The LAFCO requires that the City prezone the territory to be annexed prior to annexation. Prezone No. 92-003(Revised) is a proposal to prezone a 1.23 acre area as a supplement to a previously approved (January 23, 1996) prezone affecting a 425 acre area known as the Seco Canyon annexation. The proposed prezone would change the site from its present designation of Los Angeles County A-2-2 to Santa Clarita's RE (Residential Estate) zone, in conformance with the City's General Plan to allow for annexation of the site to the City: The project site is located on Copper Hill Drive west of Seco Canyon Road in Saugus. The proposed prezoning designations are consistent with the City's General Plan and Unified Development Code (UDC). The Planning Commission conducted a public hearing on June 18, 1996. Because the Planning Commission and City Council hearing dates are only a week apart, the staff will update the Council, orally, at the Council's June 25 meeting. Resolution P96-18 which recommends that the City Council approve the project, and adopt the proposed ordinance approving Prezone No. 92-003 (Revised). This revision to a previous prezoning is due to a minor amount of land, 1.23 acres, was recently added to the Grace Baptist Church property (part of the Seco Canyon annexation site) through a lot line adjustment. The newly added property contains an existing water tank, related underground facilities, and an access road which are all operated by the Valencia Water Co. Accordingly, the LAFCO application will now require an amendment to reflect the minor addition of land area proposed for annexation. RECOMMENDATION (1) Conduct a public hearing; (2) Adopt Resolution No. 96-94; (3) Introduce Ordinance No. 96-23, approving Prezone No. 92-003 (revised), waive further reading, and pass to a second reading; (4) Direct staff to file necessary amendments to the LAFCO application. The City of Santa Clarita City Council hereby finds and determines that in Ordinance No. 96-23 page 2 accordance with the California Environmental Quality Act, this project is categorically exempt under Section 15319 (Annexation of Existing Facilities) and no environmental review is required; and C. Public participation and notification requirements pursuant to Sections 65090, 65351, and 65854 of the Government Code of the State of California were duly followed. SECTION 2. Based upon the testimony and other evidence, if any; received at the public hearing, and upon studies and investigations made by the Planning Commission and the City Council and on their behalf, the City Council further finds and determines that the project is consistent with the General Plan and complies with all other applicable requirements of State law and local ordinance. SECTION 3. In acting on the prezoning application, the City Council has considered certain principles and standards, and finds and determines as follows: A. That a need for the prezone classifications to RE, RL, RS, and CN exists within the project area. B. That the subject property is a proper location for the RE, RL, RS, and CN designations. C. That public necessity, convenience, general welfare and good planning practice justify the prezoning designations of RE, RL, RS, and CN. D. That the :proposed prezoning designations of RE, RL, RS, and CN are consistent with existing land uses in the area and would not result in, a substantive change to the existing zoning of the subject site. E. That the proposed Annexation No. 1992-03 prezoning consists of 425 acres of generally inhabited land located adjacent to, and outside of the existing City limits, north of Copper Hill Drive, and east and west of Seco Canyon Road, as identified in Exhibit A. SECTION 4. Based upon the foregoing, the City Council does hereby ordain that the application for a prezone is approved, and that the Official Zoning Map of the City of Santa Clarita is hereby amended to designate the subject property RE, RL, RS, and CN. SECTION 5. This ordinance shall become effective at 12:01 a.m. on the thirty-first day after adoption, or upon the effective date of the annexation (proposed Annexation No. 1992-03 - Revised) of the subject property to the City of Santa Clarita, whichever occurs last. P96-18 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA CLARITA RECOMMENDING THAT THE CITY COUNCIL APPROVE PREZONE NO. 92-003 (REVISED) WHEREAS, the City Council of the City of Santa Clarita Adopted Ordinance No. 96-7 on January 23, 1996, approving Prezone No. 92-003 pertaining to the Seco Canyon annexation (app. 425 acres); and WHEREAS, a minor amount of land (1.23 acres) was subsequently added to the area proposed for annexation due to a lot line adjustment: and WHEREAS, the City of Santa Clarita has proposed and initiated a subsequent prezoning to accommodate the additional land of certain property located in the Saugus area prior to its annexation to the City of Santa Clarita (proposed Annexation No. 1992-03); and WHEREAS, such zoning would become effective upon annexation, as described in Exhibit A and designated upon the Zoning Map incorporated within and made part of Title 17 of the City's Unified Development Code; and WHEREAS, the City of Santa Clarita Planning Commission set June 18, 1996, at the hour of 7:00 PM in the City Council Chambers; 23920 Valencia Boulevard, Santa Clarita, California, as the time and place for a public hearing before said Planning Commission, and notice of said public hearing was given in the manner required by the Santa Clarita Municipal Code; THEREFORE, be it resolved by the Planning Commission of the City of Santa finds as follows: SECTION 1. The Planning Commission does hereby find and determine that: a. The purpose of the proposal is to prezone the project site from Los Angeles County A-2-2 to City of Santa Clarita RE (Residential Estate) to allow for annexation of the site to the City of Santa Clarita; and b. In accordance with the California Environmental Quality Act, this project is categorically exempt under Section 15319 (Annexation of Existing Facilities) and requires no further environmental review; and C. Public participation and notification requirements pursuant to Sections 65090 and 65351 of the Government Code of the State of California were duly followed. SECTION 2. Based upon the testimony and other evidence, if any, received at the public hearing, and upon studies and investigations made by the Planning Commission and on its behalf, the Commission further finds and determines that this proposal is consistent with the City's General Plan, including the land use designation for the; project site of RE (Residential Estate. SECTION 3. In making the recommendation contained in this resolution, the Planning Commission has considered certain principles and standards, and finds and determines as follows: a. That a need for the prezone to Residential Estate does exist within the area of the subject property; and b, That public necessity, convenience, general welfare and good planning practice justifies the prezone classification of Residential Estate; and C. That the project site consists of 1.23 acres of land contiguous a 425 -acre site previously prezoned and contiguous to the corporate limits of the City of Santa Clarita. SECTION 4 The Planning Commission hereby further recommends to the City Council that it approve the request for a prezone of the project site to City of Santa Clarita RE (Residential Estate). SECTION 5. The City Clerk shall certify the adoption of this Resolution to the Departments of Public Works, Fire, and Parks, Recreation, and Community Services, and shall give notice of this recommendation in the manner prescribed by the City Municipal Code. Topography: The site is a combination of flat and hilly terrain. 4. Physical boundaries, if any (river, freeways, etc.): The project site is bounded by Seco Canyon Road on the south, and by ridge lines on the east, west, and north that form the upper Seco Canyon. B. Population and Housing 1. Estimated Population: 4,469 2. Number of Registered Voters: 2,188 3. Number and type of dwelling units: 976 single family, and 554 multiple family. Total of 1,530. C. Land Use and Zoning 1. What is the present land use in the subject area? The project site is nearly fully developed. Of the 425 acres, most of the land area is presently devoted to the residential area described in section B., above. Only 2 acres are devoted to neighborhood commercial uses. A total of 1,530 residences are located here, as well as two neighborhood shopping centers. The only vacant parcel is a 24 -acre parcel due to be developed as a church. This is likely to occur with, or without annexation. No further development is pending and no other site improvements are anticipated. 6. What effect would denial of this proposal have on the proposed development, if any? Denial of the proposal would require the property owners to remain as residents of the County and not have a voice in City matters that would directly benefit them if their properties were located within the city limits and they could benefit from the services offered by the City of Santa Clarita. What are the reasons for initiation of this proposal? The proposal was initiated at the request of the individual property owners. Over 600 of the property owners in the annexation area signed a petition to bring their property under the City's jurisdiction. The property owners cite the quality of services provided by the City as reasons for annexation. The City supports this annexation proposal to promote sound planning and achieve orderly growth and provide a logical extension of the City's physical boundaries and urban service area. B. What are the alternate courses of action, if any? (Include the names of other local agencies having the authority to provide the same or similar services as those proposed.) None. Denial of this request would result in no change of circumstance or jurisdiction; the reasons for annexation set forth above would remain the same. C. Plan for Providing Services Describe the services to be extended to the subject area, the range and level of those services, when the services can be extended to the area, and how the services will be financed, including any improvement or upgrading of structures, roads, sewer or water facilities or other conditions which would be imposed or required by the local agency within the subject area if this proposal is completed: All services now provided by the County of Los Angeles would be provided as follows: 1) Directly by the City of Santa Clarita through assessments, property tax valuation, or similar user fees; 2) By the County under service contract with the City; 3) By the County through assessments, property tax valuation, or similar user fees; and 4) By independent and/or public utility providers and private service purveyors currently doing business in the Santa Clarita Valley.
