SUBJECT: FUNDING AND LIABILITY COVERAGE FOR COWBOY POETRY
FESTIVAL

BACKGROUND
The third annual Cowboy Poetry and Music Festival is scheduled to be held, once again, at
Melody Ranch Motion Picture Studio, which is located adjacent to Placerita Canyon Road.
The City has entered into an agreement with Mark IV Buses to provide a shuttle service for
participants of the event. In addition, should Placerita Canyon Corporation agree to allow
400 VIP parking permit holders to utilize Placenta Canyon Road for each day of the Festival;
it will include the indemnification of these vehicles..
City staff has communicated with Steve Stethansen,-President of the Placerita Canyon
Corporation, and has asked that the City indemnify the Placerita Canyon Corporation and
Homeowner's Association from accidents from Festival patrons from 6:00 p.m.,
March 29, 1996, to 6:00 p.m., March 31, 1996.
In addition, the Cowboy Poetry and Music Festival expanded this year by offering more
opportunities in terms of ticketed performances for people to attend. This was in direct
response to selling out all performances during the first two years of the Festival. Tickets
offered this year increased from approximately 3,000 to around 7,000. General Admission
was added as well to afford interested patrons the opportunity to experience the Festival
atmosphere, while offsetting costs with a $3 fee for the admission.
An increase of funds for expenses is required to accommodate the expansion in, performances
offered, as well as to adequately serve the larger crowds expected due to offering general
admission. The funds will cover the costs of items such as additional performers and shows,
increased sound, stage, lighting, power, equipment rental, and transportation.
An increase in revenue will take place through additional ticket sales, parking permits, and
gear show vendor fees, which will proportionately offset the increase in expenditures.

City Council direct the City Manager to execute the attached City Attorney approved
indemnification agreement,
In addition, staff recommends that council approve increased appropriations as shown below:

LIMITED INDEMNITY
The City of Santa Clarita, a municipal corporation, hereby agrees to indemnify, defend,
and hold harmless the Placerita Canyon Corporation re: the privately -owned portion of
Placerita Canyon Road within the City of Santa Clarita, from any and all claims for damages
resulting from the use of the privately -owned portion of Placerita Canyon Road by the City -
contracted bus shuttle or by persons attending the Cowboy Poetry and Music Festival during
the period commencing 6:00 p.m. Pacific Standard Time on March 29, 1996, and ending at
6:00 p.m. Pacific Standard Time on March 31, 1996. Said indemnity specifically excludes any
negligent or intentional act or omission of the Placerita Canyon Corporation or the property
owners holding title to the privately -owned portion of Placerita Canyon Road within the City
of Santa Clarita, provided, however, that any property owner negligence associated with the
current condition of Placerita Canyon Road is expressly excluded.
