SUBJECT: CROSSING GUARD SERVICE BY SCHOOL DISTRICTS
RESOLUTION NO. 96-108

A few years ago, legislation was passed to repeal the requirement that would obligate only the
City to provide adult crossing guards. The City Council, however, has decided to continue the
adult crossing guard program for the existing locations and refer the need for -any additional
crossing guards to the appropriate school districts.
Recently, Dr. Joseph Fazio, Superintendent of the Saugus School District, requested that the
City provide a crossing guard at the intersection of Catala Avenue and Empino Street for
Highland Elementary School. The intersection was previously evaluated and the crossing guard
warrants were not satisfied. With this, the school district is proposing to provide its own school
crossing guard service at the intersection, but is requesting the City to assist them in providing
the training for. the guard. The school district also proposes to fund the cost for the crossing
guard service and accept full liability.
The California Education Code Section 45450 allows the school districts to employ school
crossing guards. According to the California Vehicle Code Section 21100(i), the school districts
can be permitted to provide crossing guard services at intersections in the vicinity of schools.
In order for school districts to assign crossing guards, the City Council must pass a resolution
to give such authority to the school districts. The above Education and Vehicle Code sections
are shown in Exhibit "A."
Based on the above, staff recommends that the school districts in the City of Santa Clarita be
permitted to provide crossing guards at intersections in the City.
Adopt Resolution No. 96-108, and permit the school districts to hire and provide crossing guards
at intersections in the vicinity of schools.

RESOLUTION NO. 96-108
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA TO
ALLOW SCHOOL DISTRICTS TO HIRE AND PROVIDE
ADULT CROSSING GUARDS AT INTERSECTIONS
IN THE VICINITY OF SCHOOLS
WHEREAS, Section 45450 of the Education Code of the State of California allows the governing
board of any school district to employ guards at pedestrian crossings to ensure the safety of
school children who use such intersections; and
WHEREAS, Section 21100(1) of the Vehicle Code of the State of California, allows the local
authorities to adopt rules and regulations by resolution regarding the matter of providing adult
school crossing guards for protection of persons who are crossing the street or highway in the
vicinity of a school or while returning thereafter to a place'of safety.
THEREFORE, the City Council of the City of Santa Clarita does resolve as follows:
SECTION 1- That any school district be permitted to provide adult school crossing guards at
intersections in the vicinity of schools.
SECTION 2 - That the school districts shall be responsible for the associated cost and liability
for providing adult school crossing guards.
SECTION 3 - That the City of Santa Clarita assist the school districts in the training of school
crossing guards.

California Education Code Section 45450 - The governing board of any school district may
employ, in accordance with the provisions of this chapter, such personnel as may be necessary
to act as guards at pedestrian crossings to ensure the safety of school children who use such
intersections.
California Vehicle Code Section 21100(i) - Local authorities may adopt rules and regulations by
ordinance or resolution regarding the matter of providing for the appointment of non -student
school crossing guards for the protection of persons who are crossing a street or highway in the
vicinity of a school or while returning thereafter to a place of safety.
