HomeMy WebLinkAbout1996-08-27 - AGENDA REPORTS - LOCKHEED BUSINESS PARK ANNEX (2)\!1 4 - 'a City Manager Item to be pro Don Williams CONSENT CALENDAR DATE: August 27, 1996 SUBJECT: JOINT RESOLUTION OF NEGOTIATED PROPERTY TAX TRANSFER FOR ANNEXATION NO. 1995-03 (LOCKHEED BUSINESS PARK ANNEXATION) RESOLUTION NO. 96-91 DEPARTMENT: Building and Engineering Services The proposal is for a Joint Resolution of Negotiated Property Tax Transfer to be adopted by the City Council for Annexation No. 1995-03 ("Lockheed Business Park Annexation"). Annexation No. 1995-03 is a proposal to annex to the City of Santa Clarita 377 acres of land owned by the Lockheed Corporation located at the northeastern terminus of Rye Canyon Road adjacent to the northwestern portion of the existing City limits (see attached map). The site consists of land currently developed with approximately 25 structures totaling 502,000 square feet of floor space. Along with the annexation of this property, the Lockheed Corporation has requested the approval of discretionary entitlements to allow the future development of the site as a business park, with an additional four million square feet of buildings and infrastructure to serve the project. There are no known persons or organizations opposed to this annexation. The City Council adopted Ordinance No. 96-17 on June 11, 1996, for the Lockheed Business Park Prezone. The project site is currently under the Los Angeles County zone classification of A-2-5 (Heavy Agriculture, 5 -acre minimum lot size) and M11h (Restricted Heavy Manufacturing). The City of Santa Clarita has pre -zoned the project site to BP (Business Park) to allow the proposed development and use of the site as a business park in conformance with the City's Unified Development Code and General Plan. City staff subsequently requested that the Local Agency Formation Commission (LAFCO) initiate proceedings for proposed Annexation No. 1995-03. Analysis: The Los Angeles County Auditor -Controller has reviewed the proposed property, transfer and negotiated exchange of property tax revenue. associated with proposed jurisdictional change of Annexation No. 1995-03. Pursuant to State law, distribution of property tax revenue derived from the area must be negotiated and approved by a joint resolution of the City of Santa Clarita and the County of Los Angeles. The provisions of the proposed resolution reflect the County's standard language for property tax negotiation. JOINT RESOLUTION OF NEGOTIATED PROPERTY TAX TRANSFER FOR ANNEXATION NO. 1995-03 August 27, 1996 - Page 2 The County Auditor -Controller has determined the assessed value of the 377 -acre site at $50,489,119.00, and has computed the incremental tax growth to be transferred from the County to the City at 5.9401657%. The City's Finance Division of Administrative Services has reviewed the negotiated exchange of property tax revenue proposed by the County Auditor - Controller, and has determined that the conditions of the joint tax transfer are acceptable to the City. Upon Council adoption of Resolution No. 96-91, the proposed joint property tax negotiation resolution can be submitted to the Los Angeles County Board of Supervisors for adoption. Once the City Council and the Board of Supervisors have adopted the proposed property tax transfer resolution, the annexation proposal will be forwarded to LAFCO and scheduled for a hearing. Staff estimates that the annexation will be completed by September 1996. RECOMMENDATION Adopt Resolution No. 96-91, authorizing the Mayor to sign the proposed property tax transfer resolution for transmittal to LAFCO for action by the Los Angeles County Board of Supervisors. ATTACHMENTS Resolution No. 96-91 Vicinity Map MJC:IkI ca UW96.9i., k E��i)FLU VON rkF8199T.Te);1 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING AND ACCEPTING NEGOTIATED EXCHANGI OF PROPERTY TAX REVENUE RESULTING FROM "ANNEXATION 1995-03" (LOCKHEED BUSINESS PARD TO THE CITY OF SANTA CLARITA WHEREAS, pursuant toSection99 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change, the governing bodies of all agencies whose service areas or service responsibilities would be altered by such change must determine the amount of property tax revenue to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; but, if the affected agency is a special district, the Board of Supervisors must negotiate on behalf of the district; and WHEREAS, the Board of Supervisors of the County of Los Angeles and the City Council of the City of Santa Clarita have determined that the amount of property tax revenues to be exchanged between their respective agencies as a result of the annexation of unincorporated territory to the City of Santa Clarita, entitled "Annexation 1995-03," is as set forth below. NOW, THEREFORE, BE IT RESOLVED: 1. The negotiated exchange of property tax revenue between the County of Los Angeles and the City of Santa Clarita resulting from "Annexation 1995-03" is approved and accepted. 2. For fiscal years commencing July 1, 1997, or the July 1 after the effective date of this jurisdictional change, whichever is later, Twenty -Nine Thousand, Nine Hundred Ninety - One Dollars ($29,991) in property tax revenue shall be transferred from the County of Las Angeles to the City of Santa Clarita. In addition, for each fiscal year commencing July 1, 1997, or the July 1 after the effective date of this jurisdictional change, whichever is later, 5.9401657% of the incremental tax growth attributable to the Santa Clarita "Annexation 1995-03" area shall be transferred froom the. County of Los Angeles to the City of Santa Clarita, and the County's share of incremental tax growth shall be reduced accordingly. 3. For fiscal years commencing July 1, 1997 or the July 1 after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by Road District No. 5 attributable to the Santa Clarita "Annexation 1995-03" area shall be transferred to the County of Los Angeles. 4. In the event that all or a portion of the annexation area is subsequently included within a redevelopment project pursuant to California Community Redevelopment Law (California Health & Safety Code Sections 33000 et seq.), the City of Santa Clarita shall not adopt the ordinance approving the redevelopment plan with respect to the annexed area until such time as the Redevelopment Agency of the City of Santa Clarita has diligently and in good faith complied with. all applicable provisions of the California Community Redevelopment Law (California Health & Safety Code Sections 33000 et seq.), or any other relevant provision of law. Any ordinance approving a redevelopment project which does not comply with this paragraph shall be void and of no effect with regard to the subsequent allocation and distribution of taxes to the Redevelopment Agency.
