BACKGROUND
The City of San Juan Capistrano has circulated a letter to all California cities seeking support
in opposition to the Mobilehome Fairness and Rental Assistance Act initiative ballot measure
which is due to appear on the ballot as Proposition 199, on the March 26, 1996 state primary
election. A letter of explanation from the mayor of San Juan Capistrano is attached.
RECOMMENDATION
Review and discuss. If the Council wishes to support the City of San Juan Capistrano in this
matter, adopt Resolution No. 96-25.

RESOLUTION NO. 96-25
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA,
OPPOSING STATE INITIATIVE BALLOT MEASURE (PROPOSITION 199)
MOBILEHOME FAIRNESS AND RENTAL ASSISTANCE ACT
WHEREAS, a state initiative ballot measure titled "The Mobilehome Fairness and Rental
Assistance Act" (hereafter "Proposition 199"), has been certified for the March 26, 1996, election
ballot and, if it becomes law, would preempt all local ordinances regulating rents on any
mobilehome park space; and,
WHEREAS, Proposition 199 would detrimentally impact the ability of alocal jurisdiction
to regulate local rent stabilization issues; and;
WHEREAS, this Council has opposed and continues to oppose any legislation which seeks
to restrict the City's ability to regulate mobilehome rent stabilization matters.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Santa
Clarita, California, does hereby determine and find as follows:
SECTION 1. The City Council does hereby oppose the passage of Proposition 199).
SECTION 2. The City Clerk shall certify to the adoption of this resolution and certify
this record to be a full, true, correct copy of the action taken.

he City of San Capistrano opposes "The Mobilehome Fairness and Rental

Act" Initiative Ballot Measure!
In April 1994, the San Juar, Capistrano City Council adopted a resolution opposing
any legislation. that limits a local agency's ability to regulate mobilehome rent
stabilization matters. Since that time, an initiative measure entitled "The
Mobilehor•.e Fairness and Rental Assistance Act" has qualified for the March 26,
1996, ballot. If adopted, this measure would preempt all local regulation of
mobilehome space rents and detrimentally impact the ability of a local jurisdiction
to regulate local rent stabilization issues.
Accordingly, because of our grave concern over the harmful effects of "The
Mobilehome Fairness and Rental Assistance Act" initiative on our residents, the San
Juan Capistrano City Council adopted Resolution No. 95-12-5-3 (copy enclosed)
opposing the above referenced initiative. We urge you to join with us in opposing
this ballot measure. Thank you for your consideration.
