Brad Therrien CONSENT CALENDAR DATE: September 23, 1997 SUBJECT: MAGIC MOUNTAIN PARKWAY(VIA PRINCESSA NEW ROAD APPROVAL OF PROGRAM SUPPLEMENT NO. M002 PROJECT NO. S0005 DEPARTMENT: Transportation and Engineering Services This project is a multi-year effort for the design of the extension of Magic Mountain, Parkway and Via Princessa from San Fernando Road to Rainbow Glen Drive. Master Agreement No. 07-5450 for federal aid projects was executed by the City and the State on July 15, 1997. Under the terms of this agreement, the City agreed to comply with all federal/state regulations. However, no funding was established to reimburse the City for our efforts, since this is always addressed in a separate Program Supplement Agreement. Program Supplement No. M002 is the agreement for this project. To date, work on this new road includes the Project Study Report (PSR), Project Report (PR), Environmental Impact Study/Environmental Impact Report (EIS/EIR), and an Alignment Study. Federal participation through Surface Transportation Program -Local (STP -L) totals $1,623,810. Program Supplement No. M002 allocates $442,650 of this STP -L funding for the first phase of preliminary engineering, including the Environmental Impact Study/Environmental Impact Report, Project Report, Project Study Report, and Alignment Study. Future Supplemental Agreements will be necessary to allocate the remaining funds to the design and construction phases. Resolution 97-58, approved by City Council on June 24, 1997, authorizes the City Manager or his designee to execute all Program Supplements to Master Agreement No. 07-5450. Council approve Supplement No. M002 for the Magic Mountain Parkway/Via Princessa New Road, Project No. 50005, and authorize the City Manager or his designee to approve all documents relating to this supplement. Number: 07-468254 This Program Supplement is hereby incorporated into the Agency -State Agreement for Federal Aid which was entered into between the Agency and the State on 07/15/97 and is subject to all the terms and conditions thereof. This Program Supplement is adopted in accordance with Article I of the aforementioned Master Agreement under authority of Resolution No.�i7-S $ approved by the Agency on &- ate/-qj4 (See copy attached). The Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the covenants or remarks setforth on the following pages. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal -Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR -2A) or the FNM -76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs. 3. This Program,Supplement will be revised at a later date to include other phases of work. 4. The Federal funds for this project will be made available upon passage of the State Budget Act of 1997/98. 5. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal -Aid Program. 6. Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- tant or sub -contractor incurring over $25,000 on the project. The audit report must state the applicable cost principles utili- zed by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart part C - 22, Allowable Costs. Page 2 of 2
