Nisich% SUBJECT; SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO. 1 LOCATED AT GOLDEN VALLEY ROAD AND SAN RAPHAEL DRIVE - ANNUAL ASSESSMENT FOR FISCAL YEAR 95-96 RESOLUTION NO. 95-62 DEPARTMENT: Community Development This is a public hearing item to consider comments regarding the proposed assessments for Santa Clarita Landscape Maintenance District No.1 and to approve the final Engineer's Report and authorize the levy of the assessments. BACKGROUND On May 23, 1995, the resolution initiating the proceedings for Santa Clarita Landscape Maintenance District No. 1 (the District), and the resolution declaring the City's intention to levy assessments for the District on the tax rolls for fiscal year 1995-96 were approved, along with the approval of the Preliminary Engineer's Report, and call for a Public Hearing. The final Engineer's Report is attached and is also on file with the City Clerk. Santa Clarita Landscape Maintenance District No. 1 was formed for the maintenance of landscaping along Golden Valley Road from the Antelope Valley Freeway west to Green Mountain Drive. Maintenance includes all upkeep, water,electrical, repairs/replacements, and all administrative costs associated with the District landscaping. When the other projects along Golden Valley Road develop, they will annex to this District. In 1993, it was estimated that the improvements would be installed within six months, and the fiscal year 1993-94's assessment of the $9,200.88 was to cover the maintenance costs for this period with an additional six months of expenses to establish a reserve fund for future expenditures. The assessment for fiscal year 93-94 was $88.47 for each of the 111 parcels in the District. However, the landscaping has not been completed, approved by the City or accepted for maintenance. The funds will carry over to fiscal year 1995-96, and the proposed assessment this year is $0.00, the same as it was last year. Adopted: 3 s Ac Item:__ _. Fiscal Impact - None to the City. Conduct public hearing, and upon conclusion, adopt Resolution No. 95-62 approving the assessment diagram and Engineer's Report, and authorizing the annual levy of assessments. ATTACHMENTS Engineer's Report Resolution No. 95-62 Confirming Assessments NED:Ikl mumi1\re95-96.181 RESOLUTION NO. 95-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CONFIRMING THE DIAGRAM AND ASSESSMENT AND LEVYING THE ASSESSMENTS WITHIN SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO. 1 WHEREAS, on November 10, 1982, the Santa Clarita Landscape Maintenance District No. 1 was formed in accordance with the Landscape and Lighting Maintenance Act of 1972; and WHEREAS, this is the proceeding for the annual update and Engineer's Report for levying the annual assessments; and WHEREAS, on May 23, 1995, the City Council of the City of Santa Clarita (the "City Council"), adopted Resolution No. 95-50, initiating proceedings for Santa Clarita Landscape Maintenance District No. 1 (the "District"), and to levy and collect assessments in connection therewith; and WHEREAS, the City Engineer was directed to and did prepare a report in accordance with Article 4 of the Landscaping and Lighting Act of 1972 (the "Engineer's Report") and the City Council adopted Resolution No. 95-50 preliminarily approving the report; and WHEREAS, on May 23, 1995, the City Council passed Resolution No. 95-50 (the "Resolution of Intention"), declaring its intention to levy and collect assessments in connection therewith and to fix a time and place for hearing objections thereto; and WHEREAS, on June 13, 1995, at the time and place for which notice was given, the City Council conducted a public hearing and gave every interested person an opportunity to object to the proposed formation of the District and/or the levy and collection of assessments in connection therewith; and WHEREAS, the Notice of Public Hearing was duly and legally published in the time, form and manner as required by law, and the Affidavit of Publication is filed with the City Clerk; and WHEREAS, written protests against the proposed formation of the District and/or the levy and collection of assessments in connection therewith have not been made by owners representing more than one-half of the areas of land within the District; and WHEREAS, the City has duly received and considered evidence, both oral or documentary, concerning the jurisdictional facts in this proceeding and concerning the necessity for the proposed formation of the District and concerning the proposed levy and collection of assessment in connection therewith and has not acquired jurisdiction to order the proposed assessments in connection therewith. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA does resolve as follows: RESOLUTION NO. 95-62 June 13, 1995 - Page 2 SECTION 1. The above recitals are all true and correct. SECTION 2. Written protests against the proposed formation of the District and/or the levy and collection of assessments in connection therewith were not made by owners representing more than one-half (1/2) of the area of land within the District and any protest made, if any, was duly considered by the City Council. SECTION 3. The report filed by the City Engineer on May 23, 1995, and each component part of it, including each exhibit incorporated by reference, is hereby approved on June 13, 1995. SECTION 4. The formation of the District and the levy and collection of assessment in connection therewith as set forth and described in the Resolution of Intention is hereby ordered. SECTION 5. The adoption of this resolution constitutes the levy of the assessment as set forth in the Engineer's Report for the Fiscal Year 1995-96. SECTION 6. The City Clerk is hereby authorized and directed to file a certified copy of the assessments respecting the District with the County Auditor/Tax Collector of Los Angeles County no later than August 10, 1995. As a condition to the recordation of Tract No. 48117 approved by the City of Santa Clarita Planning Commission, the developer, Amcal Diversified Corp. is required to provide landscape improvements along Golden Valley Road shown on the diagram for Santa Clarita Landscape Maintenance District No. 1. The District is to provide for the maintenance and servicing of the landscape improvements and all incidentals thereto. Since this project is one development, the properties within the development each receive full benefit from the improvements, i.e., maintenance and servicing. Therefore, because each parcel benefits equally, the benefit should be proportioned to the number of lots to be created by the development. i -+• a-. . :-.- The basis of benefit was determined to be dwelling units, i.e.,, 1 dwelling unit = 1 benefit unit. Tract No. 48117 is located along Golden Valley Road between Highway 14 and Green Mountain Drive in the City of Santa Clarita as shown on Exhibit "A." Maintenance and operation of the landscaping involves: (1) regular planting maintenance; (2) irrigation repairs and maintenance; and (3) electrical needs for irrigation.. Mayor announces decision w r ; Item:__1__._ t CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING NOTICE OF A PUBLIC HEARING AND ADOPTION OF RESOLUTION CONFIRMING THE DIAGRAM AND LEVYING THE ASSESSMENT FOR LANDSCAPE MAINTENANCE DISTRICT NO.. 1, LOCATED AT GOLDEN VALLEY ROAD AND SAN RAPHAEL DRIVE PUBLIC NOTICE IS HEREBY GIVEN: That a Public Hearing will be held before the City Council of the City of Santa Clarita for the adoption of a resolution confirming the assessment, approving the Engineer's Report and levying the assessment for Landscape Maintenance District No. 1, located at Golden Valley Road and San Raphael Drive. The purpose of the public hearing is to receive and consider public testimony regarding the District improvements and the proposed assessment for fiscal year 1995-96. The purpose of the District is to provide the maintenance for the landscape improvements along Golden Valley Road. The proposed maintenance cost is $0.00 per unit because the landscaping has not been completed, The hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, 1st floor, Santa Clarita, the 13th day of June 1995, at or after 6:30 p.m. Proponents, opponents, and any interested persons may appear and be heard on this matter at that time.
