CONSENT CALENDAR rt6 3- DATE: June K 1995 SUBJECT: RESOLUTION NO. 95-69 AND 95-70: GRAFFITI REWARDS DEPARTMENT: Public Works During the month of May 1995, the City of Santa Clarita and its Community were outraged by two separate incidents of graffiti related vandalism. These separate incidents involved the vandalism of the Highlands Elementary School Library, and the senseless destruction and placement of spray painted racist epithets upon a local resident's automobile while parked in the garage of his home. On the evening of May 16, 1995, Michael Hendrix, a local Santa Clarita resident, had the sanctity of his family's home violated as a still unidentified person or persons broke into Mr. Hendrix's garage and vandalized his automobile. In addition to smashing the windshields, the placement of spray painted racist epithets were placed upon his vehicle. Due to the nature of these epithets, the Los Angeles County Sheriff's Career Offender Burglary Robbery Apprehension (COBRA) Division consider this incident to be Hate Crime related. Not one week later the senseless act of vandalism struck again, this time directed upon the Highlands Elementary School Library. On Tuesday May 23, 1995, vandals broke into the Highlands School and proceeded to cause approximately $11,000 in damage to the library facility. Among those items which were damaged included numerous school computers, the carpet throughout the entire library, and the school's Baldwin Piano, to which these vandals applied glue to the piano keys. At the request of Council member Heidt, the City of Santa Clarita wishes to offer two separate rewards in the amount of $1,500 for information which leads to the identification, apprehension and conviction of the person or persons responsible for these actions. Proposed Resolution No. 95-69 and No. 95-70 have been developed to facilitate this request.. Staff believes it is appropriate to utilize existing monies, which are presently dedicated to the City's Graffiti Reward, to fund these potential rewards. Further, the redirection of these funds are not expected to adversely impact Santa Clarita's existing Graffiti Reward Program. DEL:kmt rewards ATTACHMENTS Resolution No. 95-69 Resolution No. 95-70 RESOLUTION 95-69 A RESOLUTION OF THE CITY OF SANTA CLARITA, CALIFORNIA, OFFERING TO PAY A REWARD, NOT TO BE IN EXCESS OF ONE THOUSAND FIVE HUNDRED DOLLARS, FOR INFORMATION LEADING TO THE DETERMINATION OF THE IDENTITY, APPREHENSION AND CONVICTION OF THE PERSON OR PERSONS WHO WERE RESPONSIBLE FOR THE WILLFUL DAMAGE AND DESTRUCTION OF THE HIGHLANDS ELEMENTARY SCHOOL LIBRARY ON MAY 23, 1995 IN VIOLATION OF CALIFORNIA PENAL CODE SECTIONS 594, 594.1, 640, 640.5, 640.6, AND ANY OTHER STATE OR CITY LAW RELATING TO GRAFFITI WHEREAS, Highlands Elementary School has incurred costs to repair damage and destruction caused by the senseless act of vandalism and placement of graffiti within their school library on May 23, 1995 as a result of the "Highlands Incident"; and WHEREAS, California Government Code Section 53069.5 authorizes the City of Santa Clarita to offer and pay a reward, the amount thereof to be determined by the City Council, for information leading to the identification, apprehension, and possible conviction of any person or persons who were responsible for the willful damage and destruction of the Highlands Elementary School Library; and WHEREAS, the City is desirous of proceeding under the authority of California Government Code Section 53069.5, and has determined that the amount of this reward shall not exceed one thousand five hundred dollars for information leading to the identification, apprehension and conviction of the person or persons responsible for the Highlands Incident which occurred on May 23, 1995, and that the offer shall be subject to the terms and conditions herein contained. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve, determine and order as follows: SECTION 1. That the City Council of the City of Santa Clarita, pursuant to the authorization of California Government Section 53069.5, offers to pay a reward not to exceed one thousand five hundred dollars cash in lawful money of the United States of America for information leading to the identification, apprehension and conviction of the person or persons who were responsible for the willful damage and destruction in the Highlands Incident in violation of California Penal Sections 594, 594.1, 640, 640.5, 640.6, and any other State or City law relating to graffiti. SF,CTTON 2. The offer of reward is made to members of the public generally, but is not made to any peace officer contracted or employed by the City of Santa Clarita, employee of the City of Santa Clarita or person or persons apprehended. SF,CTION 3. Any claim for reward must be made in writing to the City of Santa Clarita. In no event will the amount of a reward, nor sums of rewards in connection with the Highlands Incident, exceed the combined total of one thousand five hundred dollars. In the event of a dispute, including whether a claimant or claimants for the reward produced information which lead to the identification, apprehension and possible conviction of any person or persons found to be in violation of California Penal Code Sections 594, 594.1, 640, 640.5, 640.6, or any other State or City law relating to graffiti, or sharing of the reward among claimants, the determinations of the City Council shall be final and conclusive. SECTION 4. This is a one time offer for specific information leading to the identification, apprehension and conviction of the person or persons responsible for the willful damage and destruction in the Highlands Incident and in no way or manner modifies the City of Santa Clarita's policy concerning its Graffiti Reward Program as currently adopted or as it may hereafter be modified. SECTION 5. This specific offer of reward concerning the damage caused in the Highlands Incident shall remain open until exhaustion of the sum total of one thousand five hundred dollars offered as rewards, or until this offer is removed by the City Council prior to acceptance of the offer. SECTION 6. The City Manager and his designees are authorized and directed to give public notice of this offer of rewards by posting suitable notices thereof as authorized by law and found by the City Manager to be effective and in keeping with good government practices.
