ANNUAL TERM EXTENSION OF AGREEMENTS

BACKGROUND
At the March 26, 1996 City Council meeting, staff was directed to draft a policy that would require
a public hearing to be held annually prior to the approval of the automatic annual term extension of
the City's refuse franchise agreements. This will provide the City Council, residents and businesses
with an opportunity to publicly express their level of satisfaction with the service performance of the
franchised haulers. It will also occur prior to the activation of an automatic one-year extension to the
term of existing residential and commercial franchise agreements.
The public hearing for the automatic annual term extension can be scheduled to concur with the
public hearing for the Annual Review of Performance and Quality of Service, which is called for in
the franchise agreements.
RECOMMENDATION
Adopt Resolution 96-43 requiring that a public hearing be conducted prior to the activation of the
annual term extension of the refuse franchise agreements,

A RESOLUTION OF THE CITY OF SANTA CLARITA, CALIFORNIA
REQUIRING THAT AN ANNUAL PUBLIC HEARING BEHELD PRIOR TO
THE APPROVAL OF THE AUTOMATIC ANNUAL TERM EXTENSION OF
THE REFUSE FRANCHISE AGREEMENTS
WHEREAS, the City of Santa Clarita has adopted Resolution No. 91-27 relating to the granting of
an exclusive franchise for the collection, recycling and disposal of solid wastes, green wastes and
recyclables within the City limits, and
WHEREAS, the City Council has entered into an agreement with Santa Clarita Disposal Company,
Blue Barrel Disposal Company, and Atlas Refuse Removal Company to collect, pick up, remove,
recycle and dispose of solid wastes, green wastes and recyclables from all single family residences and
all multi -family residences in the City of Santa Clarita, and
WHEREAS, the residential agreements provide for the franchise term to be automatically extended
for twelve months on April 15 of each year, and
WHEREAS, the commercial agreements provide for the franchise term to be automatically extended
for three years beginning on August 1, 2000 and for twelve months each August l thereafter, and
WHEREAS, the City Council has determined that residents and businesses will have an opportunity
to publicly express their level of satisfaction with the franchisees service performance prior to the
automatic term extension through the process of a public hearing, and
WHEREAS, the automatic extension of the term of agreements can not be legally terminated without
providing the franchisees with written notice thirty (30) days prior to the anniversary date of the
respective agreements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA does resolve
as follows:
SECTION 1 That a public hearing will be held at least forty-five (45) days prior to the
activation date of any annual term extension of the existing refuse franchise agreements.
SECTION 2: The City Clerk shall certify the adoption of this resolution.
