By participating in the agreement, the City gains valuable exposure to the individuals at the MTA representing our area, which can translate to a facilitation of the funding request and acquisition process. The position is held by a staff member working out of the City of Glendale's offices, who will continue to perform the duties with the MTA invoicing for services. All twelve cities within the corridor have participated in the agreement for the past two years. At this time, the MTA is requesting that all participating cities sign renewal cost sharing agreements for the upcoming year. The amount requested from each city corresponds to the percentage of population for the corridor. As Santa Clarita has 17.54% of the population, our share of the funding is. $12,276.The funds are dispensed from the Department of Public Works' Transit Division. The agreement is identical to the one adopted last year with no changes in the cost amount. The City of Glendale will continue to provide administration, office space, and clerical support, while the MTA staff member continues in the position. Staff recommends that the City Council: Direct the City Manager to execute the renewal of the 1997 Corridor Staffing Cost Sharing Agreement. DEPARTMENT: Community Development BACKGROUND At the study session held on November 5, 1996, the City Council agreed to authorize the City Manager to retain legal counseling in connection with the Tesoro Del Valle project. A number of legal firms were contacted, and in late November the firm of McCutchen, Doyle, Brown & Enersen, LLP, was engaged by the City under the approval of the City Council. In McCutchen's scope of work, estimated legal fees for their services were stated to be between $60,000 and $75,000. As of February 28, 1997, legal costs have equaled approximately $60,500. Funds for such services were not budgeted in the 1996-1997 budget. Staff is requesting a reimbursement of funds to the Planning Division's Professional Services account for the payment of legal services provided by McCutchen, Doyle, Brown &_Enersen, LLP, and is also requesting authorization for the City Manager or designee to enter into a contract for the remaining services to be provided by the firm in tracking the Tesoro Del Valle project. Currently, all legal services have been paid for out of the Planning Division's 1996-1997 base budget, which was not originally calculated to handle such costs. RECOMMENDATION . Staff recommends that the City Council: 1. Authorize the City Manager, or designee, to enter into a contract with McCutchen, Doyle, Brown & Enersen, LLP for the remaining legal services to be provided; and 2. Appropriate $75,000 to Account No. 3100-8110 (Professional Services) from the City Council Contingency Account No. 1240-7401 for legal services provided by the firm between November 1996 and June 1997.
