SUBJECT: LANDSCAPE MAINTENANCE CONTRACT FOR LANDSCAPE DISTRICT
ZONE NO. 5 - MAY WAY TRACT 48108
DEPARTMENT: Parks, Recreation, and Community Services
RECOMMENDATION
City Council award contract to Oak Springs Landscape for $53,762, and authorize a 15 percent
contingency expenditure. The funds have been budgeted in Fiscal Year 1997/98 in Account
No. 75118001. Authorize the City Manager or his designee to execute and sign all documents,
subject to City Attorney approval.
BACKGROUND
Oak Springs Landscape Company has installed the landscape and irrigation for the Landscape
Maintenance District for Tract 48108. The developers landscape contractor installed the plants
and irrigation systems per the plans. An inspection was completed and the landscape and
irrigation have been approved. As a result, the ninety -day establishment period has begun.
Upon completion of the ninety -day establishment period for the plants, the City will assume
responsibility for the landscape maintenance. When the City assumes the responsibility for the
landscape, the developer must provide a 30 -day warranty on ground cover and shrubs, and a
one-year warranty on trees and the installation of the irrigation system.
The City must then contract with a vendor to provide the landscape maintenance service.
Because it is beneficial to have continuity of the maintenance while the plants are being
established, it is usually desirable to have the same vendor be responsible for the area for the
first year to prevent invalidation of the warranty and to minimize disputes over operation and
maintenance of the irrigation system.
The purchasing policy provides that if the current work requirements are an extension of the
original work, and substantially rely on the experience gained during the original work, the
vendor is considered a sole source. The contract amount is competitive with what other vendors
would charge.

FISCAL IMPACT
The Landscape Maintenance District expenses are funded through annual assessments. There
is no fiscal impact by this action.
