PUBLIC HEARING
DATE: June 25, 1996
SUBJECT: COST RECOVERY ANALYSIS AND PROPOSED NEW FEE SCHEDULE
DEPARTMENT: Administrative Services
This is the first reading of and public hearing on the fee ordinance and proposed fee schedule.
The second reading and adoption of the ordinance and resolution will come to the Council for
adoption on July 9, 1996.
In 1990, the City Council directed staff to prepare a study identifying the full cost of providing
services. The result of this effort was the adoption of City Council policy establishing cost
recovery standards, the adoption of the City's first full -cost based fee schedule, and an ongoing
mechanism to assess the cost of City services and to adjust fees accordingly.
Since 1990, the City has chosen to delay consideration of any fee increases due to the poor state
of the regional and state economy. In early 1996, the City Manager directed staff to reassess
the City's full cost of providing services. The 1990 business cost assessment methodology was
again utilized in performing the current cost analysis update. The 1996 analysis shows that the
City's fees have not been increased to keep up with costs. As a result, the City is not recovering
costs at the levels established by the City Council in 1990.
Propositions 4 and 13 established the "costs reasonably borne" philosophy. This philosophy
necessitates the determination of the full business cost of each City -provided service, the
identification of the beneficiary of each service, and the evaluation of services to determine an
appropriate level of cost recovery for each. "Costs reasonably borne" implies a direct
relationship between payment of fees and charges and receipt of services. This direct feelservice
and tax equity relationship does not exist when tax monies are used to subsidize services
received by only a small portion of the taxpaying public, or by non-residents.
In May, staff conducted several public meetings to receive input on the proposed cost recovery
plan. This input has been incorporated into the fee schedule. The cost recovery analysis and
proposed fee changes were presented to the City Council at the June 4, 1996 Study Session.

COST RECOVERY ANALYSIS AND PROPOSED NEW FEE SCHEDULE
June 25, 1996 - Page 2
The City Council raised several questions during the Study Session which are addressed below:
Reduce fees for low-income and senior housing projects. A memo from George Caravalho
was sent to the City Councilmembers stating this process was already in effect.
How much of the Sheriffs time is spent responding to false alarms? Staff answered
approximately 15%. Council directed staff to pursue a false alarm program.
What constitutes a DUI? When does the party pay? After conviction? If a vehicle shows
obvious signs that the driver is intoxicated, it will be pulled over. The driver is given a field
sobriety test and a choice of a urine or breath test. An alcohol level of .08 constitutes arrest.
If the tests do not show an alcohol level, the driver may be given a blood test for drugs.
Other than the attorney fees, the payment is due after conviction.
New items included in the Schedule of Fees and Charges as a result of the Study Session are
itemized fees for Recreation programs and the Los Angeles County Animal Control Fee
Schedule. Based on review by the City Attorney, specific Recreation program fees have been
added in place of the proposed administrative authority for establishing fees.
Receive report, conduct public hearing, conduct first reading of Ordinance No. 96-24 and
schedule second reading and adoption of Ordinance and Resolutions for July 9, 1996.

The provisions of the Santa Clarita Municipal Code are similar to those of the County Code.
Any violations of the Santa Clarita ordinances which are not listed in the schedule have a
standard bail. Bail for an unlisted misdemeanor is $250.00 and bail for an unlisted infraction
is $35.00.
The City Council will adopt the Santa Clarita Bail Fee Schedule by resolution. The schedule
and resolution are then submitted to the Presiding Judge, who is Judge Floyd Baxter, will
review the proposed bail schedule and present it to the other judges. Once reviewed by all
judges of the Newhall Municipal Court, it will be forwarded to the Municipal Court Judicial Bail
Committee for the County of Los Angeles. The Judicial Bail Committee then adopts a
comprehensive schedule. In this case, the City Council is advisory to the judicial branch in
setting the bail schedule.
The revenue to the City is determined by the following formula
2% to an Automation Fund
98% is further divided in which:
89% is divided further with:
50% going to the State and
50% going to the City
11% goes to the State
The bail schedule will have no impact on the City's budget.
