Nisich4w�\ CONSENT CALENDAR DATE: April 11, 1995 SUBJECT: QUITCLAIM OF EASEMENT FOR TRACT NO. 26967 RESOLUTION NO. 95-37 DEPARTMENT: Community Development BACKGROUND This item is for the City Council to quitclaim a portion of the easement located on Lot 70 as shown on Tract No. 26967, for storm drain, and storm drain ingress and egress purposes, to the owner of Lot 70. When the developer recorded Tract No. 26967, located near Poppy Meadow Street and Begonias Lane, he was required to dedicate an easement for storm drain, and storm drain ingress and egress purposes within Lot 70. The easement was required to be of a size acceptable to the flood control district. The easement is required to remain clear of any permanent structures or encroachments that would interfere with the flow of storm water into the easement area. However, the owner of Lot 70, where the easement is located, has encroached within the easement. The encroachment is in the form of fill placed by the homeowner to enlarge his backyard, and construction of a workshop. After an inspection, the flood control district allowed the easement to be reduced in size. This reduction in size will be accomplished when the City quitclaims those portions of the easement that were encroached upon to the homeowner. There is no fiscal impact to the City in granting consent. RECOMMENDATION Adopt Resolution No. 95-37 authorizing the Mayor to execute the attached Quitclaim Deed for the encroached upon portion of the easement to the Owner of Lot 70. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby authorize the Mayor to execute the attached Quitclaim Deed described as Parcels One and Two in said Exhibit "A'.
