Cushman DATE: May 27, 1997 SUBJECT: SANTA CLARITA DRAINAGE ASSESSMENT AREA 19, FOUR OAKS - ANNUAL ASSESSMENT FOR FISCAL YEAR 1997-98 DEPARTMENT: Building & Engineering Services By action of the City Council of the City of Santa Clarita, on November 28, 1995, proceedings were initiated for the levying of annual assessments within the boundaries of Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks" (hereinafter referred to as the "District"), for the payment of all costs required for the continued maintenance, operation, and servicing of subsurface drainage improvements pursuant to provisions of the Benefit Assessment Act of 1982, being Chapter 6.1, Part 1, Division 2, of the Government Code of the State of California. In addition, the City Engineer was directed to prepare a written Engineer's Report and file it with the City Clerk pursuant to Section 54716 of the Government Code. There are 174 property parcels within the boundaries of the District, being a subdivision of lots in the City of Santa Clarita. Plans and specifications indicating the general nature, location, and extent of improvements are on file with the City Engineer and are hereby made a part hereof by reference. The attached map, Exhibit "A," identifies the boundaries of the District. The revenue derived from the proposed assessments will be used to maintain, operate, and service dewatering facilities and appurtenant drainage structures. The assessment for fiscal year 1997-98 is $19.00. The proposed assessment is in compliance with Proposition 218. In compliance with Government Code requirements, this report will be heard at a public hearing on June 24, 1997. Notices. for the public hearing will be published as required. RECOMMENDATION The City Council establish the date of June 24, 1997 for the public hearing for Santa Clarita Drainage Assessment Area 19, Four Oaks, and direct the City Clerk to publish notices for the public hearing. II� /, �- 201. _ �� as /e �2 O7 a` 2021 Y 10�/ rx.. :. r. • eJ d•. / .0 .196 = - �• �` "' slp r. / BOUNDARIES OF FOUR OAKS `DRAINAGE BENEFIT -ASSESSMENT DISTRICT ENGINEER'S REPORT CITY OF SANTA CLARITA DRAINAGE BENEFIT ASSESSMENT DISTRICT NO. 19 "FOUR _OAKS" FISCAL YEAR 1997/1998 SANTA CLARITA, CALIFORNIA SUBMITTED MAY 27, 1997 ENGINEER'S REPORT CITY OF SANTA CLARITA DRAINAGE BENEFIT ASSESSMENT AREA NO. 19 "FOUR OAKS" RIGHT TO VOTE ON TAXES ACT (PROPOSITION 218) On November 5, 1996, the electorate approved Proposition 218, Right to Vote on Taxes Act, which added Articles XIII C and XIII D to the California constitution. The Proposition affects all assessments upon real property for a special benefit conferred on the property. Assessments imposed under the Benefit Assessment Act of 1982 are these types of special benefit assessments. The Proposition exempts assessments for drainage systems. 2. DESCRIPTION OF THE SERVICE The proposed service involves the maintenance and operation of the subsurface drainage system and pump station constructed for properties shown on Exhibit A bounded by Four Oaks Street, Glasser Avenue, Delight Street, and Camp Plenty Road. The subsurface drainage facilities consists of seven observation wells without pumps, a pump station to dispose of the accumulation of any water within the fill area of the development, and six access shafts. The drainage facilities are shown on Exhibit A. Maintenance and operation of the subsurface drainage facilities involves: 1) periodic inspection, monitoring and evaluations; 2) well and access shaft unclogging and clean out where necessary; 3) maintenance of pump stations; 4) annual geologist review with a report and recommendations; 5) installation of dewatering devices and other mitigation measures; and 6) periodic repairs when necessary. The estimated total annual cost to provide this maintenance is $6,612.00. For Fiscal Year 1997-1998 improvements will not be installed. The proposed assessment for Fiscal Year 1997-1998 will be $38.00 per benefit unit. However, carryover from Fiscal Year 1996-1997 and City Council contribution of half of the assessment will cover this year's.maintenance and the amount placed on the property tax bills will be $19.00 for this fiscal year. BENEFIT AREA The area located within the district boundaries shown on Exhibit A is the area of benefit and the imposition of the of the benefit assessment will be restricted to this area. The basis of benefit was determined to be dwelling units, i.e., one dwelling unit = one benefit unit. Drainage Benefit Assessment Area No. 19 is comprised of 174 dwelling units with each dwelling on equivalent to one benefit unit as listed below. If changes occur in assessor's parcel numbers, the proposed assessment will be apportioned according to the basis of benefit. 4.
