Nisich PUBLIC HEARING DATE: January 9, 1996 SUBJECT: FOUR OAKS HIGH GROUNDWATER RESOLUTION NO, 96-3 DEPARTMENT: Building and Engineering Services At the November 28, 1995 City Council meeting, staff submitted a report on the chronology of events related to the City's efforts to provide a solution to the high groundwater problem in the Four Oaks area, shown on the attached vicinity map. In the report, staff recommended the formation of a Drainage Benefit Assessment District to fund ongoing maintenance costs of a pump system. The City Council set a public hearing for January 9, 1996 at 7:30 p.m. to consider the formation of the District and authorized the preparation of an Engineer's Report. The Engineer's Report is completed and a copy is attached, It contains a description of the services to be provided, a description of each lotto be assessed, the amount to be assessed on each lot, and a schedule and basis of the assessment. Public notices informing area residents of the January 9 public hearing were mailed. The public notices were also published and posted as required by the Benefit Assessment Act of 1982. On January 3, 1996, a public meeting was held at the City Council Chambers with area residents to answer questions regarding the formation of the District and the January 9 public hearing. The public hearing is an opportunity for residents to address the City Council regarding the formation of the District. Upon closing of the public hearing, Council has the option to adopt the resolution determining and proposing for adoption an annual assessment for Santa Clarita Drainage Benefit Assessment Area (DBAA) No. 19, "Four Oaks," The Council can then call for an election and direct the City Clerk to mail ballots to registered voters in the District. The District shall take effect upon approval by a majority of voters voting on the proposition. Without a majority, the City has the option to repeat the public hearing and election process at a later date. Should a consensus be reached not to adopt the resolution, Council may find no need for the FEMA grant and forego. the funding. All costs associated with administration of DBAA No. 19, if established, would be charged to the District, resulting in no fiscal impact to the City. Should the District not be formed, it is anticipated that the City will incur similar costs to the previous two high-water events. The following costs include roadway repairs, supplemental sweeping and additional refuse pickup. However, if load limits are not put in place, this cost would be. substantially higher. RECOMMENDATION City Council adopt the resolution to determine and propose for adoption an annual assessment for Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks," and call for an election. Direct the City Clerk to mail ballots to all registered voters in the District.. Mayor announces decision RESOLUTION NO. 96-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA DETERMINING AND PROPOSING FOR ADOPTION AN ANNUAL ASSESSMENT FOR SANTA CLARITA DRAINAGE BENEFIT ASSESSMENT AREA NO. 19, "FOUR OAKS" WHEREAS, the City Council has by its Resolution No. 96-3 initiated proceedings to form Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks" under the provisions of the Benefit Assessment Act of 1982 being Chapter 6.1 of Part 1, Division 2 of the California Government Code (hereinafter referred to as "the Act"); and WHEREAS, Section 54715 of the Act permits the City Council, after notice and public hearing, to adopt a resolution determining and proposing an annual assessment on each parcel of real property within Drainage Benefit Assessment Area No. 19, "Four Oaks'; and WHEREAS, the City Council has directed the City Engineer to prepare a report (hereinafter referred to as the "Engineer's Report") describing the service proposed to be financed through the revenue derived from the assessment, a description of each lot or parcel of property proposed to be subject to the benefit assessment, the amount of the proposed assessment for each parcel, and the basis and schedule of the assessment for the District; and WHEREAS, the City Council has examined and considered the Engineer's Report, which shall govern among other things as to the improvements and service to be provided, and the proceedings prior thereto; and WHEREAS, notice of said hearing was duly given as required by the Act; and WHEREAS, at the time, date, and place so fixed, a public hearing was duly held by the City Council at which all written protests or objections were presented and read, and all persons desiring to be heard thereon were heard, and the City Council gave all persons present an opportunity to be heard in respect to any matter relating to the Engineer's Report or any of the proceedings therefor. NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of the City of Santa Clarita, State of California, that: Section 1. The City Council is satisfied with the correctness of the Engineer's Report including the proceedings and all matters relating thereto. Section 2; All protests and objections be and the same are overruled and denied. Section 3. The City Council has determined that the assessment on each parcel of property within Drainage Benefit Assessment Area No. 19, "Four Oaks" is related to the benefit to the parcel which will be derived from the provision of service and that the annual aggregate amount of the assessment does not exceed the estimated annual cost of providing the service. The City Council orders the establishment of an improvement fund entitled Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks" and all moneys received representing assessments collected for the District shall be deposited by the City Finance Department in said fund and shall be expended to pay the cost of only the service for which the assessment is levied and for no other service. Section 5. The City Council determines and proposes for adoption an annual assessment` on each parcel of real property within Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks." Section 6. The; City Council determines that the amounts to be assessed against the individual parcels described in the Engineer's Report are hereby approved and confirmed and are hereby levied by said Council as special assessments against said parcels for fiscal year 1996-1997. Section 7. The City Council determines that the collection of the assessment shall be in the same manner, and subject to the same penalties and priority of lien, as other charges and taxes collected by the Los Angeles County Tax Collector. Section 8. The City Council hereby directs the City Clerk to mail a ballot which poses the question before the voters within Santa Clarita Drainage Benefit Assessment Area No, 19, "Four Oaks' whether the City shall be authorized to levy assessments for the service proposed. The ballot shall be mailed to each property owneror registered voter indicated in the Engineer's Report and returned no later than 19_. Section 9, The City Council determines that the assessment proposed to be levied for the first fiscal year 1996-1997 shall take effect in the Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks" upon approval- by a majority vote of the voters voting on the proposition.. The purpose of the public information meeting and the public hearing is to receive and consider public testimony regarding the improvements, the extent of the District, or the assessments. The contemplated improvements are briefly described as providing maintenance of subsurface drainage improvements and pump system for removal of high groundwater in the local area when necessary. The Benefit Assessment Act of 1982 (which governs the District) provides that the City's total cost can be recovered in the assessment spread including incidental expenses. Incidental expenses may include engineering fees, legal fees, printing, mailing, postage, publishing and all other costs identified with the District Proceedings. The 1996/97 fiscal year expenditures is estimated to be $6,612. The City is contributing a grant from FEMA to install the pumping system. NONE OF THIS INSTALLATION COST IS BEING ASSESSED TO THE DISTRICT. The estimated assessment for parcels like yours, which includes your property, is $38 for your entire parcel. For further particulars, you may refer to the Engineer's Report, which is on file with the City Clerk, at 23920 Valencia Boulevard, Santa Clarita, CA. ASSESSMENT, AREA NO. 19, "FOUR. OAKS" By action of the City Council of the City of Santa Clarita, on November 28, 1995, proceedings were initiated for the levying of annual assessments within the boundaries of Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks" (hereinafter referred to as the "District") for payment of all costs required for the continued maintenance, operation, and servicing of subsurface drainage improvements pursuant to provisions of the Benefit Assessment Act of 1982 being Chapter 6. 1, Part 1, Division 2, of the Government Code of the State of California. In addition, the City Engineer was directed to prepare a written Engineer's Report and file it with the CityClerk pursuant to Section 54716 of the Government Code. There are 174 parcels of property within the boundaries of the District being a subdivision of lots in the City of Santa Clarita. The description of the boundaries of the District and the property proposed to be subject to the benefit assessment is as described on Exhibit "A" attached hereto. Plans and specifications indicating the general nature, location, and extent of improvements are on file with the City Engineer of the City of Santa Clarita and are hereby made apart hereof by reference. The attached map, Exhibit "B;' identifies the boundaries of the District and the location and extent of improvements to be constructed and maintained. The revenue derived from the proposed assessments will be used to maintain, operate, and service these drainage improvements: The Benefit Assessment Act of 1982 provides that a City may impose a benefit assessment to finance the maintenance and operation costs of drainage services. The Act also indicates that the assessment imposed on any parcel of property shall be related to the benefit to the parcel which will be derived from the provisions of the service. The subsurface drainage improvements constructed by the City are to provide for the elimination of high ground water for the parcels within the boundaries of the District. Maintenance and operation of the subsurface drainage improvements involver periodic inspection and evaluation; pumping and electrical costs; unclogging and clean out when necessary; and periodic repairs when necessary. The subsurface drainage improvements constructed by the City do not benefit any surrounding properties outside the District because these properties are not subject to the constant drainage runoff caused by the high groundwater and would receive no benefit from the maintenance and operation of the improvements.. Engineer's Report Page 2 Because the area within the District is benefited only and exclusively by the subsurface drainage improvements constructed for that area, the maintenance, operation, and servicing of the improvements benefit only that area. Hence, the benefit to each parcel to be assessed is based on the total costs and only those costs of maintenance, operation, and servicing of the subsurface drainage improvements constructed in the District. The amount of the proposed assessment for each parcel is as shown on Exhibit "C," which is attached hereto and which is made a part hereof. The annual aggregate amount of the total estimated annual cost of providing maintenance, operation, and servicing of the subsurface drainage improvements is shown on Exhibit "D," which is attached hereto and which is made a part hereof. All revenue derived from the assessment will not be used to pay the cost of any service other than the service for which the assessment is levied. The basis of benefit was determined to be dwelling units, i.e., 1 dwelling unit = 1 benefit unit. This District includes 174 dwelling units. EXHIBIT "A" CITY OF SANTA CLARITA DRAINAGE BENEFIT ASSESSMENT AREA NO. 19, 'TOUR OAKS" LEGAL DESCRIPTION The property in City of Santa Clarita, County of Los Angeles, State of California included within the following described boundary is within and is the entire District for the Four Oaks Assessment District. I would, however, like to make my views known. For over three years, I have worked with staff attempting to find an amicable solution to our problem. Amazingly, staff was able to procure funding from FEMA to install wells and pumps and repair our streets. As you know, many resident meetings have taken place over the last several years. Many of us have endured major plumbing problems such as failing discharge lines, over- flowing tubs, sinks and toilets and the like. All of us have been affected by soggy landscaping, algae -coated driveways, parkways, curbs and gutters, small fly infestations, mosquito infestations and their potential health risks, the stench and the blight. This is a fixable problem and we have the federal monies backing up staff's recommendations. In short, I urge you to create the assessment district and require input when the problem occurs again. Sincerely, Y"Aell- S, Wt Margaret S. wolf 19618 Fairweather Street Santa Clarita, CA 91351 298-2534 CITY OF SANTA CLARITA ENGINEER'S REPORT REGARDING LEVYING OF AN ASSESSMENT FOR DRAINAGE BENEFIT ASSESSMENT AREA NO. 19 "FOUR OAKS" FOR DRAINAGE MAINTENANCE PURPOSES PURSUANT TO PROVISIONS OF THE BENEFIT ASSESSMENT ACT OF 1982 (CHAPTER 6.1, PART 1 DIVISION 2, GOVERNMENT CODE, STATE OF CALIFORNIA) JANUARY 9, 1996 REVISED JANUARY 10, 1996 CITY OF SANTA CLARITA ENGINEER'S REPORT REGARDING LEVYING OF AN ASSESSMENT FOR DRAINAGE BENEFIT ASSESSMENT AREA NO. 19 "FOUR OAKS" By action of the City Council of the City of Santa Clarita, on November 28, 1995, proceedings were initiated for the levying of annual assessments within the boundaries of Santa Clarita Drainage Benefit Assessment Area No. 19 "- Four Oaks" (hereinafter referred to as the "District") for the payment of all costs required for the continued maintenance, operation, and servicing of subsurface drainage improvements pursuant to provisions of the Benefit Assessment Act of 1982 being Chapter 6.1, Part 1, Division 2, of the Government Code of the State of California. In addition, the City Engineer was directed to prepare a written Engineer's Report and file it with the City Clerk pursuant to Section 54716 of the Government Code. There are 174 parcels of property within the boundaries of the District being a subdivision of lots in the City of Santa Clarita. The description of the boundaries of the District and the property proposed to be subject to the benefit assessment is as described on Exhibit "A" attached hereto. Plans and specifications indicating the general nature, location and extent of improvements are on file with the City Engineer of the City of Santa Clarita and are hereby made a part hereof by reference. The attached map, Exhibit "B", identifies the boundaries of the District and the location and extent of improvements to be constructed and maintained. The revenue derived from the proposed assessments will be used to maintain, operate and service these drainage improvements. The Benefit Assessment Act of 1982 provides that a City may impose a benefit assessment to finance the maintenance and operation costs of drainage services. The Act also indicates that the assessment imposed on any parcel of property shall be related to the benefit to the parcel which will be derived from the provisions of the service. The subsurface drainage improvements constructed by the City are to provide for the elimination of high ground water for the parcels within the boundaries of the District. Maintenance and operation of the subsurface drainage improvements involve: periodic inspection and evaluation; pumping and electrical costs; unclogging and clean out when necessary; and periodic repairs when necessary. The subsurface drainage improvements constructed by the City do not benefit any surrounding properties outside the District because these properties are not subject to the constant drainage runoff caused by the high groundwater and would receive no benefit from the maintenance and operation of the improvements. REVISED 1-10-96 Revised Engineer's Report Page 2 Because the area within the District is benefited only and exclusively by the subsurface drainage improvements constructed for that area, the maintenance, operation and servicing of the improvements benefit only that area. Hence, the benefit to each parcel to be assessed is based on one-half of the total costs and only those costs of maintenance, operation and servicing of the subsurface drainage improvements constructed in the District. The remaining one-half of the costs will be covered by the city. The amount of the proposed assessment for each parcel is as shown on Exhibit "C" which is attached hereto and which is made a part of hereof. The annual aggregate amount per parcel of the total estimated annual cost of providing maintenance, operation and servicing of the subsurface drainage improvements is shown on Exhibit M" which is attached hereto and which is made a part hereof . All revenue derived from the assessment will not be used to pay the cost of any service other than the service for which the assessment is levied. The basis of benefit was determined to be dwelling units, i.e., 1 dwelling unit = 1 benefit unit. This District includes 174 dwelling units.
