SUBJECT: AMENDMENTS TO SECTION 11.44.080 OF THE SANTA CLARITA
MUNICIPAL CODE CONCERNING PERMITTED HOURS OF
CONSTRUCTION WORK AS IT RELATES TO CONTROLLING NOISE IN
RESIDENTIAL AREAS

BACKGROUND
This item was previously considered by the City Council on April 16, 1996. At that time the
Council heard testimony and continued discussion on the item to allow more research by
interested community members. The matter relates to Section 11.44.080 of the Santa Clarita
Municipal Code regarding special noise sources from' construction and building on or adjacent
to residential properties.
Section 11.44.080 was enacted as part of Ordinance 89-29 in 1990. The regulations restricted
the use of power construction tools used for outside construction or repair of buildings to certain
permitted hours of operation. The wording of the regulations did not allow enforcement of
construction with non -power tools or noise created from constructionwithin a building.
In 1993 the City Council amended Section 11,44.080 to expand the provisions and make them
easier to enforce. Ordinance 93-4 expanded the restriction to regulate all construction work
which would require a building permit to be obtained, interior or exterior, with or without power
tools, and restricted the hours that work would be allowed on Saturdays. It also identified the
specific holiday for which work is prohibited and prohibited work on Sundays.
By relating construction noise to building permits, staff has been able to mitigate noise during
the normal inspection process which has allowed proactive action by Building and Safety as well
as effective complaint mitigation by Code Enforcement. Since enactment, the current
regulations have worked well throughout the City to control noise from construction projects
with the exception of the complaints from neighbors of the Melody Ranch Studios, who have filed
formal complaints regarding noise emanating from the studio associated with the construction
or alteration of movie sets.

The construction at Melody Ranch is at issue since the City's building code exempts the
construction of movie sets from requiring building permits. Therefore, the work is currently
exempt from the provisions of Section 11.44.080.
Since the complaints regarding the noise at the studio have been received, staff has attempted
to work with both the residents of Placerita Canyon and the Studio to remedy the matter. Staff
has been involved in mediation efforts between the Studio and the neighboring residents since
last October. However, that process has currently been terminated due to lack of progress.
Previously, staff had provided the City Council with draft ordinances for review. However, they
are not included with this report. Staff will submit them on May 14, 1996 if directed by the City
Council so that you may have references during the testimony.
RECOMMENDATION
The City Council provide direction to staff as to inclusion of proposed ordinances and continue
discussion until the May 14, 1996 meeting.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA CLARITA, CALIFORNIA,
AMENDING THE SANTA CLARITA MUNICIPAL CODE
AT SECTION 11.44.080 RELATING TO
PERMITTED HOURS OF CONSTRUCTION WORK
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. The Santa Clarita Municipal Code is hereby amended at Section 11.44.080 to read
as follows:
"11.44.080 Same -- Construction and Building.
It shall be unlawful for any person within the City to operate power construction tools
or equipment in the performance of any outside construction or repair work on buildings,
structures, or projects in or adjacent to a residential area, except between the hours of
7:00 a.m, and 7:00 p.m. Monday through Friday, 8:00 a.m. and 6:00 p.m. on Saturday,
and prohibited on Sunday and the following public holidays: New Year's Day,
Independence Day, Thanksgiving Day, Christmas Day, Memorial Day, and Labor Day;
provided, however, that such construction, tools, or equipment shall not reach a dB level
of more than thirty-five (35) dB for twenty-five (25) percent of an hour at any receiving
property line."
SECTION 2. The City Clerk shall certify to the adoption of this ordinance and shall cause the
same to be published as required by law.

SECTION 1. The Santa Clarita Municipal Code is hereby amended at Section 11.44.080 to
read as follows:
No person shall engage in any construction on private property when the construction is located
within 300 feet of an adjacent residentially zoned property except between the hours of 7:00 a.m.
to 7:00 p.m. Monday through Friday and 8:00 a.m. to 6:00 p.m. on Saturday. Further, no work
shall be performed on the following public holidays: New Year's Day, Independence Day,
Thanksgiving Day, Christmas Day, Memorial Day, and Labor Day.
Exemption:
1. Minor home repairs, construction of minor projects such as play houses, dog houses, etc.,
and similar minor home projects which are exempt from building permit requirements.
2. Emergency work as defined in Section 11.44.020D is permitted at all times.
The Building & Engineering Services Department may issue a permit for work to be done "after
hours" provided that containment of construction noises is provided.
SECTION 2. The City Clerk shall certify to the adoption of this ordinance and shall cause
the same to be published as required by law.
