HomeMy WebLinkAbout1996-06-25 - AGENDA REPORTS - SC DBAA AREA 3 (2)AGENDA REPORT City Manager Approval Item to be presented by; Bahman Janka PUBLIC HEARING DATE: June 25, 1995 SUBJECT: SANTA CLARITA DRAINAGE BENEFIT ASSESSMENT AREA 3, TRACT NO. 36496 LOCATED AT WHITES CANYON ROAD AND NADAL STREET - ANNUAL ASSESSMENT FOR FISCAL YEAR 1996-97 Resolution No. 96-57 DEPARTMENT: Building & Engineering Services BACKGROUND The County of Los Angeles previously established Drainage Benefit Assessment Area No. 3 to provide maintenance of a subsurface drainage system constructed to ensure stability of the slopes constructed for Tract No, 36496 (see attached report). The proposition was submitted to the eligible voters in this area, and a majority of voters approved the formation of the District and the levying of the assessment. Since that time, this former County area now falls within the jurisdiction of the City of Santa Clarita. Each year thereafter the City Council may determine and impose an annual assessment on the properties benefitting from the maintenance of their improvements, Drainage Benefit Assessment Area No. 3 was originally formed on January 28, 1986, The assessment last year was $122.47 per dwelling unit. The estimated assessment for Fiscal Year 1995-96 is $122.47 per dwelling unit, the same as last year. At this hearing, the Council may approve the report or modify the report and approve it. Once the assessments are confirmed, they will be placed on the County tax rolls to be collected with general County taxes. Notices of this hearing were published in compliance with Senate Bill 1977 to notify the owners of this assessment. Mayor announces decision CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING NOTICE OF A PUBLIC HEARING FOR THE ADOPTION OF A RESOLUTION DETERMINING AND IMPOSING THE ANNUAL ASSESSMENT FOR DRAINAGE BENEFIT ASSESSMENT AREA NO. 3, LOCATED AT THE NORTHWEST CORNER OF WHITES CANYON ROAD AND NADAL STREET (AMERICANA CANYON COUNTRY APARTMENT COMPLEX) PUBLIC NOTICE IS HEREBY GIVEN: That a Public Hearing will be held before the City Council of the City of Santa Clarita for the adoption of a resolution approving the Engineer's Report and levying the assessment for Drainage Benefit Assessment Area No, 3, located at the northwest corner of Whites Canyon Road and Nadal Street (Americana Canyon Country Apartment Complex). The purpose of the public hearing is to receive and consider public testimony regarding the District improvements and the proposed assessment for fiscal year 1996-97. The purpose of the District is to provide the mandatory maintenance for the existing slope drainage system in Area 3 of the City of Santa Clarita. The proposed maintenance cost is $122.47 per unit, the same as last year The hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, 1st floor, Santa Clarita, the 25th day of June 1996, at or after 6:30 p.m. Proponents, opponents and any interested persons may appear and be heard on this matter at that time. NED:lkl dWrid\v.db..3.96 RESOLUTION NO. 96-57 DRAINAGE BENEFIT ASSESSMENT AREA NO. 3 ARESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DETERMINING AND IMPOSING ANNUAL ASSESSMENT WHEREAS, the Board of Supervisors of the County of Los Angeles, State of California, established Drainage Benefit Assessment Area No. 3 on January 28, 1986, pursuant to the Benefit Assessment Act of 1982, Chapter 6.4 of Part 1, Division 2 of Title 5 of the Government Code of the State of California, to finance the operation and maintenance of drainage facilities constructed and dedicated as required for the recordation of a subdivision of land known as Tract No. 36496; and WHEREAS, Tract No. 36496 has been recorded and the drainage facilities have been constructed; and WHEREAS, this former County area has now become within the jurisdiction of the City of Santa Clarita; and WHEREAS, the Engineer's report containing a description of the service proposed, the revenue to be derived from the assessments, and a description of each parcel of real property proposed to be assessed for these services, has been filed with the City Clerk and presented to and considered by the City Council; NOW, THEREFORE, BE IT RESOLVED: Section 1 That the City Council of the City of Santa Clarita hereby determines that the assessment set out in accordance with the Engineer's report for Drainage Benefit Assessment Area No, 3 on file with the City Clerk of the City of Santa Clarita sets out the reasonable cost of the service provided; and Section 2. That the assessment shall be levied upon the respective parcels of land in the assessment area and collected for the 1996-97 Fiscal Year on the tax roll in the same manner, by the same persons, and at the same time as together with and separately from the general taxes of the City of Santa Clarita, without further action by this City Council. Section 3. Mt -a WIN The proposed service involves the maintenance and operation of the subsurface drainage system constructed for Tract No. 36496. Tract No. 36496 is located at Whites Canyon Road and Nadal Street, as shown on Exhibit "A". The subsurface drainage facilities consists of approximately sixteen hydraugers or horizontal perforated drain pipes and three observation wells located as shown on Exhibit "A", Each hydrauger is approximately 200 feet long. Maintenance and operation of the subsurface drainage facilities involves. 1. Periodic inspection, monitoring and evaluations. 2. Annual cleaning of the hydraugers. 3. Annual Geologist review with report and recommendations. 4, Necessary repairs and maintenance as recommended. 5. Installing paved swales. 6.. Pumping the three wells. The estimated total annual cost to provide this maintenance of the drainage devices is $28,413.04. 2. Description of Each Parcel Drainage Benefit Assessment Area No. 3 is comprised of Lots 1 and 2 of Tract No 36496, recorded in Book 1042, page 56 to 61 of maps in the office of the County Recorder. The basis of benefit was determined to be dwelling units, i.e., one dwelling unit = one benefit unit. Tract No. 36496 contains 232 dwelling units.
