City of Santa Clarita ordered the trial court to direct the City of Santa Clarita and the Santa Clarita Redevelopment Agency to vacate the Notice of Exemption finding that the adoption of the Santa Clarita Community Recovery Plan and all related documents were exempt as a project from the California Environmental Quality Act. The order has been issued by the trial court. Adopt Resolution No.96-86 agnrpt.cega.new Adopted: 4 Agenda Item: RESOLUTION NO. 96-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA VACATING ITS NOTICE OF EXEMPTION FINDING THAT THE ADOPTION OF THE SANTA CLARITA COMMUNITY RECOVERY PLAN AND ALL RELATED DOCUMENTS WERE EXEMPT AS A PROJECT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT THE CITY OF SANTA CLARITA HEREBY DOES RESOLVE AS FOLLOWS: SECTION 1. The City of Santa Clarita does hereby find, determine and declare that the Courtof Appeal of the State of California, Second Appellate District, Division Seven, issued an opinion in Castaic Lake Water Agency v. City of Santa Clarita ordering the trial court to grant a peremptory writ of mandate ordering the City of Santa Clarita and the Santa Clarita Redevelopment Agency to vacate the Notice of Exemption finding that the adoption of the Santa Clarita Community Recovery Plan and all related documents were exempt as a project from the California Environmental Quality Act. SECTION 2. That the City Council hereby vacates the Notice of Exemption finding that the adoption of the Santa Clarita Community Recovery Plan and all related documents were exempt as a project from the California Environmental Quality Act and rescinds Resolution No. 94-23 adopted on February 22, 1994 that had accepted said Notice of Exemption and ordered it filed. SECTION 3. That the City Clerk shall certify the adoption hereof, and forward a certified copy hereof, to the City Manager. PASSED, APPROVED AND ADOPTED this day of 71996.
