IMPLEMENTATION OF RESIDENTIAL YARD TRIMMINGS RECYCLING
PROGRAM AND ADJUSTMENT OF RESIDENTIAL REFUSE RATE
RESOLUTION 96-113
Public Works
Following a public hearing at the August 27, 1996 meeting, City Council deferred the adoption of
Resolution 96-113 and directed staff to return the item with additional information related to yard
trimmings recycling exemptions. A written supplement outlining the criteria and procedures for
program exemptions will be distributed at tonight's meeting. Staff is also prepared to address other
issues identified by the Council.
At the July 9, 1996 meeting, City Council directed staff to implement a residential yard trimmings
recycling program not to exceed $1.50 per month per household. Council directed staff to amend
sections 5B and C of the franchise agreements to specify new container services for this new recycling
service. Council also directed staff to conduct an extensive public education campaign and to
implement the program by October 1, 1996.
Staff has initiated a public education and awareness campaign to inform residents of the upcoming yard
trimmings program. Staff is currently accomplishing this campaign through media advertising on the
local cable television, radio and newspapers.. Staff also sent letters highlighting the yard trimmings
program to homeowners' associations, community organizations, chambers of commerce, and
landscaper businesses. Staff has also formulated a speakers' bureau to make presentations to these
organizations at their convenience.
The haulers have confirmed that they will provide yard trimmings service to single family residents at
a charge of $1,50 per month. This rate is based on participation by all single family residents. The new
single family refuse, recycling, and yard trimmings collection rate for standard service is $21.72 a
month. As noted in Resolution 96-103, the rate will remain unchanged for 15 months beginning
October 1, 1996, Sections 21B and C of the residential franchise agreements are suspended to reflect
City Council direction.

For the City Council's consideration, staff is, preparing amendments to the City's Integrated Waste
Management Code that will prohibit the placement of yard trimmings in regular refuse containers and
will allow for program exemptions at the discretion of the Public Works Director. A first reading of
the ordinance with amended language will be presented at the September 10, 1996 meeting of the City
Council.
An initial study and negative declaration for the yard trimmings program pursuant to AB 939 was
prepared, noticed and circulated for public review in compliance with CEQA and the City's
Environmental Guidelines.
RECOMMENDATIONS
1) Adopt Resolution 96-113 which institutes a weekly, residential yard trimmings recycling program
and adjusts the residential rate schedule by $1.50 for standard weekly service.
2) Execute the franchise agreement amendments with Atlas Refuse Removal, Blue Barrel Disposal, and
Santa Clarita Disposal Companies to reflect the yard trimmings recycling program requirements and
suspension of rate adjustments for a period of 15 months beginning on October 1, 1996..
3) Direct staff to prepare amendments to the City's Integrated Waste Management Code which will
prohibit placement of yard trimmings in unauthorized containers and will allow for program exemptions
at the discretion of the Public Works Director.

This amendment ("Amendment") entered into this _ day of September, 1996, is to the franchise
agreement for the collection, transportation, recycling, composting and disposal of solid waste, yard
trimmings/green wastes and recyclables ("Franchise Agreement") entered into between the City of
Santa Clarita ("City') and Atlas Refuse Removal ("Grantee") which was executed by the parties on
February 20, 1991.
The Franchise Agreement is therefore amended as follows:
SECTION 5B and C - SERVICES PROVIDED BY GRANTEE of the Franchise Agreement shall
be amended as follows (new language is italicized, deleted language is stricken).
B. Container Services
Grantee shall provide each Single Family Residence up to (4) four 90 -gallon semi -
automated carts for the collection of refuse at a designated rate listed on Exhibit --D
Exhibit A-97.
Grantee shall provide (1) one 34 -gallon recycling cart, with wheels, for each Single
Family Residence, to be used exclusively for recyclable materials, and
Grantee shall provide one 64 -gallon, yard trimmingslgreen waste recycling cart,
with wheels, for each single-family residence, to be used exclusively for yard
trimmings material for either a semi -automated or fully -automated collection system.
Upon customer request, Grantee shall provide additional recycling containers or
"recycling" identification stickers for containers provided by the householder(s) for
additional recyclables.
C. Single Family Residences
1) Weekly Service
Once each week Grantee shall collect from Single -Family Residences solid
waste and yard trimmings/green waste (except bulky wastes and special
wastes) which have been placed, kept or accumulated in approved containers,
of bags or bundles, at curbside prior to Grantee's normal weekly collection
time. Recyclables placed in containers designated for recyclables shall be
collected on the first and third or second and fourth pickup days of each
month depending on the route schedule. Recycling programs shall be
operated in accordance with requirements outlined in EXHIBIT C-97.

Section 2 1 A Grantee Rates of the Franchise Agreement shall be amended as follows (new language

A. Grantee Rates
Grantee shall provide the services described in this Franchise Agreement in accordance with
the rates fixed by the City from time to time , all as described below and set forth in the
"Schedule of Rates", which is attached asExhibitD-FxhibitA-97.
1) Single Family Residential
Grantee shall charge the monthly fees set forth in Eiddbit-D Exhibit A-97 for each
household.
2) Multi -Family Residential
Grantee shall charge the monthly fee set forth in Eadtibit-D- Exhibit A-97 for each bin
based on the size of the bin and frequency of service.
Section 21A(3) Landfill Fees, 21B. Annual Modification and Adjustment of Rates, and
21C. Extraordinary Costs of the Franchise Agreement shall be suspended for a period of 15 months
beginning on October 1, 1996.
As of October 1, 1996 the 1996 SCHEDULE OF RATES of the Franchise Agreement Will be
deleted and replaced with EXHIBIT A-97 SCHEDULE OF RATES. The amended exhibit is
attached.
EXHIBIT C- RECYCLING PROGRAM of the Franchise Agreement will be deleted and replaced
with EXHIBIT C-97 RECYCLING PROGRAMS. The amended exhibit is attached.

RECYCLING PROGRAMS
A. Grantee will cause at least twenty-five percent (25%) of the waste stream to be
collected under this Franchise Agreement to be diverted from ultimate deposit in landfills or
transformation facilities by January 1, 1995, in accordance with the regulations implementing the
California Integrated Waste Management Act of 1989 (as amended) (also known as AB 939). In the
event this Agreement remains in effect, grantee will cause at least fifty percent (50%) of the waste
stream to be collected under this Franchise Agreement to be diverted from deposit in landfills or
transformation facilities by January 1, 2000.
B. Grantee shall upon execution of this agreement institute -continue the commingled
curbside recycling collection program
1991 and institute a weekly, yard trimmings/green waste collection program for City households
within the franchise area by October 1, 1996.
The Grantee shall furnish the curbside recycling services to the franchise area described in
Exhibit A at no cost to the City or to the program participant during the term of the program.
The Grantee shall purchase sufficient numbers of containers at its sole cost and distribute one
(1) curbside recycling container and one (1) yard trimmings/green waste container to each applicable
household. Each curbside recycling container shall be a minimum of 34 gallons in size, have a cover,
be provided with wheels, color, bright green, as approved by the City. Each yard trimmings/green
waste recycling container shall be a minimum of 64 gallons in size, have a cover, be provided with
wheels, color, charcoal -gray, as approved by the City. No initial deposit will be charged to
customers for the yard trimmings/green waste recycling container. Containers must be compatible
with a fully, or semi -automated collection system.
Households requesting additional containersfor curbside recycling will be provided by the
Grantee in accordance with the rate provided in Exhibit A-97. Grantee shall also collect all
recyclables deposited in any approved container identified by an approved City of Santa Clarita
recycling sticker. Stickers shall be provided at Grantee's expense. Households requesting
additional containers for yard trimmings1green waste recycling will be charged a fee in accordance
with Exhibit A-97.
From time to time a household may damage or destroy the recycling, or yard trimmings/green
waste container supplied by the Grantee. Grantee shall replace the recycling container at the expense
of the household. The Grantee shall make the replacement recycling containers available to any
program participant at the fee, plus delivery as set forth in Exhibit A-97.

All recyclable materials collected through the program must be transported to a properly permitted
diversion facility, yard trimmings/green waste collected through the program must be delivered to
a properly permitted compost or mulching facility or material end-user. Recyclables or yard
trimmings/green waste materials that have been collected for the express purpose of diversion will
not be taken to a landfill, unless the landfill possesses other diversion facilities on site. The
transport and disposal of recyclable materials and/or yard trimmings/green waste in unauthorized
facility, i.e., landfill, will constitute a material breach of agreement.
C. Exemption from the yard trimmings recycling program is subject to the rules outlined
in the City of Santa Clarita Integrated Waste Mangement Code.
D. Grantee will provide City with written reports in a form adequate to meet City's
reporting requirements to the California Integrated Waste Management Board, and to the County of
Los Angeles throughout the term of this Franchise Agreement wherein its performance under this
program is set forth in detail.

Section 21A Grantee Rates of the Franchise Agreement shall be amended as follows (new language
is italicized; deleted language is stricken).
A. Grantee Rates
Grantee shall provide the services described in this Franchise Agreement in accordance with
the rates fixed by the City from time to time , all, as described below and set forth in the
"Schedule of Rates", which is attached as-Exhibit-B-ExhibitA-97,
1) Single Family Residential
Grantee shall charge the monthly fees set forth in Exd6it-D Exhibit A-97 for each
household.
2) Multi -Family Residential
Grantee shall charge the monthly fee set forth in Exhibit 13- Exhibit A-97 for each bin
based on the size of the bin and frequency of service.
Section 21A(3) Landfill Fees, 2113. Annual Modification and Adjustment of Rates, and
21C. Extraordinary Costs of the Franchise Agreement shall be suspended for a period of 15 months
beginning on October 1, 1996.
As of October 1, 1996 the 1996 SCHEDULE OF RATES of the Franchise Agreement will be
deleted and replaced with EXHIBIT A-97 SCHEDULE OF RATES. The amended exhibit is
attached.
EXHIBIT C- RECYCLING PROGRAM of the Franchise Agreement will be deleted and replaced
with EXHIBIT C-97 RECYCLING PROGRAMS. The amended exhibit is attached.

RECYCLING PROGRAMS
A. Grantee will cause at least twenty-five percent (25%) of the waste stream to be
collected under this Franchise Agreement to be diverted from ultimate deposit in landfills or
transformation facilities by January 1, 1995, in accordance with the regulations implementing the
California Integrated Waste Management Act of 1989 (as amended) (also known as AB 939). In the
event this Agreement remains in effect, grantee will cause at least fifty percent (50%) of the waste
stream to be collected under this Franchise Agreement to be diverted from deposit in landfills or
transformation facilities by January 1, 2000.
B: Grantee shall upon execution of this agreement institute -continue the commingled

199+ and institute a weekly, yard trimmings/green waste collection program for City households
within the franchise area by October 1, 1996
The Grantee shall furnish the curbside recycling services to the franchise area described in
Exhibit A at no cost to the City or to the program participant during the term of the program.
The Grantee shall purchase sufficient numbers of containers at its sole cost and distribute one
(1) curbside recycling container and one (1) yard trimmings/green waste container to each applicable
household. Each curbside recycling container shall be a minimum of 34 gallons in size, have a cover,
be provided with wheels, color, bright green, as approved by the City. Each yard trimmings/green
waste recycling container shall be a minimum of 64 gallons in size, have a cover, be provided with
wheels, color, charcoal -gray, as approved by the City. No initial deposit will be charged to
customers for the yard trimmings/green waste recycling container. Containers must be compatible
with a fully, or semi -automated collection system.
Households requesting additional containers for curbside recycling will be provided by the
Grantee in accordance with the rate provided in Exhibit A-97. Grantee shall also collect all
recyclables deposited in any approved container identified by an approved City of Santa Clarita
recycling sticker. Stickers shall be provided at Grantee's expense. Households requesting
additional containers for yard trimmings/green waste recycling will be charged a fee in accordance
with Exhibit A-97.
From time to time a household may damage or destroy the recycling, or yard trimmingslgreen
waste container supplied by the Grantee. Grantee shall replace the recycling container at the expense
of the household. The Grantee shall make the replacement recycling containers available to any
program participant at the fee, plus delivery as set forth in Exhibit A-97.

All recyclable materials collected through the program must be transported to a properly permitted
diversion facility, yard trimmings/green waste collected through the program must be delivered to
a properly permitted compost or mulching facility or material end-user. Recyclables or yard
trimmingsvgreen waste materials that have been collected for the express purpose of diversion will
not be taken to a landfill, unless the landfill possesses other diversion facilities on site. The
transport and disposal of recyclable materials and/or yard trimmings/green waste in unauthorized
facility, i.e., landfill, will constitute a material breach of agreement.
C: Exemption from the yard trimmings recycling program is subject to the rules outlined
in the City of Santa Clarita Integrated Waste Mangement Code.
D, Grantee will provide City with written reports in a form adequate to meet City's
reporting requirements to the California Integrated Waste Management Board, and to the County of
Los Angeles throughout the term of this Franchise Agreement wherein its performance under this
program is set forth in detail,

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA,
AMENDING THE AGREEMENT BETWEEN THE CITY OF SANTA CLARITA AND
ATLAS REFUSE AND REMOVAL CO., BLUE BARREL DISPOSAL, AND SANTA
CLARITA DISPOSAL CO. FOR INTEGRATED WASTE MANAGEMENT FOR
RESIDENTIAL AREAS
WHEREAS, the City of Santa Clarita has adopted Resolution No. 91-27 relating to the granting of
exclusive franchises for the collection, recycling and disposal of solid wastes, green wastes and
recyclables within the city limits; and
WHEREAS, the City Council has entered into an agreement: with Santa Clarita Disposal Company,
Blue Barrel Disposal Company, and Atlas Refuse Removal Company to collect, pick up, remove,
recycle and dispose of solid wastes, green wastes and recyclables from all single family residences,
multi -family residences in the City of Santa Clarita; and
WHEREAS, the City of Santa Clarita is required by the California Integrated Waste Management Act
of 1989 to reduce waste being sent to local landfills by fifty (50) percent by the year 2000; and
WHEREAS, the City of Santa Clarita is committed to reducing dependence on urban landfills and
opposed to the development of the proposed Elsmere Canyon Landfill; and
WHEREAS, the City Council has determined that the implementation of a weekly; residential yard
trimmings recycling program is necessary to comply with the California Integrated Waste Management
Act of 1989; and
WHEREAS, the City Council; has determined that; the projected monthly cost of implementing a
residential yard trimmings recycling program is $3.77 per household; and
WHEREAS, there has been a suspension of a one (1) percent County landfill tax assessment amounting
to thirteen cents (.13) cents per household, and an anticipated monthly savings in landfill tipping fees
amounting to approximately one dollar and thirty-six cents ($1.36) per household beginning October
1, 1996 and continuing through 1997, and
WHEREAS, the reduced landfill tax and anticipated tipping fee and processing fee reductions have
offset the the total cost of the yard trimmings program, the resident's monthly share of program costs
will be one dollar and fifty cents ($1.50) per household with the remaining program cost being borne
by the franchisees, and
WHEREAS, an initial study and negative declaration for the implementation of the yard trimmings
program pursuant to the California Integrated Waste Management Act was prepared, noticed and
circulated for public review in compliance with the revisions of CEQA and the City's Environmental
guidelines; and
WHEREAS, Resolution No. 96-113, hereinafter superseding Resolution No. 95-141, authorizing fees
necessary for collection services of solid wastes, yard trimmings and recyclables to all Santa Clarita
residents;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA does resolve
as follows:
SECTION 1: The City Council has reviewed and considered the initial study and negative declaration
for the residential yard trimmings recycling program and adopts the negative declaration prepared in
compliance with the provisions of the California Environmental Quality Act (CEQA) and the City's
environmental guidelines.
SECTION 2: Recycling services to single family residents are expanded to include yard trimmings
recycling. The attached amendment of the Franchise Agreement between the City of Santa Clarita and
Atlas Refuse Removal Company, Blue Barrel Disposal, and Santa Clarita Disposal Company reflecting
this service is adopted in accordance with this paragraph.
SECTION 3: Single family residential refuse and recycling rates will increase by $1.50 to provide for
a yard trimmings recycling program beginning on October 1, 1996. The multifamily rate structure will
remain unchanged. Refuse and recycling rates for the single family and multifamily residents will
remain in effect for a period of 15 months beginning on October 1, 1996.
The attached amendment of the Franchise Agreement between the City of Santa Clarita and Atlas
Refuse Removal Company, Blue Barrel Disposal, and Santa Clarita Disposal Company. adjusting the
rates suspending the rate adjustment provisions in those agreements until January 1998 are prepared
in accordance with this paragraph.
SECTION 3: The City Clerk shall certify to the adoption of this resolution.
