REFUSE FRANCHISES TO INCLUDE REVISED COMMERCIAL REFUSE
RATE BAND AND RECYCLING RATE SCHEDULE

BACKGROUND
At the July 9, 1996 meeting, after a public hearing, the City Council adopted Resolution 96-100
revising the Commercial Refuse Rate Band and Recycling Rate Schedule. This item brings the actual
language of the commercial franchise amendments for council approval. The amendments for each
agreement, incorporating the revised rate band and recycling rate schedule, and language suspending
further commercial rate band adjustments for a fifteen month period, are attached.
RECOMMENDATIONS
Execute the franchise agreement amendments with Atlas Refuse Removal, Blue Barrel Disposal, and
Santa Clarita Disposal Companies to include the Commercial Rate Band and Recycling Rate Schedule
as revised by Resolution 96-100 and to suspend further adjustments for a period of fifteen (15)
months beginning October 1, 1996.

RESOLUTION NO. 96-100
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA
AMENDING THE SERVICE RATE BAND SCHEDULE FOR THE COLLECTION,
TRANSPORTATION, RECYCLING, COMPOSTING AND DISPOSAL
OF COMMERCIAL SOLID WASTE
WHEREAS, the City of Santa Clarita has adopted Resolution No. 93-83 relating to the granting of
modified exclusive commercial solid waste permits for the collection, transportation, recycling,
composting and disposal of solid waste within the city limits, and
WHEREAS, the City Council has entered into an agreement with Santa Clarita Disposal Company,
Blue Barrel Disposal Company, and Atlas Refuse Removal Company to collect, transport, recycle,
compost and dispose of solid waste, compostable materials and recyclables from all commercial
businesses in the City of Santa Clarita, and
WHEREAS, Section 10 of the City's commercial refuse and recycling franchise agreement provides
for periodic adjustment of rates due to changes in the Producer Price Index and landfill tipping fees,
and
WHEREAS, the City's franchised commercial haulers primarily utilize the Chiquita Landfill and such
action has imposed a direct impact upon the franchisees' operational costs related to all commercial
accounts within the City, and
WHEREAS, Resolution No. 96-100, hereinafter superseding Resolution No. 93-105, authorized to
impose fees and to establish a service rate band necessary for the collection, transportation, recycling,
composting and disposal of commercial solid waste to all Santa Clarita commercial accounts.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA does resolve
as follows:
SECTION 1: The attached Exhibit A (Adjusted Refuse Rate Band) is the service level rate band
schedule for the collection, transportation, recycling, composting and disposal of commercial solid
waste. The attached Exhibit B is the commercial recycling bin rate schedule.
SECTION 2: This action is subject to the preparation and approval of consistent contract
amendments to the three franchise agreements.
SECTION 3: The effective date of this Resolution is September 1, 1996.

AMENDMENT TO AGREEMENT BETWEEN
THE CITY OF SANTA CLARITA AND
BLUE BARREL DISPOSAL
FOR INTEGRATED WASTE
MANAGEMENT: FOR COMMERCIAL SOLID WASTE
This amendment ("Amendment") entered into this _ day of September, 1996, is to the franchise
agreement for the collection, transportation, recycling, composting and disposal of solid waste, green
wastes and Tecyclables ("Franchise Agreement") entered into between the City of Santa Clarita
("City") and Blue Barrel Disposal ("Grantee") which was executed by the parties on July 23, 1993.
The Franchise Agreement is therefore amended as follows:°
Section 10A RATES AND BILLING of the Franchise Agreement shall be deleted and replaced
with the following language.
A. Rates
1. Commercial Solid Waste Collection Rate
Hauler shall charge a fee to its commercial solid waste customers as set forth in
Exhibit A-96 (Adjusted Commercial Refuse Rate Band) for each bin based on the size
and frequency of service.
2. Recyclable Collection Rate
Hauler shall charge a recyclable collection fee for all commercial solid waste accounts
in all service levels as set forth in Exhibit B-96 (Adjusted Commercial Recycling Rate
Schedule)
Section 10B,C and D RATES AND BILLING of the Franchise Agreement shall be suspended
until January 1998,
Exhibit A (Proposed Commercial Refuse Rate Band) and Exhibit B (Proposed Maximum
Commercial Recycling Rate sl of the Franchise Agreement will be replaced with Exhibit A-96
(Commercial Refuse Rate Band) and Exhibit B-96 (Maximum Commercial Recycling Rates). The
amended exhibits are attached.
