Cushman CONSENT CALENDAR DATE: August 27, 1996 SUBJECT: SUMMARY VACATION OF A PORTION OF VIA PRINCESSA EAST OF MAY WAY RESOLUTION NO. 96-102 DEPARTMENT: Building and Engineering Services Via Princessa is a planned major roadway traversing the City in an east to west direction. As development progresses, developers are conditioned to construct those portions of Via Princessa that are within the boundary of their tract. The City, in cooperation with the County, has constructed other portions of Via Princessa outside the boundaries of the developers. The developer of Tract No. 38519 constructed Via Princessa easterly to a point on the easterly boundary of Tract No. 38519. After this project was completed, the City/County project, "Whites Canyon Road Phase III," was designed to extend Via Princessa from this point to Whites Canyon Road and Sierra Highway. To facilitate this design, it was necessary to realign the easterly 350 feet of the developer -built roadway. To accommodate this new alignment, a portion of the existing Via Princessa alignment that was dedicated for public use needs to be vacated. There appears to be no fiscal impact at this time. The City Council approve Resolution No. 96-102, which approves the Notice of Exemption and orders the vacation of Via Princessa east of May Way. RESOLUTION NO. 96-102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA SUMMARY VACATION OF A PORTION OF VIA PRINCESSA EAST OF MAY WAY AND RESERVING EASEMENTS FOR PUBLIC UTILITIES IN THE CITY OF SANTA CLARITA WHEREAS, a triangular portion of Via Princessa extending easterly from a point on the southerly boundary of Via Princessa, which is 450± feet from the easterly boundary of May Way to the easterly boundary of Tract No. 38519, a distance of 350± feet is no longer needed for present or prospective public use, including bicycle paths or trails; and WHEREAS, a portion of the Via Princessa alignment is superseded by the construction of City/County Project, "Whites Canyon Road - Phase III," and there are no in place public utility facilities in use that would be affected by the vacation; and WHEREAS, the City Council reviewed and approved the Notice of Exemption for the vacation of Via Princessa in compliance with the California Environmental Quality Act and that such notice was filed with the County Clerk of the County of Los Angeles; and NOW, THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, does resolve as follows: SECTION 1: That it is hereby found and determined that a triangular portion of Via Princessa extending easterly from a point on the southerly boundary of Via Princessa, which is 450± feet from the easterly boundary of May Way to the easterly boundary of Tract No. 38519, a distance of 350± feet legally described in Exhibit "A". and shown on Exhibit "B" attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, in the County of Los Angeles, State of California, is no longer needed for present or prospective use based upon the following facts: that this vacation does not cut off the sole access to the properties of any persons and does not terminate a public service easement; that the subject rights-of-way are superseded by relocation and are not required -for street or highway purposes; and that the subject rights-of-way are not required for general public access or circulation or for bicycle paths or trails. SECTION 2: That the public easements in, over and across said property for street and highway purposes legally described in Exhibit "A" and shown on Exhibit "B," which are attached, are vacated pursuant to Chapter 4, Part 3, Division 9 of the Streets and Highways Code, State of California, commencing with Section 8330. SECTION 3.: That the City Clerk of the City Council be instructed to record the certified original resolution, in the Office of the Registrar -Recorder of the County of Los Angeles, at which time the area will no longer be a public road.
