Nisiclf`r�\ V CONSENT CALENDAR DATE: May 9, 1995 SUBJECT: PROGRAM SUPPLEMENT AGREEMENT FOR STATE/LOCAL TRANSPORTATION PARTNERSHIP PROJECTS DEPARTMENT: Community Development The State/Local Transportation Partnership Program identifies and participates in funding locally supported projects, and the following projects have been previously approved by Caltrans for participation in this program: Lyons Avenue Golden State Freeway to Valley Street (Project No. SB94-5450-35) Street Overlay/Reconstruction Rockwell Canyon Road: McBean Parkway to Valencia Boulevard (Project No. SB94-5450-36) Street Overlay/Reconstruction Soledad Canyon Road: 5400' E/O Bouquet Canyon Road to 90' E/O Langside Avenue (Project No. SB94-5450-37) Street Overlay/Reconstruction On May 25, 1993, Council awarded the above projects to Boral Resources, Inc. The project was completed on September 30, 1993 for a total construction cost of $985,200. These projects were completed on schedule and 5% under budget. On October 26, 1993 Council accepted the work performed by Boral Resources, Inc. As part of this program, the City has applied for $220,980.00 in State Partnership grant funds. Soledad Canyon Road: Sierra Highway to 1000' E/O Sierra Highway (Project No. SB94-5450-37) Street Overlay/Reconstruction On October 26, 1993, Council awarded a contract for the above project to Excel Paving Company. This project was completed on April 13, 1994, for a total construction cost of $67,918.75. This project was completed three days ahead of schedule and under the approved budget amount. On May 24, 1994, Council accepted the work performed by Excel Paving Company. As part of this program, the City has applied for $14,938.00 in State Partnership grant funds. APPROW ED Agenda Item: PROGRAM SUPPLEMENT AGREEMENT May 9, 1995 - Page 2 San Fernando Road (Route 126) Phase V: Valencia Boulevard to Bouquet Canyon Road (Project No. SB94.5450-44) Street and Bridge Widening On April 26, 1994, Council awarded the above project to Reyes, Security, J.V. in the amount of $4,900,585.48 for the widening of the street and bridge of Phases II and V. Costs for this project have been tracked in Account No. 30-96036-227. As part of this program, the City has applied for $933,452.00 in State Partnership grant funds. Caltrans' procedures for the Partnership Program requires the execution of a Local Agency - State Master Agreement. In addition, a Program Supplement must be executed for each approved project. We anticipate reimbursement from the State during the 1995-1996 fiscal year. RECOMMENDATION 1. Approve Program Supplement Nos. 016, 017, 018, 019, and 020 to the State/Local Entity Master Agreement, and direct staff to process these supplements through Caltrans. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for the mutual benefit of both parties, in order to avoid program and fiscal delays that would occur if the agreement were executed after that determination was made. The total amount of State -Local Transportation Partnership funds payable by the State shall not exceed $67426 to be encumbered and reimbursed as follows: FY 93-94 $ 67426 FY 94-95 0 FY 95-96 0 Any increase in State Partnership funds will require a revised program supplement. SPECIAL COVENANTS FOR SLTPP PROJECTS UNDER EARLY REIMBURSEMENT PLAN AND UNDER $300,000 STATE SHARE These Covenants supersede any conflicting provisions of the Master Agreement: A. The LOCAL ENTITY agrees that the payment of State Share Funds will be limited to the lessor of the product of multiplying the calculated pro rata percentage as determined by the STATE by either: (a) The eligible award amount or (b) The total eligible State/Local Partnership Project cost in the approved State/Local Partnership Program Application and accepts any consequent increase in LOCAL ENTITY funding requirements. B. The LOCAL ENTITY will invoice the State for the full "State's Share" after the contract award or upon the State Budget Act appropriation of funds, whichever occurs later.
