Newman CONSENT CALENDAR DATE: June 11, 1996 SUBJECT: FY 1995-96 ANNUAL SLURRY SEAL PROGRAM - PROJECT NO. 95-040 AWARD PROJECT DEPARTMENT: Building and Engineering Services On April 23, 1996, Council authorized advertisement of the subject project. This project involves the surface preparation and application of emulsion slurry seal to seal surface cracks, stop raveling, improve skid resistance and increase the useful pavement life of our roadways. On May 14, 1996, four bids were received by the City Clerk. The following is a summary of these bids: Company Location Bid Amount 1. Asphalt Maintenance Visalia $289,886.40 2. Roy Allan Slurry Seal Santa Fe Springs $311,733.82 3. California Pavement Maintenance Sacramento $357,629.77 4. Pavement Coatings Company Cypress $367,735.55 The apparent low bidder made a mistake in his bid and has submitted a corrected bid. An attorney representing Roy Allan Slurry Seal called and challenged the authority of the City to allow the apparent low bidder to correct its bid. The specifications provide that any discrepancies in figures be resolved in favor of the unit bid amount. Case authority holds that a procedure established in the specifications must be followed by the public agency in awarding the bid. This would apparently require that we hold the apparent low bidder to its unit bid amount which would be $262,360.16. The apparent low bidder however, could file an action under provisions of the contract code to be relieved of his bid based upon his mistake. Alternatives available to the City are as follows: 1. Reject all bids and re -advertise the project. 2. Hold Asphalt Maintenance to his bid amount of $262,360.16 and risk litigation. 3, Relieve Asphalt Maintenance from mistaken bid and award bid to Roy Allan Slurry Seal, the second lowest bidder. 4. Consent to the corrected bid of $289,360.16 and risk litigation by Roy Allan Slurry Seal and/or others. Based upon the four alternatives, staff recommends to reject all bids and re -advertise the project, which will result in an earlier completion of the project than either of the litigation alternatives. The City Attorney concurs with this recommendation.
