On May 14, 1996, the City Council voted to support Assembly Bill 2495 which reconfigures the
Board of Directors of the Los Angeles County Metropolitan Transportation Authority (MTA).
At that time, it was anticipated that the four seats allocated to the 87 cities, exclusive of the
City of Los Angeles, and members selected by the City Selection Committee would be increased
to eight seats, two representatives per sector. Furthermore, alternate positions would be
eliminated.
On May 29, 1996, AB 2495 was amended to reflect an agreement between the two major
proponents of MTA reorganization, Los Angeles Mayor Richard Riordan and Los Angeles County
Supervisor Mike Antonovich, Under their agreement, the Los Angeles County Board of
Supervisors will make five appointments to the MTA Board. The Mayor of the City of Los
Angeles will be entitled to make four appointments. The City Selection Committee will be
entitled to make five appointments; one from each of the four previously established sectors and
one at -large appointment. Unlike the other City Selection Committee appointments, the at -
large appointment need not be an elected official
The legislation continues to eliminate the alternate positions. Under the new configuration,
appointees to the MTA will need to make a commitment to actively serve on the Board.
Currently, appointees or their alternates may attend meetings and vote which sometimes
creates confusion when the alternate has been participating in meetings but the voting member
actually appears for a critical vote and is in conflict with positions previously articulated by
their alternate.
Council Member Heidt serves as the alternate to MTA Board Chairman Larry Zarian. Under
AB 2495, Ms. Heidt would no longer maintain her committee positions at MTA or the Southern
California Regional Rail Authority. For Santa Clarita to continue to have a direct, active voice
at the MTA Board, a Member of the City Council would need to be appointed by the City

Selection Committee to either the North County/San Fernando Valley Sector seat or the At -
Large seat.
Supervisor Antonovich has requested that the City of Santa Clarita retain its support position
for AB 2495. He argues that the current version of the legislation provides an additional seat
for cities to ensure that the needs of smaller cities are addressed. It is currently believed that
some form of MTA reorganization will be enacted by the Legislature this year and that alternate
positions will be eliminated in any plan which is adopted.
The Assembly voted 42-29 on a mostly party line vote to approve AB 2495. The Senate
Transportation Committee will take up the bill on July 2, 1996.

An act to amend Section 130051 of [A>, and to repeal Section
130051.5 of, <A] the Public Utilities Code, relating to transportation.
LEGISLATIVE COUNSEL'S DIGEST
AB 2495, as amended, Margett. Los Angeles County Metropolitan
Transportation Authority: membership.
Under existing law, the Los Angeles County Metropolitan
Transportation Authority is comprised of 14 members, [D> 4 of whom are
mayors or council members of cities, one from each of 4 specified
sectors appointed by the Los Angeles County City Selection Committee. <D]
[D> Under existing law, alternates may be appointed for certain
members <D] [A> including 2 public members and one member of the City
Council of the City of Los Angeles appointed by the mayor of that city <A]
This bill would [D> increase the number of representatives of each
of the 4 sectors to 2, and <D] [A> delete the requirement that the
mayor's appointees be 2 public members and a member of the city council.
The bill would increase the authority's membership to 15 by including an
at -large member, who may be a mayor, a member of a city council, or a
nonelected official, appointed by the Los Angeles County City Selection
Committee. In the case of the mayor and the 5 members of the board of
supervisors who serve on the authority, the bill would allow each of
those positions to be filled by a designee of the specified member. The
bill <A] would delete the authorization for alternate members.
Vote: majority. Appropriation: no. Fiscal committee: no.
State -mandated local program: no.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. This act shall be known and may be cited as the
Margett-Antonovich Metropolitan Transportation Authority Reform Act of
1996.
SEC. 2. Section 130051 of the Public Utilities Code is amended to
read:
130051. The Los Angeles County Metropolitan Transportation
Authority consists of [D> 18 <D] [A> 15 <A] members, as follows:
(a) Five members of the Los Angeles County Board of Supervisors
[A>, or the designee of the individual supervisor <A] . If the number
of members of the Los Angeles County Board of Supervisors is increased,
the authority shall, within 60 days of the increase, submit a plan to
the Legislature for revising the composition of the authority.
[D> (b) The Mayor of the City of Los Angeles or an alternate
appointed by the mayor. <D]
[D> (c) Two public members and one member of the City Council of
the City of Los Angeles appointed by the Mayor of the City of Los
Angeles. <D]
[D> (d) Eight <D]
[A> (b) The Mayor of the City of Los Angeles, or the mayor's
designee, and three members appointed by the mayor. <A]
[A> (c) Four <A] members, each of whom shall be a mayor or a member
of a city council, appointed by the Los Angeles County City Selection
Committee. For purposes of the selection of these [D> eight <D]
[A> four <A] members, the County of Los Angeles, excluding the City of
Los Angeles, shall be divided into the following four sectors:
(1) The North County/San Fernando Valley sector.
(2) The Southwest Corridor sector.
(3) The San Gabriel Valley sector.
(4) The Southeast Long Beach sector.
The League of California Cities, Los Angeles County Division, shall
define the sectors. Every city within a sector shall be entitled to
vote to nominate one or more candidates from that sector for
consideration for appointment by the Los Angeles County City Selection
Committee. A city's vote shall be weighted in the same proportion that
its population bears to the total population of all cities within the
sector.
The members appointed pursuant to this subdivision, shall be
appointed by the Los Angeles County City Selection Committee upon an
affirmative vote of its members which represent a majority of the
population of all cities within the county, excluding the City of Los
Angeles.
The members selected by the city selection committee shall serve
four-year terms with no limitation on the number of terms that may be
served by any individual. The city selection committee may shorten the
initial four-year term for one or more of the members for the purpose of
ensuring that the members will serve staggered terms.
[A> (d) One at -large member, who may be a mayor, a member of a city
council, or a nonelected official, appointed by the Los Angeles County
City Selection Committee. <A]
[A> The member so appointed shall be selected by an affirmative vote
of those members of the committee that represent a majority of the
population of the cities within the county, excluding the City of Los
Angeles. <A]
(e) If the population of the City of Los Angeles, at any time,
becomes less than 35 percent of the combined population of all cities in
the county, the position of one of the [D> two public <D] members
appointed pursuant to subdivision [D> (c) <D] [A> (b) <A] , as
determined by the Mayor of the City of Los Angeles [D> by lot <D] ,
shall be vacated, and the vacant position shall be filled by appointment
by the city selection committee pursuant to subdivision [D> (d) <D]
[A> (c) <A] from a city not represented by any other member appointed
pursuant to subdivision [D> (d) <D] [A> (c) <A] .
(f) One nonvoting member appointed by the Governor.
[A> (g) Any member appointed to the Los Angeles County Metropolitan
Transportation Authority, including the designee of any member, shall
act for, and in the interests of, his or her appointing authority. <A]
[A> SEC. 3. Section 130051.5 of the Public Utilities Code is
repealed. <A]
[D> 130051.5. (a) The appointing authorities specified in
subdivisions (c) and (d) of Section 130051 may each appoint alternate
members to the Los Angeles County Metropolitan Transportation Authority
to represent, at a meeting of the authority, a regular member it has
appointed, but only if the regular member cannot attend the meeting. <D]
[D> (b) For purposes of this section, an alternate member shall be: <D]
[D> (1) In the case of the member of the City Council of the City of
Los Angeles appointed by the Mayor of the City of Los Angeles, any
person appointed by the mayor with the consent of the city council. If
the alternate member is a member of the city council, consent of the
city council is not necessary. In the case of the two public members
appointed by the mayor, any persons appointed by the mayor. <D]
[D> (2) In the case of a member appointed by the Los Angeles County
City Selection Committee, the mayor or city council member of a city
within the county, other than the City of Los Angeles or a city
represented by a regular member. <D]
[D> (c) Any alternate member appointed to the Los Angeles County
Metropolitan Transportation Authority, including any appointed pursuant
to Section 130051, shall act for, and in the interests of, his or her
appointing authority. <D]
[D> (d) Except for alternate members representing regular members
appointed pursuant to subdivision (d) of Section 130051, alternate
members appointed to the Los Angeles County Metropolitan Transportation
Authority shall not vote on any matter reserved to the authority
exclusively pursuant to Section 130051.12. <D]
[D> (e) (1) Every regular member and alternate member is subject to
Section 87100 of the Government Code. <D]
[D> (2) No alternate member shall make, participate in making, or in
any way attempt to use his or her appointed position to influence an
authority decision in which the alternate member knows or has reason to
know that the regular member, whom the alternate member represents, has
a financial interest. This paragraph does not apply to alternate
members representing regular members appointed pursuant to subdivision
(d) of Section 130051.'<D]

The State Senate is scheduled to take action on the proposed
Metropolitan Transportation Authority reorganization plan, AB
2495 (Margett), on Tuesday, July 2, 1996.
AB 2495 is vital to ensuring a representative MTA Board, which
meets all the needs of the county's 88 cities and its dispersed
population and employment centers.
The bill will make the following changes:
Maintain the four seats for the California League of Cities
and add one at -large member;
Maintain the City of Los Angeles representation: the Mayor,
one city council member and two citizen appointees;
Maintain the Los Angeles County representation;
Eliminate alternates.
I urge your city council to support AB 2495,.and request your
State Senator to vote in favor of this legislation.

Dear Assembly Member Margett:
I understand that Santa Clarita Intergovernmental Relations Officer
Michael Murphy met briefly with you last week in Sacramento to
advise you of the Santa Clarita City Council's unanimous support for
your Assembly Bill 2495 relating to reconfiguration of the Board of
Directors of the Los Angeles County Metropolitan Transportation
Authority (MTA).
The City of Santa Clarita supports AB 2495 because it provides
additional and fair levels of representation to all cities on the MTA
Board of Directors. Santa Clarita is within the North County/San
Fernando Valley Sector and one of our Council Members, Jan Heidt,
serves as the area alternate to current Board President Larry Zarian.
Under the existing structure, we believe that all communities in our
sector have enjoyed excellent representation. Through elimination of
the alternates and increasing the cities' representation by a like
amount, each sector in the county has the opportunity to ensure that
all communities have an opportunity to be heard at the MTA Board.
We have worked hard with the other cities in our sector to ensure that
every community's voice is heard. Three cities of north Los Angeles
County, Santa Clarita, Palmdale and Lancaster, are particularly
sensitive to any reconfiguration proposal which potentially provides us
with enhanced representation. The City of Santa Clarita believes that
your bill is most sensitive to our concerns.
