recreational facilities." Upon completion of the Annexation, the County would transfer title of the Park to the City pursuant to the provisions of the lease agreement and as proposed to the Local Agency Formation Commission as a condition of approval for the Annexation, Exhibit 8, Parks and Recreation Element. The General Plan indicates a local deficiency in parks and recreational facilities and specifically identifies the vicinity of Bouquet Park as "extremely deficient" in improved parkland. The Department of Parks & Recreation estimates that operation and maintenance of the park will cost approximately $75,000 annually. Due to the park's location adjacent to the City, existing single-family residences (all located in the City), and the adjacent elementary school, staff anticipates that this expense would be sufficiently off -set by the elimination of the potential threat to the public health, safety, and welfare were the park closed and neglected. The elimination of a possible visual nuisance anticipated to result from closure of the park is also a consideration. Long-term City operation and maintenance of the park could arguably constitute a "gift of public funds" if the park is, not annexed to the City, and would likely prohibit the use of various funding sources used to support other City recreational facilities. Finally, the City's assumption of responsibility for the park's long-term operation represents a smaller financial burden to the City than the development, operation and maintenance of new park facilities. The park is primarily utilized by City residents at this time, as the surrounding unincorporated area is undeveloped and uninhabited. The proposed prezone and associated annexation would result only in 'a change in governmental responsibility for the continued operation and maintenance of the park for City residents. RECOMMENDATION Staff recommends that the Planning Commission: 1) Conduct a public hearing; and 2) Adopt Resolution No. P94-14, recommending that the City Council: a) adopt the proposed resolution approving the Negative Declaration prepared for this project with the finding that, with mitigation, the project will not have a significant effect upon the environment; and, b) adopt the proposed ordinance approving Prezone No. 94-002 (MCN 94-054, Annexation No. 1994-02). The Planning Commission, based upon the findings set forth above, hereby finds the negative declaration for this project to have been prepared in compliance with CEQA, and recommends to the City Council that it adopt the Negative Declaration for Prezone No. 94-002 and Annexation No. 1994-02. SECTION 5. The Planning Commission hereby further recommends to the City Council that it approve the request for a prezone of the project site to City of Santa Clarita Open Space. SECTION 6. The City Clerk shall certify the adoption of this Resolution to the Departments of Public Works, Fire, and Parks, Recreation, and Community Services, and shall give notice of this recommendation in the manner prescribed by the City Municipal Code.
