HomeMy WebLinkAbout1996-04-16 - AGENDA REPORTS - NOISE RESID AREAS (2)AGENDA REPORT City Manager Approv Item to be presented by: Jan Bear NEW BUSINESS DATE: April 16,1996 SUBJECT: AMENDMENTS TO SECTION 11.44.080 OF THE SANTA CLARITA MUNICIPAL CODE CONCERNING PERMITTED HOURS OF CONSTRUCTION WORK AS IT RELATES TO CONTROLLING NOISE IN RESIDENTIAL AREAS ORDINANCE NO. 96-16 ORDINANCE NO. 96-18 DEPARTMENT: Building and Engineering Services Attached is a proposed amendment to Section 11.44.080 of the Santa Clarita Municipal Code regarding noise restrictions for construction projects on or adjacent to residential properties. Mayor Carl Boyer requested that the City Council review and discuss an amendment to the current ordinance as proposed by a private resident of Placerita Canyon living near the Melody Ranch Studios. The intent of the proposal is to place noise limitations on all construction and to regulate noise generated by the construction of movie sets, which are exempt from our current regulations on construction since they are exempt from building permit requirements. The proposal is substantially identical to the provisions of 11.44.080 which were enacted as part of Ordinance 89-29 in 1990. At the time the regulation applied to all outside construction, including the construction of exterior movie sets at Melody Ranch and minor projects at homes, such as reroofing or constructing playhouses, dog houses, or tree houses. It also placed noise limits of 35 decibels on the noise conveyed to an adjoining property line by the construction activities or equipment, regardless of time of day. Some of these provisions proved to be difficult or impossible to enforce because the regulations did not control the hours of construction for interior work. Further, it was difficult to obtain a sound reading that could be used to enforce the regulations. Staff and the Council consequently received many complaints regarding construction noise. In 1993 the City Council amended Section 11.44.080 to make the provisions more enforceable. Ordinance 93-4 focused the regulation of construction work on that work which required a building permit. Since enactment, the current regulations have worked well throughout Agenda Remit- AMENDMENTS TO SECTION 11.44.080 OF THE SANTA CLARITA MUNICIPAL CODE ORDINANCE NO. 96-16 ORDINANCE NO. 96-18 April 16, 1996 - Page 2 the City with the exception of the complaints from neighbors of the Melody Ranch Studios, who have filed formal complaints regarding noise emanating from the studio associated with the construction or alteration of movie sets. Staff has prepared two ordinances for your review. The first is Ordinance 96-16, which presents the submittal prepared by the Placerita Canyon residents near Melody Ranch. The second is Ordinance 96-18, which was developed by staff to address the same issue raised by the Placerita Canyon residents but which staff feels would be easier to enforce. There will be implications on other events or properties from either ordinance. Both ordinances regulate the noise emitted during set construction by limiting when construction may occur. They will therefore impact events, such as the City's "Concert in the Park" series, which require the construcion and removal of temporary stages on Sundays in parks near residential properties. RECOMMENDATION The City Council review Ordinance No. 96-16 and Ordinance 96-18 and provide direction to staff regarding the issue of the control of noise from the Melody Ranch Studio. The Santa Clarita Municipal Code is hereby amended at Section 11.44.080 to read as follows: "11.44.080 Same -- Construction and Building. It shall be unlawful for any person within the City to operate power construction tools or equipment in the performance of any outside construction or repair work on buildings, structures, or projects in or adjacent to a residential area, except between the hours of 7:00 a.m. and 7:00 p.m.. Monday through Friday, 8:00 a.m.. and 6:00 p.m. on Saturday, and prohibited on Sunday and the following public holidays: New Year's Day, Independence Day, Thanksgiving Day, Christmas Day, Memorial Day, and Labor Day; provided, however, that such construction, tools, or equipment shall not reach a dB level of more than thirty-five (35) dB for twenty-five (25) percent of an hour at any receiving property line." SECTION 2. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this day of 19_. The Santa Clarita Municipal Code is hereby amended at Section 11.44.080 to read as follows: "11.44.080 Same -- Construction and Buildin No person shall engage in any construction on private property when the construction is located within 300 feet of an adjacent residentially zoned property except between the hours of 7:00 a.m.. to 7:00 p.m. Monday through Friday and 8:00 a.m. to 6:00 p.m. on Saturday. Further, no work shall be: performed on the following public holidays: New Year's .Day, Independence Day, Thanksgiving Day, Christmas Day, Memorial Day, and Labor Day. Exemption: 1. Minor home repairs, construction of minor projects such as play houses, dog houses, etc., and similar minor home projects which are exempt from building permit requirements. 2. Emergency work as defined in Section 11.44.020D is permitted at all times. The Building & Engineering Services Department may issue a permit for work to be done "after hours" provided that containment of construction noises is provided. SECTION 2. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published as required by law.
