HomeMy WebLinkAbout1997-01-28 - AGENDA REPORTS - NEWHALL REDEVELOPMENT PROJECT (2)City Manager A roval Item to be presented by: Ken Pulskamp NEW BUSINESS DATE: January 28, 1997 SUBJECT: NEWHALL REDEVELOPMENT PROJECT - RESOLUTION NO. 97-4 DEPARTMENT: Newhall Redevelopment Agency In accordance with provisions of Community Redevelopment Law, a city council is obligated to call for the formation of a project area committee when a redevelopment project is being established if: (1) A substantial number of low-income persons or moderate -income persons, or both, reside within the project area, and the redevelopment plan as adopted will contain authority for the agency to acquire, by eminent domain, property on which said persons reside; or (2) The redevelopment plan as adopted contains one or more public projects that will displace a substantial number of low-income or moderate -income persons. To ensure that the formation of a project area committee will not be required for the Newhall Redevelopment Project, the Council is requested to formally foreclose the possibility that low - or moderate -income residents will be displaced by the Project. Staff brought this item to the Newhall Redevelopment Committee for their consideration at the their meeting of January 13, 1997. The Committee's recommendation is to formally exclude eminent domain authority within the redevelopment plan with regard to properties occupied for residential purposes, and to exclude any public projects that will displace a substantial number of low-income or moderate - income residents. In making this recommendation, the Committee wanted language in the adopted redevelopment plan indicating that the City had the ability to reverse this eminent domain issue in the future if necessary, provided that all of the necessary steps of Redevelopment Law were followed. Staff recommends that the City Council adopt the attached resolution determining that a project area committee shall not be established for the Newhall Redevelopment Project. ATTACHMENTS Resolution No. 97-4 Adopted: m GEA: -11 n h4dv,a,01„97.1 RPROVEIg enda Item: RESOLUTION NO. 97-4 A RESOLUTION OF THE SANTA CLARITA CITY COUNCIL DETERMINING THAT A PROJECT AREA COMMITTEE SHALL NOT BE ESTABLISHED FOR THE NEWHALL REDEVELOPMENT PROJECT WHEREAS, pursuant to the Community Redevelopment Law of the State of California, Health and Safety Code Sections 33000 et seq. ("CRL"), the City Council of the City of Santa Clarita has previously found the need for the Santa Clarita Redevelopment Agency to function in the community with this Council sitting as the directors of said Agency; and, WHEREAS, on the 23rd day of January 1990 the City Council adopted Resolution No. 90-19 designating a redevelopment survey area to determine whether the formation of a redevelopment project from within said area is feasible; and, WHEREAS, on November 12, 1996, by Resolution No. P 96-26, the Santa Clarita Planning Commission selected the planning boundaries of the Newhall Redevelopment Project and approved a preliminary plan for the redevelopment of said Project; and WHEREAS, Section 33385 of the CRL provides for the City to establish a project area committee to participate in the processing of a new redevelopment project area whenever: (1) A substantial number of low-income persons or moderate -income persons, or both, reside within the project area, and the redevelopment plan as adopted will contain authority for the agency to acquire, by eminent domain, property on which said persons reside; or (2) The redevelopment plan as adopted contains one or more public projects that will displace a substantial number of low-income or moderate -income persons, or both; and WHEREAS, neither of the foregoing criteria from Section 33385 will be met by the Newhall Redevelopment Project, for the following reasons, which are collectively sufficient to render a project area committee unnecessary: (i) the redevelopment agency's use of eminent domain under the redevelopment plan will be limited so as to prevent the agency from acquiring by eminent domain property on which persons reside, as more specifically provided below; and (ii) the redevelopment plan as adopted will not contain any public projects that will displace a substantial number of low-income persons or moderate -income persons, or both; NOW, THEREFORE, it is hereby resolved by the Santa Clarita City Council as follows: SECTION 1: The foregoing recitals are hereby adopted as findings and conclusions of the City Council. SECTION 2: The redevelopment plan to be formulated for the Newhall Redevelopment Project shall expressly limit the redevelopment agency's use of eminent domain so as to prevent the agency from acquiring by eminent domain property on which any persons reside. For purposes of this resolution, the term "property on which persons reside" shall mean property which has been continuously occupied as a residence during the 90 -day period preceding the adoption by the agency of a resolution of necessity for acquisition of the property. SECTION 3: The redevelopment plan to be formulated for the Newhall Redevelopment Project shall not contain any public projects that will displace a substantial number of low-income or moderate -income persons, or both.
