HomeMy WebLinkAbout1996-01-09 - RESOLUTIONS - LAFCO ANNEX 1992-03 AMEND (2)RESOLUTION NO. 96-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THAT THE LOCAL AGENCY FORMATION COMMISSION OF LOS ANGELES COUNTY AMEND THE EXISTING SPHERE OF INFLUENCE FOR THE CITY OF SANTA CLARITA, FOR PROPOSED ANNEXATION NO. 1992-03, "SECO CANYON" ANNEXATION TO THE CITY OF SANTA CLARITA (MASTER CASE NO. 92-094) WHEREAS, Section 56848.5 of the Cortese -Knox Local Government Reorganization Act states that no proceedings for an inhabited annexation my be initiated, by a City of over 100,000 residents in a County of over 4,000,000 people, unless the proposal is consistent with the sphere of influence of the affected city; and WHEREAS, the City of Santa Clarity desires to initiate proceedings pursuant to the Cortese -Knox Local Government Reorganization Act of 1985 (Revised 1994), Division 3, commencing with Section 56000 of the California Government Code, for proposed Annexation No. 1992-03 ("Seco Canyon' -Annexation); and WHEREAS, the territory proposed to be annexed is inhabited and is described in Exhibit T A and a map of the boundaries is set forth in Exhibit B, attached and by this reference incorporated; and WHEREAS, this proposal is inconsistent with the City of Santa Clarita's Sphere of. Influence as designated by the Local Agency Formation Commission on January 22, 1992, and would require amending thereof pursuant to this proposal; and WHEREAS, the territory within this proposed amendment contains development of an urban nature that is physically adjacent to, and economically and socially integrated, with the City of Santa Clarita; and WHEREAS, this proposed amendment will enable orderly growth and development in an area adjacent to the City of Santa Clarita; and WHEREAS, this proposed amendment will coordinate property development standards and encourage timely provision of adequate and essential services such as streets, sewer, water, police and fire protection, parks and recreation, flood control and solid waste disposal services; and, WHEREAS, the territory within this proposed amendment to the Sphere of Influence is entirely contained within the Planning Area of the General Plan for the City of Santa Clarita, and, WHEREAS, this proposed amendment will promote, assist and enhance the property owners' ability to plan comprehensively, and with reasonable assurance, for the ultimate use and development of their lands, and Resolution No. 96-5 Page 2 WHEREAS, this proposed amendment will enable appropriate local government oversight, the expansion and creation of a more logical City boundary, and the exercise of sound planning and land use practices, and WHEREAS, this proposed amendment will enable the City of Santa Clarita to provide needed urban services and respond to requests of local residents for annexation of the affected territory to the City of Santa Clarita. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Santa Clarita, California, does hereby determine and find as follows: SECTION 1. This Resolution is hereby adopted by the City Council, and the Local Agency Formation Commission of Los Angeles County is hereby requested to initiate proceedings for the amendment of the Sphere of Influence for the City of Santa Clarita as described in Exhibit A and mapped in Exhibit B, incorporated by this reference, in the manner provided by the Cortese -Knox Local Government Reorganization Act of 1985 (Revised 1994). SECTION 2. The City Council hereby directs and authorizes the City Clerk of the City of Santa Clarita to forward a certified copy of this Resolution with applicable fees, if any, and other information as required by Section 56383 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Los Angeles County. SECTION 3. The City Clerk shall certify to the adoption of this resolution and certify this record to be a full, true, correct copy of the action taken.
