DEPARTMENT: Public Works 1(—%'X 3.11MI D At the August 27, 1996 City Council meeting, staff was directed to prepare an ordinance to amend Chapter 15.44 (Integrated Waste Management) of the Santa Clarita Municipal Code to prohibit the placement of recyclables, specifically yard trimmings, in unauthorized containers. The proposed ordinance also allows for exemptions from the yard trimmings recycling program to be granted at the discretion of the City Manager or a designee. The primary criteria for program exemption are: residences with a complete absence of vegetative landscaping or residences that are actively involved in home composting or mulching of all yard trimming material generated at the abode. The proposed ordinance also adds definitions for RecKlables, Solid Waste and Yard Trimmings to the Integrated Waste Management Code. The proposed amendments to the Integrated Waste Management Code are designed to facilitate effective implementation of the residential yard trimmings recycling program and to provide guidelines for program compliance and enforcement. ORDINANCE NO. 96-28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING THE MUNICIPAL CODE AT CHAPTER 15.44 REGARDING REGULATIONS GOVERNING INTEGRATED WASTE MANAGEMENT, INCLUDING REFUSE COLLECTION AND DISPOSAL SERVICES WITHIN THE CITY, AUTHORIZING THE FURNISHING OF SUCH SERVICES BY THE CITY OR PURSUANT TO FRANCHISE OR PERMIT THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1. The Santa Clarita Municipal Code is amended at Chapter 15.44 relating to integrated waste management to read as follows: Part 1 - Definitions for the purposes of this Chapter, the following italicized words and phrases shall be added and have the meaning respectively ascribed them by this Part 1: 15.44.076 Recyclables. "Recyclables" includes any and all tin, steel and tin plated beverage and food containers; aluminum cans, foil and scrap, glass bottles, jars and food containers; PETE (#1 resin) plastic bottles and containers; HDPE (92 resin) plastic bottles and containers, PS (#6 resin) plastic containers, clamshells, cutlery; corrugated cardboard; chipboard; mixed paper, junk mail; magazines; newspaper, telephone books; aseptic containers; Christmas trees and any other recyclable goods designated by the City Manager or Designee. 15.44.096 Solid Waste "Solid Waste" includes refuse and yard trimmings, means putrescible or non. putrescible, and includes rubbish, garbage and yard trimmings as defined in this section. 15.44.101 Yard Trimmings. "Yard Trimmings" includes vegetative cuttings, shrubs, stumps, brushes, tree trimmings, leaves, grass clippings, twigs, weeds, and related garden materials. Yard trimmings does not include agave, yucca, palm fronds, bamboo or juniper spears. Part 1 - Definitions for the purposes of this Chapter, shall be revised as follows: 15.44,090 Rubbish "Rubbish" means nonputrescible unwanted or discarded material or debris, either combustible or noncombustible including but not limited to paper, cardboard, grass, tire m shrub himinings, straw, clothing; fvead or wood products, crockery, glass, rubber, nietal, plastic, construction or demolition material, mcyclables, compostables, bulky wastes and other municipal solid waste. Part 2- Integrated Waste Management for the purposes of this Chapter, is revised to read as follows: 15,44,200 Provision of Service. The City shall provide for or furnish integrated waste management services relating to collection, transfer, and disposal of refuse, yard trimmings, recyclables and compostables within and throughout the City. Such services may be furnished by any one or combination of the following: (i) City officers and employees; (ii) contractors franchised or licensed by the City; or (iii) agreement with another local agency. 15.44.215 Collection Arrangements Required. The owner, occupant or other person responsible for the day-to-day operation of every property in the City of Santa Clarita shall make arrangements with the City, another local agency approved by the City, or a contractor fimchised or licensed by the City for the collection of refuse, recyclable materials, yard trimmings, and compostable materials as set forth in this Chapter. Part 3 - Fees. Franchises and Licenses for the purposes of this Chapter is revised to read as follows: 15.44.325 Liability for Fees. (a) Every person required to arrange for refuse collection or the collection of recyclables, yard trimmings or compostables shall be liable for the service access fees and charges for such collection, whether or not collection services are utilized. Part 4 - Containers for the purposes of this Chapter is revised to read as follows: 15.44.400 Containers: Location. It is the duty of every person designated under Part 2 in possession, charge or control of any place within the City, in or from which refuse solid waste accumulates or is produced, to keep in a suitable place readily accessible to the collector, containers capable of holding without spilling all refuse solid waste which would ordinarily accumulate on the premises between the time of two successive collections. 15.44.405 Use of Containers. (a) Every person designated under Part 2 who is in charge of residential or commercial premises shall deposit or cause to be deposited all refuse, recyclables and yard trimmings in standard containers or bins as approved and assigned by the City Manager or designee and the collector. (e) Every person designated under Part 2 who is in charge of residential or commercial premises shall not mix recyclables or yard trimmings with either rubbish or refuse as defined in Part I - Definitions. 15,44.410 Unlawful Acts. It is unlawful for any person to place refuse and yard trimmings in or to otherwise use the refuse containers of another person without the permission of such other person.. Part 9 - Self -Haulers for the purposes of this Chapter shall be revised and added to read as follows: 15.44.901 Exemptions All residential dwellings, multi family dwellings and commercial establishments have the option to be exempt from yard trimmings collection serviceprovided that those dwellings have no landscaping or that home composting and mulching is actively practiced as a method to source reduce all yard trimmings generated at that dwelling site Those exercising this option have the responsibility of notifying their individual contractor of their intention of being exempt from the program and applying for an exemption permit through the City. The City Manager or designee shall make a determination on the issuance of a certificate of exemption from the yard trimmings service If this option is exercised the contractor shall not pickup yard trimmings from the location. It is the Contractor's responsibility NOT to collect any yard trimmings with the refuse/rubbisk SECTION 2. SEVERABILITY. The city council hereby declares that the provisions of this Ordinance are severable and if for any reason a court of competent jurisdiction shall hold any sentence, paragraph or section of this ordinance to be invalid, such decision shall not affect the validity of the remaining parts of this Ordinance. SECTION 3. The City Clerk shall certify to the adoption of this ordinance and cause a copy of this ordinance to be published in the manner prescribed by law.
