In 1990, the City Council directed staff to prepare a study identifying the full cost of providing
services. The result of this effort was the adoption of City Council policy establishing cost
recovery standards, the adoption of the City's first full -cost based fee schedule, and an ongoing
mechanism to assess the cost of City services and to adjust fees accordingly.
Since 1990, the City has chosen to delay consideration of any fee increases due to the poor state
of the regional and state economy. In early 1996, the City Manager directed staff to reassess
the City's full cost of providing services. The 1990 business cost assessment methodology was
again utilized in performing the current cost analysis update. The 1996 analysis shows that the
City's fees have not been increased to keep up with costs. As a result, the City is not recovering
costs at the levels established by the City Council in 1990.
Propositions 4 and 13 established the "costs reasonably borne" philosophy. This philosophy
necessitates the determination of the full business cost of each City -provided service, the
identification of the beneficiary of each service, and the evaluation of services to determine an
appropriate level of cost recovery for each. "Costs reasonably borne" implies a direct
relationship between payment of fees and charges and receipt of services. This direct fee/service
and tax equity relationship does not exist when tax monies are used to subsidize services
received by only a small portion of the taxpaying public, or by non-residents.
In May, staff conducted several public meetings to receive input on the proposed cost recovery
plan. This input has been incorporated into the fee schedule. After the June 4, 1996 Study
Session, the fee ordinance will be brought to the City Council for a first reading and public
hearing on June 25, 1996. The second reading and adoption of the ordinance and resolution
could proceed on July 9, 1996. Fees take effect 30 days after adoption of the ordinance and
resolution.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, AMENDING THE SANTA CLARITA MUNICIPAL CODE BY ADDING
CHAPTER 3.32 ESTABLISHING A FEE AND SERVICE CHARGE REVENUE/COST
COMPARISON SYSTEM.
The City Council of the City of Santa Clarita does hereby ordain as follows:
SECTION 1. Chapter 3.32 of the Santa Clarita Municipal Code is
hereby added to read as follows:

Section 3.32.010. Findings and Intent
(a) Pursuant to Article %IIIB of the California Constitution, it is
the intent of the City Council to require the ascertainment and
recovery of costs reasonably borne from fees, charges and regulatory
license fees levied therefor in providing the regulation, products
or services hereinafter enumerated in this Chapter.
(b) The fee and service charge revenue/cost comparison system set
forth in this Chapter provides a mechanism for ensuring that fees
adopted by the City for services rendered do not exceed the
reasonable estimated cost for providing the services for which the
fees are charged.
(c) The adoption of this Chapter is exempt from the California
Environmental Quality Act (Public Resources Code Sections 2100 et
seq.), because it approves and sets forth a procedure for
determining fees for the purpose of meeting the operating expenses
of City departments, as set forth in Public Resources Code Section
21080 (b) (8) (1).
Section 3.32.020. Delegation of Authority and Direction to Manager
(a) The City Manager is hereby delegated the authority and directed
to provide documents to the City Council to implement its herein
enumerated policy to adjust fees and charges to recover the
percentage of costs reasonably borne as established hereby, in
providing the regulation, product or service enumerated in this
Chapter in the percentage of costs reasonably borne and on the
schedule of rate review and revision as hereinafter established in
this Chapter.
(b) The City Manager is hereby authorized and directed to issue
Executive Orders defining terms, setting out administrative, fee
collection, and financial procedures, definitions, and establishing
effective dates of all fees set by the City Council by resolution.
All Executive Orders shall be originated and signed by the affected
department head, shall be signed by the Finance Director certifying
that the financial requirements of this Chapter are complied with,
and shall be signed by the City Manager connoting the effective date
of the Executive Order and new or revised rate structure, procedure
or definition.
(c) "Costs reasonably borne" shall be as defined in Section
3.32.030. In adjusting fees and charges, the City Manager shall act
In an administrative and ministerial capacity and shall consider
only the standards and criteria established by this Chapter, and the
procedures set hereby and by applicable State law. All Executive
Orders issued hereunder shall comply in all respects with this
Chapter, and the several schedules of fees and rates as set by the
City Council by resolution.
Section 3.32.030. "Costs Reasonably Borne" Defined. Costs
reasonably borne" as used and ordered to be applied in this Chapter
are to consist of the following elements:
(a) All applicable direct costs including, but not limited to
salaries, wages, overtime, employee fringe benefits, services and
supplies, maintenance and operation expenses, contracted services,
special supplies, and any other direct expense incurred.
(b) All applicable indirect costa including, but not restricted to,
building maintenance and operations, equipment maintenance and
operations, communications expenses, computer costs, printing and
reproduction, vehicle expenses, insurance, debt service, and like
expenses when distributed on an accounted and documented rational
proration system.
(c) Fixed asset recovery expenses, consisting of depreciation of
fixed assets, and additional fixed asset expense recovery charges
calculated on the current estimated cost of replacement, divided by
the approximate life expectancy of the fixed asset. A further
additional charge to make up the difference between book value
depreciation not previously recovered and reserved in cash and the
full .cost of replacement, also shall be calculated and considered a
cost so as to recover such unrecovered costa between book value and
cost of replacement over the remaining life of the asset.

(d) General overhead, expressed as a percentage, distributing and
charging the expenses of the City Council, City Attorney, City
Administration, City Clerk, City Treasurer, Economic Development,
Finance Department, Personnel Office, and City Promotion, and all
other staff and support service provided to the entire City
organization. Overhead shall be prorated between tax -financed
services and fee -financed services on the basis of said percentage
so that each of taxes and fees and charges shall proportionately
defray such overhead costs.
(e) Departmental overhead, expressed as a percentage, distributing
and charging the cost of each department head and his or her
supporting expenses as enumerated to subsections a, b, c, and f of
this Section.
(f) Debt service costs, consisting of repayment of principal,
payment of interest, and trustee fees and administrative expenses
for all applicable bond, certificate, note or securities issues or
loans of whatever nature or kind. Any required coverage factors or
required or established reserves beyond basic debt service costs
also shall be considered a cost if required by covenant within any
securities ordinance, resolution, indenture or general law
applicable to the City.

(a) The City Manager, rector and each City department
head, under the direction of the City—Manager, shall review annually
the fees and service charges listed following, and provide an
adjusted fee or charge schedule to the City Council for it
consideration so as to recover the listed percentage of costs
reasonably borne necessary to provide the listed regulation, product
or service.
(b) The hereinabove services as listed in this section shall be as
defined in that certain document entitled "Cost Control System for
the City of Santa Clarita" dated April , 1922, as produced by
Management Services Institute, Incorporated, of Anaheim, California.
(c) All fees and charges set pursuant to this Chapter and Section
shall take effect ten (10) days after the City Manager signs an
Executive Order stipulating that all provisions of this Chapter have
been complied vith, and no written appeal has been filed.
(d) The schedule of frequency of rate adjustments may be varied by
the City Manager to adjust revenues sufficient to meet debt service
coverage requirements of any bond, certificate, or ordinance,
resolution, indenture, contract, or action under which securities
have been issued by the City which contain any coverage factor
requirement.
(e) The City Manager may vary the reviev schedule listed in this
Section if, in the judgment of the City Manager and a directly

affected and requesting department head, a gross inequity would be
perpetrated by not revising the rate schedule. Any such rate
revision which deviates from the review schedule as set herein shall
be reported to the City Council at its next succeeding meeting.
Section 3.32.050, Statutory Public Meeting . Pursuant to California
Government Code Sections 54992, 54994.1 and 54994.2, the City Clerk
shall cause notice to be provided as set out in Government Code
Sections 54992, 54994.1, and 6062s, and the City Council
periodically, at least annually, shall receive at a regularly
scheduled meeting oral and written presentations concerning fees and
charges proposed to be increased or added. Such notice, oral and
written presentation, and public meeting shall be provided prior to
the City Council taking any action on any new or increased fees or
charges. At least one such public hearing shall be held annually,
in conjunction with the City annual budget process and hearing.
Section 3.32.060, Provision of Data. Pursuant to the California
Government Code, at least ten (10) days prior to the required public
hearing set out herein, the City Manager shall make available to the
public appropriate data indicating the cost, or estimated cost
required to support the fees and charges for which changes are
proposed to be made or fees or charges imposed. The City Manager
also shall provide a summary of the present fee and charge schedules
and those proposed at such annual public hearing. A general
explanation of such changes also shall be published per the
requirements of Government Code Section 6062a.
(a) Any person who feels that any fee or charge determined and set
is in excess of the percentage of costs reasonably borne to be
recovered as set out in this Chapter, or that such fee or charge has
been reviewed prior to or has not been reviewed within the review
schedule as set out herein, may appeal in writing to the City
Council.
(b) No fee or charge for which an appeal has been filed shall take
effect until heard by the City Council. Such appeal shall be placed
on the agenda of the next available Council meeting after receipt of
such appeal and heard at the next regularly scheduled Council
meeting. Such appealed fee or charge shall take effect immediately
upon hearing by the City Council unless ordered otherwise by the
City Council by ordinance amending this Chapter.
SECTION 2. SEVERABILITY. If any portion of this Chapter is found
to be unconstitutional or invalid, the City Council hereby declares that it
would have enacted the remainder of this Chapter regardless of the absence of
any such invalid part.
SECTION 3. FEESAND CHARGES SUPERSEDED. The fees and charges
established by this Chapter shall supersede all previously established fees or
charges for the same regulation, product or service, and all such previous
fees and charges are superseded on the effective date of the Executive Order
of the City Manager provided in Section 3.32.040 (c) hereof.

SECTION 4. EFFECTIVE DATE. This ordinance shall take effect and be
in force thirty (30) days after its passage.
SECTION 5. The City Clerk shall certify to the passage of this
Ordinance and shall cause the same to be published in the same manner
prescribed by fay..

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA,
ESTABLISHING A SCHEDULE OF FEES AND
CHARGES FOR CITY SERVICES
WHEREAS, the City of Santa Clarita has conducted an extensive and exhaustive analysis of its
services, the costs reasonably borne of providing those services, the beneficiaries of those
services, and the revenues produced by those paying fees and charges for special services; and
WHEREAS, the City wishes to comply with both the letter and the spirit of Article XIIIB of the
California Constitution and limit the growth of taxes; and
WHEREAS, the City desires to establish a policy of recovering the full costs reasonably borne
of providing special services of a voluntary and limited nature, such that general taxes are not
diverted from general services of a broad nature and thereby utilized to subsidize unfairly and
inequitably such special services; and
WHEREAS, heretofore the City Council adopted Ordinance 90-17 on the 10th day of July, 1990
and adopted Ordinance 96-24 on the day of 1996, establishing its policy as
to the recovery of costs and more particularly the percentage of costs reasonably borne to be
recovered from users of City services and directing staff as to the methodology for implementing
said Ordinance; and
WHEREAS, pursuant to Government Code Section 54994.1, the specific fees to be charged for
services must be adopted by the City Council by Resolution, after providing notice and holding
a public hearing; and
WHEREAS, notice of public hearing has been provided per Government Code Section 6062a,
oral and written presentations made and received, and the required public hearing held; and
WHEREAS, a schedule of City service fees and charges to be paid by those requesting such
special services need to be adopted so that the City might carry into effect its policies; and
WHEREAS, it is the intention of the City Council to develop a revised schedule of fees and
charges based on the City budgeted and projected costs reasonably borne for the fiscal year
beginning July 1, 1997; and
WHEREAS, pursuant to the California Government Code Section 6062a, a general explanation
of the hereinafter contained schedule of fees and charges has been published as required; and
WHEREAS, all requirements of California Government Code Section 54994.1 are hereby found
to have been complied with;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES
RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:

SECTION 1. Fee Schedule Adoption. The following schedule of fees and charges are hereby
directed to be computed by and applied by the various City departments, and to be collected by
the City Administrative Services Department for the herein listed special services when
provided by the City or its designated contractors.
SECTION 2. Separate Fee for Each Process. All fees set by this Resolution are for each
identified process; additional fees shall be required for each additional process or service that
is requested or required. Where fees are indicated on a per unit of measurement basis, the fee
is for each identified unit or portion thereof within the indicated ranges of such units.
A. Added Fees and Refun a. Where additional fees need to be charged and collected for
completed staff work, or where a refund of excess deposited monies is due, and where
such charge or refund is ten dollars ($10.00) or less, a charge or refund need not be
made, pursuant to California Government Code Sections 29373.1 and 29375.1 and
amendments thereto.
B. Defining and TimingofFee Schedule. Definitions regarding and the timing of the
implementation of the hereinafter enumerated fee schedules shall be as stipulated in
Ordinances 91-17 and 96-24.
SECTION 3. New Fees. Any fees, for new services established throughout the year shall be
incorporated into the City's fee structure and collected with recovery percent consistent with
similar services.
SECTION 4. Interpretations. This Resolution may be interpreted by the several City
department heads in consultation with the City Manager, and should there be a conflict between
two fees, then the lower in dollar amount of the two shall be applied.
A. Intent. It is the intention of the City Council to review the fees and charges as
determined and set out herein based on the City's next Annual Budget and all of the
City's costs reasonably borne as established at that time and, as and if warranted, to
revise such fees and charges based thereon.
SECTIONS 6. Constitutionality. If any portion of this Resolution is declared invalid or
unconstitutional, then it is the intention of the City Council to have passed the entire Resolution
and all its component parts, and all other sections of this Resolution shall remain in full force
and effect.
SECTION 6. Rept. All resolutions and other actions of the City Council in conflict with the
contents of this Resolution are hereby repealed.
SECTION 7. Effective Date. This Resolution shall go into full force and effect immediately, but
shall be subject to the terms and conditions of Ordinances 90-17 and 96-24.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA
RECOMMENDING A REVISED BAIL FEE SCHEDULE
FOR ADOPTION BY THE COURT
WHEREAS, the City Council of the City of Santa Clarita is recommending a revised bail
schedule for the Santa Clarita Municipal Code violations, which schedule is to be adopted by the
court; and
WHEREAS, the City Council believes that the amounts now need to be revised to conform to the
changing needs within the City;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the city of Santa Clarita as
follows:
SECTION 1. The City Council hereby adopts the Bail Fee Schedule set forth in Exhibit
A, attached hereto and incorporated herein by reference.
SECTION 2. The City Council hereby recommends that the court adopt the
aforementioned Bail Fee Schedule.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution and transmit
this Resolution to the Newhall Municipal Court.

SUPPLEMENT TO THE MSI FEE STUDY
STUDY SESSION GOING TO COUNCIL
The Department of Parks, Recreation, and Community Services is a major provider of services
to the citizens to the City of Santa Clarita. In terms of cost recovery, each of these services can
be categorized as being in one of the following fee structures:
1. Free or Substantiab Subsidized Servi .c. Classes or programs within this category are
provided at little or no cost and are generally recognized as providing necessary or
significant services to the community. Included in this category would be swim lessons,
special events, and the community center.
2. Direct Coc Recovery Services. These services have a goal to recover up to 100 percent
of their direct costs. This significant category provides services such as child
development programs, teen programs, day camp, and youth sports. Many of the City's
most popular programs are contained within this category. Although the Department
strives to recover 100 percent of the direct costs, this would in some cases be cost
prohibitive for a significant number of families. Fee increases should occur when
necessary and with respect to market conditions for similar services.
3. Total Cost Recov= Services. These services are provided based on a cost recovery goal
of 100 percent of total costs. Total costs are defined as direct and indirect costs.
Services within this category include adult sports, plan check fees, and parade permits.
The MSI Study, working in conjunction with the Parks, Recreation, and Community Service
Department, recommends changes to the current fee structure. Goals of the fee structure
include:
Timely and adaptive responsiveness to market conditions and fee adjustments where
necessary to insure maximum program participation.
Maximize cost recovery and minimize subsidies for non-essential and discretionary
services.
Create an enterprise division to help support value -based programing.
The Parks, Recreation, and Community Service Department recommends the following:
Adopt the recommendations of the MSI Fee Study, and designate staff to
administratively set activity fees within the fee study guildlines.
Set fees to recover direct costs from non-profit rental of facilities.
• Discontinue practice of providing facility keys to renters and assign the cost of a
building/facility attendant to be included in the fee structure.
• A modest increase in youth sports fees of $10 per child not to exceed $20 per family, to
help cover the cost of new fingerprinting regulations.
• Increase the fee for youth organizations from $0 to $10 per hour to cover the cost of ball
diamonds.
• Adjust service fee for permits and plan checks to recover all associated costs.

The provisions of the Santa Clarita Municipal Code are similar to those of the County Code.
Any violations of the Santa Clarita ordinances which are not listed in the schedule have a
standard bail. Bail for an unlisted misdemeanor is $250.00 and bail for an unlisted infraction
is $35.00.
The City Council will adopt the Santa Clarita Bail Fee Schedule by resolution. The schedule
and resolution are then submitted to the Presiding Judge, who is Judge Floyd Baxter, will
review the proposed bail schedule and present it to the other judges. Once reviewed by all
judges of the Newhall Municipal Court, it will be forwarded to the Municipal Court Judicial Bail
Committee for the County of Los Angeles. The Judicial Bail Committee then adopts a
comprehensive schedule. In this case, the City Council is advisory to the judicial branch in
setting the bail schedule.
The revenue to the City is determined by the following formula:
