HomeMy WebLinkAbout1996-01-23 - AGENDA REPORTS - STORM DRAIN EASEMENT VACATION (2)City Manager Approval Item to be presented by: Bahman Janka CONSENT CALENDAR DATE: January 23, 1995 SUBJECT: STORM DRAIN EASEMENT VACATION RESOLUTION NO. 96-4 DEPARTMENT: Building & Engineering Services B & E Engineering, on behalf of FN Development Company, has requested that a storm drain easement located across a portion of Tract Map 44359-01, recorded May 11, 1995, be vacated. The proposed storm drain line has been relocated approximately ten feet to the north due to the reduction of the number of lots. A new easement has been deeded to the City of Santa Clarita. The location of the new storm drain and the vacation of the storm drain easement have been reviewed and approved by staff and the Los Angeles County Public Works Department. The California Street and Highways Code (CS&HC 8333c) states that "The legislative body of a local agency may summarily vacate a public service easement ... (if) the easement has been superseded by relocation and there are no other public facilities located within the easement." The easement in question qualifies under this section for a summary vacation. RECOMMENDATION The City Council adopt Resolution No. 96-4, accepting the storm drain easement relocation and approving the vacation of the existing storm drain easement pursuant to the California Street & Highways Code Section 8333(c). ATTACHMENTS Resolution No. 96-4 y Exhibit "B" Adopted: Exhibit B Storm Drain Easement NLA,�oM:hd. s A enda Item:f-- RESOLUTION NO. 96-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA VACATING STORM DRAIN EASEMENT IN THE CITY OF SANTA CLARITA WHEREAS, the subject storm drain easement, as described, has been superseded by relocation; and WHEREAS, the City of Santa Clarita has reviewed and approved the revisions to the storm drain and newly dedicated easements and has no objection to the vacation; THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as follows: SECTION 1. That the City of Santa Clarita accepts public easement in, over, and across said property legally described and shown in Storm Drain Easement Deed. SECTION 2. That the public easements in, over, and across said property legally described in Exhibit "A" and shown on Exhibit `B" attached are vacated pursuant to Chapter 4, Part 3, Division 9 of the Streets and Highways Code, State of California, commencing with Section 8333. SECTION 3. That the City Clerk of the City of Santa Clarita be instructed to record the certified original resolution and acceptance of the new easement, in the office of the Registrar -Recorder of the County of Los Angeles, at which time the area will no longer be a public easement.
