Cushman SUBJECT: SANTA CLARITA DRAINAGE ASSESSMENT AREA 19, LOCATED AT FOUR OAKS STREET AND GLASSER AVENUE - ANNUAL ASSESSMENT FOR FISCAL YEAR 1997-98 RESOLUTION NO. 97-80 DEPARTMENT: Building & Engineering Services The City of Santa Clarita had previously established Drainage Benefit Assessment Area No. 19 to provide for the maintenance of a subsurface drainage system for dewatering in the Four Oaks area. The proposition was submitted to the eligible voters in this area, and a majority of voters approved the formation of the District and the levying of the assessment. Each year thereafter, the City Council determines and imposes an annual assessment to cover the costs of maintaining the system. The construction project, which is designed to dewater this area by pumping shallow groundwater into the river, is currently out to bid and construction should be completed within six months. The estimated assessment for Fiscal Year 1997-98 is $19.00 per unit. The proposed assessment is in compliance with Proposition 218. The affected property owners have been notified of the public hearing in compliance with Senate Bill No. 1977. City Council conduct the public hearing, adopt Resolution No. 97-80, approve the Engineer's Report as presented, and authorize the levy of assessments for fiscal year 1997-98. Resolution No. 97-80 Exhibit "A," Location Map NED:lkI Adopted: /� Q �] ...61N.97 -80..d Adopted•�Z�/ RESOLUTION NO. 97-80 DRAINAGE BENEFIT ASSESSMENT AREA NO. 19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DETERMINING AND IMPOSING ANNUAL ASSESSMENT FOR SANTA CLARITA DRAINAGE BENEFIT ASSESSMENT AREA NO. 19, "FOUR OAKS" WHEREAS, The City of Santa Clarita City Council established Drainage Benefit Assessment Area No. 19 on November 28, 1995, pursuant to the Benefit Assessment Act of 1982, Chapter 6.4 of Part 1, Division 2 of Title 5 of the Government Code of the State of California, to finance the operation and maintenance of subsurface drainage facilities constructed for dewatering in the "Four Oaks" area; WHEREAS, Section 54715 of the Act permits the City Council, after notice and public hearing, to adopt a resolution determining and proposing an annual assessment on each parcel of real property within Drainage Benefit Assessment Area No. 19, "Four Oaks"; WHEREAS, the City Council has directed the City Engineer to prepare a report (hereinafter referred to as the "Engineer's Report") which is on file with the City Clerk; WHEREAS, there 174 parcels of property within the boundaries of the district; WHEREAS, the Engineer's Report containing a description of the service proposed, the revenue to be derived from the assessments, the district boundary, and a description of each parcel of real property proposed to be assessed for these services, has been filed with the City Clerk and presented to and considered by the City Council; WHEREAS, the City Council has examined and considered the Engineer's Report, which shall govern among other things as to the improvements and service to be provided,.and the proceedings prior thereto; WHEREAS, notice of said hearing was duly given as required by the Act; and WHEREAS, at the time, date, and place so fixed, a public hearing was duly held by the City Council at which all written protests or objections were presented and read, and all persons desiring to be heard thereon were heard, and the City Council gave all persons present an opportunity to be heard in respect to any matter relating to the Engineer's Report or any of the proceedings therefor. NOW THEREFORE, BE IT RESOLVED: SECTION 1. The City Council is satisfied with the correctness of the Engineer's Report including the proceedings and all matters relating thereto. All protests and objections have been heard at the public hearing. RESOLUTION NO. 97-80 June 24, 1997 - Page 2 SECTION 2. That the City Council of the City of Santa Clarita hereby determines that the assessment set out in accordance with the Engineer's Report for Drainage Benefit Assessment Area No. 19 on file with the City Clerk of the City of Santa Clarita sets out the reasonable cost of the service provided and the cost is related to the benefit to each parcel and that the annual aggregate amount of the assessment does not exceed the estimated annual cost of providing the service. SECTION 3. The City Council determines that the proposed assessment is in compliance with Proposition 218, and proposes for adoption an annual assessment on each parcel of real property within Santa Clarita Drainage Benefit Assessment Area No. 19, "Four Oaks." SECTION 4. The City Council determines that the amounts to be assessed against the individual parcels described in the Engineer's Report are hereby approved and confirmed and are hereby levied by said Council as special assessments against said parcels for fiscal year 1997-1998. SECTION 5. That the assessment of $19.00 per unit shall be levied upon the respective parcels of land in the assessment area and collected for the 1997-98 fiscal year on the tax roll in the same manner, by the same persons, and at the same time as together with and separately from the general taxes of the City of Santa Clarita, without further action by this City Council. SECTION 6. The foregoing resolution was on the 24th day of June 1997, adopted by the City Council of the City of Santa Clarita, and ex -officio the governing body of all other special assessment taxing districts for which the City Council so acts. ASSESSMENT DISTRICT CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING NOTICE OF A PUBLIC HEARING FOR THE ADOPTION OF A RESOLUTION DETERMINING AND IMPOSING THE ANNUAL ASSESSMENT FOR DRAINAGE BENEFIT ASSESSMENT AREA NO. 19, FOUR OAKS PUBLIC NOTICE IS HEREBY GIVEN: That a public hearing will be held before the City Council of the City of Santa Clarita for the adoption of a resolution approving the Engineer's Report and levying the assessment for Drainage Benefit Assessment Area No. 19, located at Four Oaks. The purpose of the meetings is to receive and consider public testimony regarding the District improvements and the proposed assessment for fiscal year 1997-98.. The purpose of the District is to provide the mandatory maintenance for the existing subsurface drainage system, pump station and observation wells. The proposed maintenance cost is $19.00 per unit per year, which is included on the tax bills for the properties in the district. The public hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, 1st floor, Santa Clarita, the 24th day of June 1997, at or after 6:30 p.m. Proponents, opponents, and any interested persons may appear and be heard on this matter at that time. Further information may be obtained by contacting the City Clerk's office, Santa Clarita City Hall, 23920 Valencia Boulevard, 3rd Floor, Santa Clarita or call Nancy Delange at (805)286-4067. If you wish to challenge this order in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council, at or prior to the public hearing.
