HomeMy WebLinkAbout1996-07-09 - AGENDA REPORTS - TAX SHARING SANDIST ANNEX (2)City Manager Approval *ex� Item to be presented by: Don Williams CONSENT CALENDAR DATE: July 9, 1996 SUBJECT TAX SHARING FOR SANITATION DISTRICT ANNEXATION NO. 290 RESOLUTION NO. 96-98 DEPARTMENT: Building and Engineering Services BACKGROUND Los Angeles County Sanitation Districts No. 26 and No. 32 provide wastewater treatment services through the Santa Clarita Valley Joint Sewerage System. To provide wastewater treatment service to property located outside of the Districts' service area boundary, the service area boundary must be expanded through the annexation process. To complete the annexation process, a tax -sharing resolution to provide the necessary funding to the Sanitation Districts is adopted by the public agencies responsible for providing services to the subject property. The governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged, between the affected agencies. For this annexation, a total of 1.1074 percent of the annual tax increment attributable to the land area involved in the annexation will be transferred to Sanitation District No. 26. Of this total, the City of Santa Clarita is contributing 0.1120 percent of its revenues from the annual tax increment for the annexation area. The annexation proposal is for a 3.84 acre property which is currently vacant. The City's General Plan land use and zoning designation for the site is CC (Community Commercial), and would typically allow retailing and service uses with a floor area ratio of 0.375:1. Future development of this site will provide increased tax revenues for all service -providing agencies. As proposed, this annexation should result in no adverse fiscal impact to the City. RECOMMENDATION; Adopt Resolution No. 96-98, approving and accepting the negotiated exchange of property tax revenues resulting from Sanitation District Annexation No. 290.. "ANNEXATION NO. 290" WHEREAS, pursuant to Section 99 and 99.1 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution, and WHEREAS, the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to County Sanitation District No. 26 entitled Annexation No. 290. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS 1: The negotiated exchange of property tax revenues resulting from the annexation of territory to County Sanitation District No, 26 in the annexation entitled Annexation No. 290 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 1996 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to County Sanitation District No. 26 a total of 1.1074 percent of the Annual Tax Increment attributable to the land area encompassed within Annexation No. 290. Said percentage has been determined on the basis of the following contributions. No additional transfer of property tax revenues shall be made from any other taxing agencies to County Sanitation District No. 26 as a result of annexation entitled Annexation No. 290. 4. No transfer of property tax revenues from properties within a community redevelopment project shall be made during the period that the entire tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year, and any amounts of property tax received in excess of that which is proper shall be refunded to the appropriate agency. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of County Sanitation District No. 26 and the governing bodies of City of Santa Clarita, Castaic Lake Water Agency, and Greater Los Angeles County Vector Control District, signatory hereto.
