Stiles CONSENT CALENDAR DATE: November 7, 1995 SUBJECT: TRANSFER OF STORM DRAINS TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD) TRACT NO. 44452, PRIVATE DRAIN NO. 2176 RESOLUTION NO. 95-123 DEPARTMENT: Building and Engineering Services The construction of Private Drain No. 2176, has been inspected and approved by the County Director of Public Works, who has sent Notices of Completion to the City. The project is located in the Circle "J" Ranch area. A detailed description of the facilities is contained in Exhibit "A." The storm drains were constructed by the developer in accordance with agreements and the Faithful Performance Bonds on file with the City Clerk (see Exhibit "B" attached showing the location and extent of improvements). The agreements also provide that the work shall not be deemed completed until approved, accepted as complete, and transferred to LACFCD for maintenance. The City and County entered into an agreement on March 14, 1989, recorded as Document No. 89-1346418, which provides for the transfer of storm drains. The City Council must approve a resolution authorizing the transfer to complete the process. The transfer is then accepted and approved by the Board of Supervisors for the LACFCD, who operates and maintains the storm drains for public use. Adopt Resolution No. 95-123 for the transfer and conveyance of the storm drain improvements to the LACFCD for purposes of operation, maintenance, repair and improvements. 2; Authorize the Mayor of the City to execute the attached Quitclaim Deed for the easements to the LACFCD on behalf of the City. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit "A". RESO NO. 95-123 November 7, 1995, Page 2 BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore have been conveyed to and accepted by District. Reference is hereby made to District Drawing Nos. 337-F-150.1 through 337-F-150.9, the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to ,the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles.
