SUBJECT: TRACT 45416-01/02 - APPROVAL OF THE MAP AND ACCEPTANCE OF
OFFERS OF DEDICATION

BACKGROUND
This item was removed from the Consent Calendar of September 12, 1995, and continued to this
date, as the applicant was unable to fulfill all of the conditions of approval for the tract at that
time.
The Tentative Tract Map was originally approved by the Planning Commission on April 3, 1990,
by Resolution P90-13. The approval of a development agreement followed on October 8, 1991.
The developer is subdividing 21.2 acres into 76 single-family residential lots with these first two
phases of the Tentative Tract Map. With the exception of condition #81, all of the conditions of
approval have been met. In reference to condition #81, the developer proposes two alternatives
to comply with the intent of this condition::
1. The developer proposes to substitute annexation into the City's existing Landscape
Maintenance District (LMD) for the express purpose of meeting all of the needs of slope
maintenance as described in the first part of condition #81, in lieu of forming an
Homeowners' Association (HOA) performing the same function. Since the HOA has not been
assigned any other function for this tract, the LMD will provide substantial compliance with
this section of condition #81.
2. The second part of condition #81 provides for separate ownership of the slope area to be
maintained by the HOA. The developer proposes to provide a slope easement over private
property to include the same area. Since this will allow separate ownership of this easement
area by the LMD, this is in substantial compliance with the second part of condition #81.
As a condition of annexation to the existing LMD, the applicant has paid the first
nine-month assessment of $33,180 and granted an easement over the necessary portions of
the property to the City for landscape maintenance purposes. Due to the fact that the
landscaping on some slopes will not be publicly maintained, the existing grading bond will
be held in force until such time that all of the provisions of the approved landscape and
irrigation plans have been met and accepted by the City.

The fees have been paid as indicated on the Fact Sheet, and the map has been checked to the
satisfaction of the City Engineer, The map is ready for the Council's approval and acceptance
of the dedications.
RECOMMENDATIONS
Part 1. Approve the Map.
Part 2. Accept on behalf of the public, the offers of dedication for the public streets,
the easements for storm drain purposes, and the public sewers.
Part 3. Make findings as follows:
a. That this project is consistent with the provisions of Sections 66474,
66474.1 and 66474.6 of the Subdivision Map Act and should be
approved.
b. That this proposed subdivision, together with the provisions for this
design and improvement, is consistent with the general plan required
by Article 5 (commencing with Section 65300) of Chapter 3 of
Division 1 of the Government Code, or any specific plan adopted
pursuant to Article 8 (commencing with Section 65450) of Chapter 3
of Chapter 3 of Division of the Government Code.
Part 4. Instruct the City Treasurer to endorse the Special Assessment Certificate
on the face of the map of Tract Map Nos. 45416-01 and 45416-02, which
indicates that all special assessments levied by the City have been paid.
Part 5. Instruct the City Clerk to endorse the Certificate on the face Tract Maps
Nos. 45416-01 and 45416-02, which embodies the approval of said map and
the acceptance of the dedications shown thereon,

Tract Map Location: Continuation of Canvas Street and Mount Stephen Avenue between
Soledad Canyon Road and Sierra Highway in Canyon Country.
Acreage: 21.2 acres in two map phases.
Number of Lots: 38 lots on each of the two phase maps for a total of 76.
Developer: Weston Development.
Quimby Fees: Park in -lieu fees of $81,792.60.
Road Improvements: Construction of full improvements along all subdivision streets.
Road Fees: Bridge and Thoroughfare Fees to be paid at building permit stage per
the approved development agreement.
School fees: To be paid at building permit stage per the approved development
agreement.
Other agreements: Developer exchanged property with the William S. Hart Union High
School District for the property on which the new junior high school
now resides.
