SUBJECT: Resolution 95-22, Amending Resolution 94-106 Which Authorized the
City's Submittal of an Application to the California State Department of
Housing and Community Development for Disaster Relief Funding.

BACKGROUND
On September 13, 1994, the City Council approved Resolution 94-106, authorizing the City's
submission of the HOME Program for Disaster Relief application. This resolution also
authorized George Caravalho, City Manager, Ken Pulskamp, Assistant City Manager, and Don
Duckworth, Community Recovery Agency Consultant, to sign documents required by the
California State Department of Housing and Community Development (HCD) or the
Department of Housing and Urban Development (HUD) for participation in the program.
HCD legal counsel has interpreted the wording in Resolution 94-106 to mean that the
signatures of the City Manager, Assistant City Manager, and Community Recovery Agency
Director are all needed on documents required by HCD and HUD for participation in the.
HOME program. Under this interpretation, HCD will not accept any documents from Santa
Clarita which are not signed by each of the three identified individuals. HCD staff has
suggested that Santa Clarita approve a new resolution, with changes in the wording to reflect
that only one of the three signatures will be needed on required documents.
ANALYSIS
The wording of Resolution 94-106 in question reads as follows:
"The City of Santa Clarita authorizes George A. Caravalho, City Manager, Kenneth R.
Pulskamp, Assistant City Manager, and Donald R. Duckworth, Community Recovery
Agency Consultant, to execute in the name of the City of Santa Clarita, the application,
thee Standard Agreement, and all other documents required by the Department or
HUD for participation in the HOME disaster relief program, and any amendments
thereto."
Staff has drafted a new resolution to reflect this change. The word "and" following the City
Manager's title will be replaced with the word "or" to authorize each individual to sign

without requiring two signatures on each document. This change will therefore read as
follows:
"The City of Santa Clarita authorizes George A. Caravalho, City Manager, or Kenneth
R. Pulskamp, Assistant City Manager, to execute in the name of the City of Santa
Clarita, the application, the Standard Agreement, and all other documents required by
the Department or HUD for participation in the HOME Disaster Relief Program, and
any amendments thereto."
RECOMMENDATION
Staff recommends that the City Council:
1. Approve Resolution 95-22, authorizing George A. Caravalho, City Manager, or Kenneth
R. Pulskamp, Assistant City Manager, to sign all documents required by the State
Department of Housing and Community Development or the Department of Housing
and Urban Development for participation in the HOME Disaster Relief Program.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA,
AUTHORIZING SUBMITTAL OF AN APPLICATION TO THE
CALIFORNIA STATE DEPARTMENT OF HOUSING AND COMMUNITY
DEVELOPMENT
FOR DISASTER RELIEF FUNDING UNDER THE
HOME INVESTMENT PARTNERSHIPS PROGRAM;
THE EXECUTION OF A STANDARD AGREEMENT IF SELECTED
FOR SUCH FUNDING AND ANY AMENDMENTS THERETO;
AND ANY RELATED DOCUMENTS NECESSARY TO PARTICIPATE IN THE
HOME INVESTMENT PARTNERSHIPS PROGRAM
FOR DISASTER RELIEF
WHEREAS, The City of Santa Clarita, a political subdivision of the State of California,
wishes to apply for and receive an allocation of funds through the HOME Investment
Partnerships Program for disaster relief (hereinafter referred to as "HOME disaster relief");
and
WHEREAS, the California Department of Housing and Community Development
(hereinafter referred to as the "Department') has issued a Notice of Funding Availability for
the HOME disaster relief program and is authorized to approve funding allocations which
will be made available directly through the U.S. Department of Housing and Urban
Development (HUD) to be used for the purposes set forth in Title II of the Cranston -Gonzalez
National Affordable Housing Act of 1990, the implementing regulations set forth in Title 24
of the Code of Federal Regulations, part 92, and Title 25 of the California Code of Regulations
commencing with section 8200; and
WHEREAS, The City of Santa Clarita wishes to submit an application to obtain from
the Department an allocation of HOME disaster relief funds.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES
RESOLVE that the City of Santa Clarita shall submit to the Department an application to
participate in the HOME disaster relief program in response to the NOFA issued on July 20,
1994 which will request a funding allocation for the following activities:
Loans for rehabilitation and reconstruction activities for low income owner occupied
housing units located in the City of Santa Clarita.
SECTION 1 -If the application for funding is approved, the City of Santa Clarita hereby
agrees to use the HOME disaster relief funds for eligible activities in the manner presented
in the application as approved by the Department and in accordance with regulations cited
above. It may also execute any and all other instruments necessary or required by the
Department or HUD for participation in the HOME disaster relief program.
SECTION 2 -The City of Santa Clarita authorizes George A. Caravalho, City Manager,
or Kenneth R. Pulskamp, Assistant City Manager, to execute in the name of the City of Santa
Clarita, the application, the Standard Agreement, and all other documents required by the
Department or HUD for participation in the HOME disaster relief program, and any
amendments thereto.
