October 22, 1996 SUBJECT: A RESOLUTION OF APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF LOS ANGELES COUNTY FOR ANNEXATION NO. 1995-01 (MASTER CASE NO. 95-049), THE "HUNTERS GREEN GOLF COURSE AND RESIDENTIAL PROJECT" ANNEXATION RESOLUTION NO. 96-129 DEPARTMENT:. Community Development BACKGROUND On September 10, 1996, the City Council approved Master Case No. 95-049 allowing for the development of a 401 acre property with two 18 hole golf courses, clubhouse and 73 single family residential lots. Approximately 103 acres of the project site is located outside of the City limits. The 'Resolution of Application" proposed for adoption by the City Council constitutes a formal request to the Local Agency Formation Commission (LAFCO) to initiate annexation proceedings for Annexation No. 1995-01 the "Hunters Green" Annexation (Master Case No. 95-049). The Resolution sets forth applicable Government Code sections, reasons for the annexation, exhibits identifying the site, and other required information. The applicant will be required to pay all filing fees associated with this application. Annexation No. 1995-01, is a proposal to annex 103 acres of uninhabited land generally located south of Oak Spring Canyon Road and north of Live Oak Springs Canyon Road, adjacent to the existing corporate boundaries in the Sand Canyon area. The proposed annexation is being requested by the project proponent and property owner. Though there was opposition to the development, staff is not aware of any formal opposition to the annexation. A fiscal impact analysis was prepared for the project. The summary page is attached to this report. In general, revenues generated from the annexation will offset expenditures incurred by the City. Resolution No. 96-129 Exhibit A - Legal Description Exhibit B - Map s:\cd\annex\951apangea RESOLUTION NO. 96-129 A RESOLUTION OF APPLICATION BY THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THAT THE LOCAL AGENCY FORMATION COMMISSION OF LOS ANGELES COUNTY INITIATE PROCEEDINGS FOR THE PROPOSED ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF SANTA CLARITA (MASTER CASE NO. 95-049 - HUNTERS GREEN ANNEXATION) WHEREAS, the City of Santa Clarita desires to initiate proceedings pursuant to the Cortese -Knox Local Government Reorganization Act of 1985 (Revised 1994), Division 3, commencing with Section 56000 of the California Government Code, for annexation; and WHEREAS, the territory proposed to be annexed is uninhabited, and a description of the boundaries is set forth in Exhibit A and a map of the boundaries is set forth in Exhibit B, attached and by this reference incorporated; and WHEREAS, the short form designation of the proposal is Annexation No. 1995-01 (Master Case No. 95-049); and WHEREAS, this proposal is inconsistent with the City of Santa Clarita's Sphere of Influence as designated by the Local Agency Formation Commission on November 15, 1989, and would require amending thereof pursuant to this proposal; and WHEREAS, no terms or conditions are requested by the City or the property owner for this proposed annexation at this time; and WHEREAS, the reasons for this proposed annexation are as follows: 1) to respond to the property owner's request for City services and; 2) to expand and provide a logical extension of the City's physical boundary and urban service area; and 3) to promote sound planining and land use practices in the affected territory; and WHEREAS, all owners of land within project area have given their written consent to the annexation; and WHEREAS, the City Council of the City of Santa Clarita has considered all evidence, oral and documentary, and is advised of the foregoing. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Santa Clarita, California, does hereby determine and find as follows: SECTION 1. This Resolution of Application is hereby adopted by the City Council, and the Local Agency Formation Commission of Los Angeles County.is hereby requested to initiate proceedings for the annexation of that territory described in Exhibit A and mapped in Exhibit B, incorporated by this reference, according to the terms and conditions stated above, if any, Page 2 without notice and hearing by the commission and the City, and in the manner provided by the Cortese -Knox Local Government Reorganization Act of 1985 (Revised 1994). SECTION 2. The City Council hereby directs and authorizes the City Clerk of the City of Santa Clarita to forward a certified copy of this Resolution with applicable fees and other information as required by Section 56383 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Los Angeles County.
