HomeMy WebLinkAbout1996-10-22 - RESOLUTIONS - ANNEX 1995-03 (2)RESOLUTION NO. 96-121 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, MAKING FINDINGS THAT INSUFFICIENT WRITTEN PROTESTS HAVE BEEN FILED AND APPROVING AND ORDERING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS "ANNEXATION NO. 1995-03" THE LOCKHEED BUSINESS PARK ANNEXATION TO THE CITY OF SANTA CLARITA WHEREAS, the Local Agency Formation Commission of the County of Los Angeles adopted its resolution on October 9, 1996, making determinations and approving the proposed "Lockheed Business Park" annexation, Annexation No. 1995-03, to the City of Santa Clarita of territory described in Exhibit "A" and mapped in Exhibit "B" attached hereto and by this reference incorporated; and, WHEREAS, the Local Agency Formation Commission of the County of Los Angeles has adopted Resolution No. 1996-50 directing the City of Santa Clarita to proceed with the annexation without notice and hearing; and, WHEREAS, the City Clerk set this item on the City Council Consent Calendar for Tuesday, October 22, 1996, at 6:30 p.m. in the Council Chambers of the City Hall, 23920 Valencia Boulevard, 1st Floor, Santa Clarita, California, as the date, time, and place for final action on the proposed annexation; and, WHEREAS, the property owners in the said territory were duly informed of their right to file a written protest against the annexation with the City Clerk at any time prior to the conclusion of the hearing on the proposed annexation; and, WHEREAS, no written protests were filed against this proposed annexation; and, WHEREAS, the Local Agency Formation Commission reviewed and found adequate the Environmental Impact Report prepared and certified by the City of Santa Clarita for this annexation and related entitlements; and, WHEREAS, the Local Agency Formation Commission amended the sphere of influence for the City of Santa Clarita to include the above -referenced property; and, WHEREAS, the Local Agency Formation Commission has determined the following: a) The subject site consists of an existing industrial 377 -acre site previously utilized by the property owner since the late 1950's as an aerospace research and development facility, with buildings totaling an area of 502,000 square feet. The property owner has also proposed the development of the subject site with four million square feet of new buildings for a business park; RESOLUTION NO. 96-121 October 22, 1996 - Page 2 b) The subject site is adjacent to the northwest portion of the City of Santa Clarita, in the area commonly known as the Valencia Industrial Center, and meets or exceeds the Local Agency Formation Commission's minimum contiguity requirement; c) The site has been prezoned to BP (Business Park) consistent with the City of Santa Clarita General Plan, allowing the proposed business park development, which is consistent and compatible with adjacent established land uses; d) Once annexed, the City will provide municipal services. WHEREAS, the Local Agency Formation Commission approved the Lockheed Business Park property description for the boundaries of the territory set forth in Exhibits "A" and "B"; and, WHEREAS, the Local Agency Formation Commission approved this proposed annexation subject to the following conditions: a) The subject territory would also be annexed to the Consolidated Fire Protection District; and, b) The subject territory would be withdrawn from County Road District No. 5; and c) The City Council of the City of Santa Clarita is directed to initiate proceedings in compliance with the Los Angeles County Local Agency Formation Commission's resolution approving and ordering City of Santa Clarita Annexation No. 1995-03; and, d) The City is authorized by Local Agency Formation Commission Resolution No. 1996-50, to proceed without notice and/or hearing pursuant to Government Code Section 56837. WHEREAS, the reason for this annexation is to fulfill the property owners' request to have the site annexed into the City of Santa Clarita to allow the proposed business park development, to secure municipal public services, and promote sound planning and land use practices in the affected territory; and WHEREAS, the regular County assessment roll is utilized by this City; and WHEREAS, the affected territory will not be taxed for existing bonded indebtedness of this City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: RESOLUTION NO. 96-121 October 22, 1996 - Page 3 SECTION 1. The City Council hereby declares said territory is found to be uninhabited and a legal description of the boundaries of the annexation is set forth in Exhibit "A" and a map of the boundaries is set forth in Exhibit "B," attached hereto and made a part hereof. SECTION 2. In accordance with Section 57075 of the Government Code, it is hereby found that no written protests have been filed on this action by any affected property owner owning less than 50% of the total assessed value of land within the territory. SECTION 3. The City Council hereby orders the territory described in Exhibits "A" and "B" to be annexed and directs the City Clerk to transmit eight (8) certified copies of this resolution with applicable fees required by Section 54902.5 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Los Angeles County. SECTION 4. The City Clerk shall certify to the adoption of this resolution and certify this record to be a full, true, correct copy of the action taken.
